SUBJECT: Request for Authorization for the County Librarian to Accept Institute of Museums
and Library Services Grant Funds for the Contra Costa Reads! Program
SPECIFIC REQUEST (S) OR RECOMMENDATION (S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Authorize the Contra Costa County Librarian to enter into an agreement with the Institute of Museum and
Library Services and accept $71,424 for the period of January 1, 2005 to December 31, 2007 for the Contra
Costa Reads!program.
FINANCIAL IMPACT
Contra Costa County Library staff will visit every 2nd grade class in the county, introduce the students to library
services, and ensure that all 12,000 students have library cards. Each student will also receive a new paperback
book to start a personal library. The Institute of Museum and Library Services will provide $71, 424 to purchase
the paperback books, book bags, and bookmarks needed for the program. The Library will provide $73,576 of
in-kind support to cover the costs of staff time to conduct class visits, purchase library materials appropriate for
2nd grade students and furnish other supplies for the program.
BACKGROUND
Studies consistently show that reading is the single most important factor in academic success. The Contra
Costa County Library is committed to promoting reading and learning in our schools and community through
Contra Costa Reads!, a program that unites the library with schools, parents, educators and community leaders
behind the very important goal of helping kids learn how to read. By exposing students to the library as they are
learning to read, the library reinforces classroom instruction, encourages students and their parents to use library
services, and promotes life-long reading and learning.
CONTRA COSTA CHILDREN'S IMPACT STATEMENT
Students in the second grade are at an age of rapid learning, and the development of reading comprehension
skills is essential to their academic success. Free-choice reading significantly aids that development and access
to the range of books available at the library encourages the exploration of reading for pleasure. The students'
engagement with reading and the library at this age ensures that they will maintain those relationships
throughout their lives. Contra Costa Reads! aids academic achievement and encourages lifelong learning by:
• Introducing every second grader to their local library
• Providing all 12,000 second graders with a library card
• Allowing every second grader to start a personal library with a new paperback book

II. FINANCIAL IMPACT:

For several years, the County Counsel's Office has provided legal services to the Contra
Costa County Office of Education. This contract will enable County Counsel to continue to

to receive compensation therefor.

1. PARTIES. This Agreement is entered into by and between the COUNTY OF CONTRA COSTA,
a political subdivision of the State of California(hereinafter referred to as "COUNTY"), and
the CONTRA COSTA COUNTY SUPERINTENDENT OF SCHOOLS and CONTRA COSTA COUNTY
BOARD OF EDUCATION (hereinafter both referred to as "COUNTY SCHOOLS").
2. TERM. The term of this Agreement shall be from January 1,2005,through January 1,2006,
unless renewed before then or terminated pursuant to Section 7. Commencing January 1,
2006, the term shall be automatically extended from year to year, unless the Agreement is
terminated in accordance with the provisions of Section 7.
3. COUNTY'S OBLIGATION.
A. In consideration of County Schools'promise to pay the amounts stated herein,County,
through its County Counsel, shall provide oral and written legal advice to County Schools
and represent County Schools in all administrative proceedings and litigation except:
1) Suits involving personal injury and property damage.
2) Matters involving labor negotiations.
3) Matters involving student's claims regarding
provision of special education services.
B. Matters pertaining to unfair practice charges arising under the Educational
Employment Relations Act(Gov. Code §§ 3540 et seq.)may be handled by
County Counsel, but County Schools will first consult with and obtain County
Counsel's concurrence for representation and handling of any such matters as they
may arise.
C. County Counsel shall be truthful with County Schools, cooperate with it, keep it
informed of developments,perform the obligations required by this Agreement,
and immediately notify County Schools of any discovered actual or apparent
conflicts for representation decisions.
4. COUNTY SCHOOLS'OBLIGATION,
A. Compensation. In consideration of the County's provision of these legal services
during the term of this Agreement, the County Schools shall pay the County as
follows:

