SUBJECT: ADOPT Resolution No. 2005/188 to summarily vacate an excess portion of
1 st Avenue South. [CDD-CP#76-44]

The Board of Supervisors of Contra. Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer
required for street or highway purposes, is made pursuant to Division 9, Park 3, Chapter 4
of the Streets and Highways Code, commencing with Section 8330, et. seq. A description
of the offered area to be vacated is described in Exhibit "A" and shown on Exhibit „g„
attached hereto.
This vacation request is for an excess right of way for a street or highway not
required for street or highway purposes. (S. & H. Code Section 8334).

This Board declares that the hereinabove described proposed vacation is HEREBY
ORDERED VACATED subject to any reservation and exception described in Exhibit "A„
and shown on Exhibit "B" attached hereto. From and after the date of this Resolution is
recorded, the portion vacated no longer constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution
in the office of the County Recorder.

All that certain real property situate in the County of Contra Costa, State of California, described
as follows:
Being a portion of First Avenue South, shown as "Walnut Street" on the "Map of Pacheco,
Contra Costa County, California, 1869" filed in Book "E" of Maps at Page 95, Contra Costa
County Records, further described as follows:
BEG NNING at an angle point in the easterly boundary line of Parcel 2, as said Parcel is shown
on the Record of Survey filed October 31, 1975, in Book 59 of Licensed Surveyors' Maps at
Page 43, Contra Costa County Records, at the most southerly comer of the parcel of land
described in the deed from Pacheco Town Council to Frank Fernandes, recorded April 13, 1984
in Book 11741 of Official Records at Page 942, Contra Costa County Records;
THENCE from said Point of Beginning along said easterly line of Parcel 2 (59-LSM-43) South
81158'52" West, 91.00 feet;
THENCE South 4'30'32" East, 50.16 feet;
THENCE leaving said easterly line along the southerly line of First Avenue South North
81058'52" East, 150.01 feet to a point on a line parallel with and 60.00 feet westerly measured at
right angles from the proposed centerline of Contra Costa Highway now known as Pacheco
Boulevard as said centerline is shown on the map entitled "A Precise Section of the Streets and
Highways Plan, Contra Costa County, Contra Costa Highway" recorded on August 15, 1962 in
Book 4182 of Official Records at Page 133;
THENCE leaving said southerly line along said parallel line North 7'56'54" West, 25.03 feet to
a point on the centerline of said First Avenue South;
THENCE leaving said parallel line along said centerline South 81'58'52" West, 56.00 feet to a
point on the southerly prolongation of the westerly line of said Fernandes Parcel (11741 O.R.
942);
THENCE leaving said centerline along said southerly prolongation North 7'56'54" West, 25.03
feet to the Point of Beginning.
