SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): ADOPT Resolution No. 2005/ 101 for Subdivision 01-08572, accepting completion of private improvements (South Lakefront Loop,Gold Creek Circle,Denali Drive,Heron Drive,Arcadia Circle,and Oasis Drive),for project being developed by Hofmann Land Development Company, Discovery Bay area. (District III) FISCAL IMPACT: None. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The private improvements have been installed in a good workmanlike manner as required by the improvement plans and in conformance with the County Ordinance Code. CONSEQUENCES OF NEGATIVE ACTION: The six-month lien period will not start,the surety bond will not be exonerated,the cash bond will not be refunded, and the billing account will not be closed and liquidated. (District III) DATE: March 1, 2005 PAGE: 2 NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of March 1,2005 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT NAME OF BANK/SURETY November 4, 2003 Liberty Mutual Insurance Company BE IT FURTHER RESOLVED the payment(labor and materials)surety for$1,585,900.00, Bond No. 070000634 issued by the above surety be RETAINED for the six month lien guarantee period until September 1, 2005, at which time the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that the private improvements have been COMPLETED and are NOT ACCEPTED NOR DECLARED as County Roads, at this time. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refund the $31,800.00 cash security for performance (Auditor's Deposit Permit No. 413390, dated October 16, 2003) plus interest in accordance with Government Code Section 53079,if appropriate,to Hofinann Land Development Company pursuant to the requirements of the Ordinance Code; and the Subdivision Agreement and surety bond (performance), Bond No. 070000634, dated October 10, 2003, are exonerated.
