(District III)Project No. 7761-6X5148 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the General Manager of Canyon Lakes Geologic Hazard Abatement District(CHAD) to execute a contract amendment with ENGEO, Inc. effective March 8, 2005 to increase the payment limit by $24,500 to a new payment limit of$50,000 for Geotechnical Engineering Services for the GRAD, FISCAL IMPACT: There is no impact to the County General Fund.The Canyon Lakes CHAD is funded through revenues generated by special assessments on properties within the boundaries of the Canyon Lakes CHAD. (District III) Project No. 7761-6X5148 DATE: March 8, 2005 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: In the summer of 2004,the GHAD entered into an agreement with ENGEO,Inc. to retain the geotechnical firm to provide services within the Canyon Lakes GHAD area. At the time of the contract initiation, ENGEO was not providing services for any large-scale projects identified within the Canyon Lakes GHAD. It was expected that the on-call services would be limited to reading monitoring instruments throughout the GHAD and occasional consultation. Since that time,an investigation has been undertaken by the Canyon Lakes GHAD to evaluate elevated water levels identified at the San Ramon Regional Medical Center and at the Lakes on Canyon Lakes Home Owners Association property. The GHAD discovered that water levels at the Medical Center were higher than expected based on original design conditions and need to be lowered. Therefore,the GHAD retained ENGEO to install additional piezometers at the site to better evaluate water levels to aid in design and post installation evaluation of the proposed water-lowering horizontal drains. The GHAD will also use ENGEO to provide design consultation and construction observation services for installation of the horizontal drains. The GHAD also discovered that water levels at the Lakes on Canyon Lakes Homeowners Association property also warrant further attention.The GHAD has retained ENGEO to conduct engineering analyses to evaluate the potential impact. It is likely that water levels will have to be lowered,again using horizontal drains.If this work is necessary, the GHAD will use ENGEO to provide design consultation and construction observation services for installation of the horizontal drains. ENGEO is conducting this work and providing this data to the Canyon Lakes GHAD through regular communications. They are also participating in meetings, alongside GHAD staff, with the San Ramon Regional Medical Center, the City of San Ramon and the Homeowners Associations for Canyon Lakes. Without the augmentation of their budget, work would have to cease immediately on these projects. CONSEQUENCES OF NEGATIVE ACTION: Without Board approval,work on these important projects would have to cease immediately and the water levels would not be lowered, resulting in slopes with compromised stability. 4y 9 SECOND AMENDMENT TO CONTRACT This Contract amendment is effective March 8, 2005, between the Canyon Lakes Geologic Hazard Abatement District (Public Agency), an agency formed under Section 26500 of the Public Resource Code and ENGEO, Inc. (Contractor), a company doing business at 2010 Crow Canyon Place, Suite 250, San Ramon, CA 94583-4634. WHEREAS,Public Agency and Contractor previously entered into a contract dated July 1, 2004,which Contract was authorized by the General Manager; WHEREAS, said contract was amended on October 19, 2004 increasing the contract payment limit from$15.,000 to $24,500; THEREFORE, Public Agency and Contractor mutually agree to amend said contract to increase the contract payment limit from$24,500 to $50,000. In all other respects,the contract dated July 1, 2004 shall remain in full force and effect. In WITNESS WHEREOF,Public Agency and Contractor have executed this Contract as of date written on the first paragraph of this Contract.
