(District III) DATE: April 5, 2005 PAGE: 2 NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of April 5,2005 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT NAME OF BANKlSURETY September 23, 2003 Liberty Mutual Insurance Company BE IT FURTHER RESOLVED the payment(labor and materials)surety for$1,760,750.00, Bond No. 070000617 issued by the above surety be RETAINED for the six month lien guarantee period until October 5,2005,at which time the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that the private improvements have been COMPLETED and are NOT ACCEPTED NOR DECLARED as County Loads, at this time. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refund the $35,215.00 cash security for ,performance (Auditor's Deposit Permit No. 411016, dated August 28, 2003) plus interest in accordance with Government Code Section 53079,if appropriate,to Hofmann Land Development Company pursuant to the requirements of the Ordinance Code; and the Subdivision Agreement and surety bond,Bond No. 070000617, dated August 25, 2003, are exonerated.
