Upon acceptance of the Work as complete by the Board of Supervisors and upon request of Subdivider,the amounts held as securitywmay be reduced in accordance with Sections 94-4.406 and 94-4.408 of the Ordinance Code. 4. GUARANTEE AND WARRANTY OF WORK. Subdivider guarantees that the Work shall be free from defects in material or workmanship and shall perform satisfactorily fora period of one(1)year fr:m and after the Board of Supervisors accepts the work as complete in accordance with Article 96.4.6,"Acceptance,'of the Ordinance Code. Subdivider agrees to correct,repair,or replace at Subdivider's expense,any defects in said Work. The guarantee period does not apply to road improvements for private roads that are not to be accepted into the County road system. 5. PLANT ESTABLISHMENT WORK.Subdivider agrees to perform plant establishment work for landscaping installed under this Agreement Said plant establishment work shag consist of adequately watering plants,replacing unsuitable plants,doing weed,rodent and other pest control and other work determined by the Public Works Department to be necessary to en sure establishment of plants. Said plant establishment work shall be performed for a period of one(1)year from and after the Board of Supervisors accepts the Work as complete. 6. IMPROVEMENT PLAN WARRANTY.Subdivider warrants the improvement plans for the Work are adequate to accomplish the Work as promised in Section 2 and as required by the Conditions of Approval for the Subdivision. If,at any ffine before the Board of Supervisors accepts the Work as complete or during the one year guarantee period,said improvement plans prove to be inadequate in any respect,Subdivider shall make whatever changes are necessary to accomplish the Work as promised. T NO WAIVER BY COUNT Y. inspection of the Work and/or materials,or approval of the Work and/or materials or statement by any officer,agent or employee of the County indicating the Work or any part thereof complies with the requirements of this Agreement,cr acceptance of the whole or any part of said Work and/or materials,or payments therefor,or any combination or all of these acts,shag not relieve the Subdivider of its obligation to fulfill this Agreement as prescribed;nor shall the County be thereby stopped from bringing any action for damages arising from the failure to comply with any of the terms and conditions hereof. 8. INDEMNITY. Subdivider shail defend,hold harmless and indemnity the indemnitees from the liabilities as defined in this section: A. The indemnitees benefitted and protected by this promise are the County and it special districts,elective and appointive boards,commissions,officers,agents and employees. 8. The liabilities protected against are any liability or claim for damage of any kind allegedly suffered,incurred or threatened because of actions defined below,and I ncluding personal injury,death,property damage,inverse condemnation,or any combination of these,and regardless of whether or not such liability,claim or damage was unforeseeable at any time before County reviewed said Improvement plans or accepted the Work as complete,and including the defense of any suit(s),action(sl or other proceedings)concerning said liabilities and dalms. C. The actions causiN liability are any act or omission{negligent or non-negligent)in connection with the matters covered by this Agreement and attributable to Subdivider,contractor,subcontractor,or any officer,agent,or employee of one or more of them. D. Non-Conditions.The promise and agreement in this section are not conditioned or dependent on whether or not any Indemnitee has prepared,supplied!Xapproved any plans)or specifications)in connection with this Work or Subdivision,or has insurance or other indemnificallon covering any of these matters,orthatthe allaged damage resulted partly from any negligent or willful misconduct of any indemnitee. 9. COSTS. Subdivider shall pay,when due,all the costs of the Work,incuding but not limited to the costs of relocations of existing utilities required thereby;Inspections;material checks and tests;and other costs incurred by County staff arising from or related to the Work,and prior to acceptance of the Work as complete or expiration of any applicable warranty periods, whichever is later. 10. SURVEYS. Subdivider shall set and establish survey monuments in accordance with the filed map and to the satisfaction of the County Road Commissioner-Surveyor before acceptance of the Work as complete by the Board of Supervisors. 11. NON-PERFORMANCE AND COSTS. If Subdivider falls to complete the Work within the time specified in this Agreement,and subsequent extensions,or falls to maintain the Work,County may proceed to complete and/or maintain the Work by contract or otherwise and Subdivider agrees to pay all costs and charges incurred by County(including,but notgmited to,engineering,inspection,surveys,contract,overhead,etc.)immediately upon demand. Once action is taken by County to complete or maintain the Work,Subdivider agrees to pay all costs incurred by County,even if Subdivider subsequently completes the Work Should County sue to compel performance under thisAgreement or to recoveroosts incurred in completing ormaintaNng the Work,Subdivider agrees to pay all attorney's fees, staff costs and all other expenses of litigation incurred by County in connection therewith,even If Subdivider subsequently proceeds to complete the Work. 12. 