A) For Legal Services; effective January 1, 2005
1. Deputy Mary Ann Mason $ 129.79/hr.
2. Deputy Kevin T. Kerr $ 133.04/hr.
3. Deputy David F. Schmidt $ 133.04/hr.
4. Deputy Esther Milbury $ 114.65/hr.
5. Any other Deputy County Counsels utilized at
the same hourly rate charged county departments,
but in no event to exceed $ 114.65/hr.
6. Assistant County Counsels $ 143.85/hr.
7. Legal Services Clerk $ 45.45/hr.
B) Commencing October 1, 2005, the compensation set forth in subsection A)
above may be adjusted annually in accordance with County's salary
adjustment process,provided that County shall give County Schools at
least 30 days written notice of such adjustment.
2. For reasonable costs, as follows:
A) Automobile mileage at$.405 per mile.
B) Reporter's fees,witness fees, any extraordinary postage and
long distance telephone charges, electronic research, and all filing
fees and court expenses as incurred, all at County's cost.
B. Obligations. In connection with any legal work assigned to County Counsel,
County Schools shall take reasonable steps to respond to County Counsel's
inquiries thereon and pay the County's bills as provided in Section 5.
5. BILLING AND PAYMENT: County Counsel shall submit itemized billings to County
Schools at least quarterly. County Schools shall pay the billings within 45 days of
receipt.
6. EMPLOYEE STATUS. In performing legal services for the County Schools, the County
Counsel and his staff shall be regarded as employees of County Schools for the purposes
of the Tort Claims Act (Gov. Code § 810 et seq.; specifically, § 820 et seq. and § 825 et
seq.).

7. TERMINATION. This agreement may be terminated at any time by either party, at its sole
discretion, upon 30 days' advance written notice to County Schools by the County or
upon 5 days' advance written notice to the County by County Schools.
8. ONGOING LITIGATION. If this Agreement is not renewed or otherwise terminated during
its term and County Counsel is representing County Schools in ongoing litigation,
County Counsel shall cooperate with the attorneys chosen by County Schools to enable
them to assume control of such litigation on behalf of County Schools.

Services under this contract indirectly support the third community outcome established in the Children's
Report Card: "Families that are Economically Self-Sufficient"by providing training to obtain and maintain
non-subsidized employment.
]BACKGROUND
If granted, funding will be used to support high wage/high growth employment in the petrochemical and
manufacturing industries in Contra Costa County and contiguous region. Funds will be used to train workers
for entry-level positions, upgrade training for existing workers, and encourage youth and non-traditional
workers to enter manufacturing and petrochemical employment. The grant award will be for a two-year period.

behalf of the County, Grant Award#28-653-2 from the California Wellness Foundation, in an amount not
to exceed $120,000, for the Healthy Neighborhoods Project, for the period from January 1, 2005 through
December 31, 2007.

The goal of this Project is to expand the Healthy Neighborhoods Project to provide education to low-
income Contra Costa County communities with regard to environmental health issues including, but not

health and justice concerns, conducting three (3)Environmental Justice Town Hall meetings in Bay Point
and creating environmental justice framework and a comprehensive vision for future work on
environmental health issues.
Approval of Grant Award#28-653-2 will allow the County to expand the Healthy Neighborhoods Project
to provide environmental health education to low-come residents,through December 31,2007.

behalf of the County, Standard Agreement #29-611-22 (State #05-6002) with the State Office of
Statewide Health Planning and Development, to pay County in an amount not to exceed $154,845, for
continuation of the Family Practice Residency Program,for the period from July 1,2005 through June 30,
2008.
FISCAL IMPACT:
Approval of this Agreement will result in a total of$154,845, for the period from July 1,2005 through

BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
Since 1978, the Board of Supervisors has approved subsequent Agreements with the State to provide

funds for the County's Family Practice Residency Program.
Approval of Standard Agreement#29-611-22 will extend the program through June 30,2008 and allow
the Department to continue the maintenance of effort levels by training a total of three(3)family practice
residents each Fiscal Year.

for submission to the State.
