BACKGROUND: The project involves the development of an approximately 157,370 sq. ft. office building and a 530- space parking garage. The first one-year extension was granted by the Planning Commission on May 7, 2002, extending the development plan to May 3, 2003. The second one-year extension was granted by the Planning Commission on June 10, 2003, extending the development plan to May 3, 2004. The third extension was granted May 18, 2004, extending the permit to May 3, 2005. Since the approval, the County and the County Redevelopment Agency consented to EJP-I's assumption of the Spieker Properties' rights and obligations with respect to the parcel pursuant to the Consent and Agreement dated December 11, 2001, and the amended Development Agreement approved October 19, 2004. The applicant requests a one-year extension of the final development plan due to economic factors affecting the development of the site, the overall downturn in the Bay Area economy and specifically the commercial office market. The request is consistent with the P-1 Ordinance Code and the Disposition and Development Agreement.