1NCORPORATIONIANNEXATION. If,before the Board of Supervisors accepts the Work as complete,the Subdivision is included in territory incorporated as a city or is annexed to an existing city,except as provided In this paragraph,County's rights under this Agreementand/orarry deposit,bond,©clatter of credit securing said dots shag be transferred to the new or annexing city.Such city shag have all the rights of a third party beneficiary against Subdivider,who shag fulfill all the terms of this Agreement as though Subdivider had contracted with the city originally.The provisions of paragraph 8(indemnity)shall continue to apply in favor of the indemniteas listed in paragraph B.A.upon any such incorporation or annexation. 13. RECORD MAP. In consideration hereof,County shag allow Subdivider to file and record the final map or parcel map for said Subdivision. 14. RIGH iT OF ENTRY.Subdivider hereby consents to entry onto the Subdivision property,and onto any other property over which Subdivider has land rights and upon which any portion of the Work kis to be installed pursuant to tyre improvement pians,by County and its forces,including contractors,for the purpose of inspection,and!in the event of nor-performa.ca of this Agreement by Subdivider,completion and/or maintenance of the Work. The enclosed letter requests that the state officially respond to your attached letter regarding disaster assistance status for Bethel Island Municipal Improvement District(BINGD). In 1987,Amendment#5 to DR-758 was added to the Federal Emergency Management Agency (FEMA)/State Agreement. This amendment established short-term hazard Mitigation plan(HMP) standards for reclamation districts(RDs)affected by flooding. It also required RDs to upgrade delta levees to 100-year frequency elevations and to ensure that RDs met the cross section established in the Short-Term levee Rehabilitation plan of 1913,which includes all-weather access roads. All RDs were given a deadline of September 1991 to meet the minimum criteria for Amendment#5,or they would be permanently excluded (ineligible)for future disaster grants. UAfortunately,BIMID did not meet that deadline and,as a result,was permanently excluded by FEMA for future disaster grants. An appeal wad-,Med January 10,2003,with FEMA on behalf of the district,and the Governor's Office of Emergency Services (CIES)is awaiting FEMA's response to that appeal. CIES has subsequently issued a policy"Me no dated February 19,2004,stating that if,at the time of a disaster,an RD meets the minimum applicable standards established by DWR,OES would consider it an eligible applicant for disaster assistance. The Department of Water Resources(DWR)would ultimately decide if the applicant meets the required standards. Also,CIES will determine whether specific levee facilities were adequately maintained,prior to approving funding for the repair of a specific levee. At the date of this memo,it is our understanding that BIMID has not resolved all pending issues for compliance with the DWR standard. However,during the next disaster event,if DWR can verify that BIMID meets the established DWR standards and the facilities were adequately maintained,BIMID levees would be considered for California Disaster Assistance Act(CDAA)funding. OES is also wort with FEMA to eliminate Amendment#5 or sign a new Memorandum of Understanding tha#zs ilat restrictive to the 1991 RD eligibility deadline. Bragdon Director, Community Development Department County Administration Building 651 Pine Street 4th Floor, 'north Wing Martinez, California 94553-0095 RE: Bethel Island Floodplain Development Dear Mr. Bragdon: On February 20, February 26, and April 3, 1992, Robert Durrin of this office toured Bethel Island in an attempt to determine whether or not Contra Costa County is properly applying its Floodplain Management Ordinance to new development and substantia' improvements. His observations resulted in numerous questions being raised. Mr. Durrin photographed a number of structures that, apparently, have recently b�en constructed or improved and may be in violation of your Ordinance. Discussions with members or your regulatory staff did not contribute to the formulation of favorable conclusions. Even though staff members readily adrnitted difficulties in administration and enforcement, they were adamantly opposed to suLlgestions Mr. Durrin attempted to offer. It appears that staff members are not sufficiently familiar with the County Floodplain Management Ordinance and that details of floodplain development requirements are being overlooked. For instance, flood venting applications seem to be inconsistent resulting in lowest floors that could be 10 feet or more below the required elevations. Materials and methods being utilized by developers may not be resistant to flood damage, and uses of enclosed areas below the flood elevations are questionable. It was indicated to Mr. Durrin that the County has not been reaulatinz all development in floodplains as required by Federal rules and the County's own ordinance (see definition of development). As a result, some development is being allowed and some structures are being built that appear to violate the Ordinance. The regulatory review procedures may be deficient. For example, the proposed post office building on Bethel Island was approved by both the Community Development Department and the Building Department. The Community Development Department did require, as a condition for approval, that all conditions of the Floodplain Management Ordinance be met. The Building Department, according to information made available to this agency, approved the design of the building as being compliant with the Ordinance. It was not. The Ordinance requires that the Director of the Community Development Department implement and administer the Floodplain Management Program: and that all applicable general and specific standards be applied to all development
