SUBJECT: Accepting completion of public (widening of Vernal Drive) and private (Pleasant
Knoll Court)improvements,warranty period,and release of cash deposit for faithful
performance, Subdivision 91-07725, Alamo area. (District III)
The Public Works Director has notified this Board that the public(widening of Vernal Drive)
and private(Pleasant Knoll Court)improvements in Subdivision 91-07725 have been completed as
provided in the Subdivision Agreement with GHC Investments, LLC,heretofore approved by this
Board in conjunction with the filing of the Subdivision Map.

SUBJECT: Accepting completion of public (widening of Vernal Drive) and private (Pleasant
Knell Court)improvements,warranty period,and release of cash deposit for faithful
performance, Subdivision 91-07725, Alamo area. (District III)

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of Apri15,2005 thereby establishing the six-month terminal period for the filing of liens in case of
action under said Subdivision Agreement:

BE IT FURTHER RESOLVED that the private improvements have been COMPLETED
and are NOT ACCEPTED NOR DECLARED as County Roads, at this time.
BE IT FURTHER RESOLVED the payment (labor and materials) surety for $99,550.00,
Bond No. 8674745 issued by the above surety be RETAINED for the six month lien guarantee
period until October 5,2005,at which time the Clerk of the Board is AUTHORIZED to release the
surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the widening of Vernal Drive is ACCEPTED and
DECLARED to be a County road;the right-of-way was conveyed by separate instrument,recorded
on October 28, 1965 , in Book 4982 of Official Records on Page 27.
The Board hereby FINDS that the improvements have satisfactorily met the guaranteed
performance standards for the period following completion and acceptance.NOW THEREFORE BE
IT RESOLVED that the Public Works Director is AUTHORIZED to refund the $2,000.00 cash
deposit (Auditor's Deposit Permit No. 379878, dated January 9, 2002) plus interest to GHC
Investments,LLC in accordance with Government Code Section 53079(if appropriate),Ordinance
Code Section 94-4.406, and the subdivision agreement.
BE IT FURTHER RESOLVED that the warranty period has been completed and the
Subdivision Agreement and performance/maintenance surety for $197,100.00, bond number
8674745, issued by Developers Surety and Indemnity Company, are exonerated.
All deposit permits are on file with the Public Works Department.
