RECOMMENDATION(S):
ADOPT Resolution No. 2005/ 100 for Subdivision 01-08571, accepting completion of private improvements
(South Lakefront Loop,Fern Ridge Circle, and Gold Creek Circle),for project being developed by Hofmann Land
Development Company, Discovery Bay area. (District III),
.FISCAL IMPACT:
None.
BACKGROUND/.REASON(S) FOR RECOMMENDATION(S):
Thep rivate improvements have been installed in a good workmanlike manner as required by the improvement plans
and in conformance with the County Ordinance Code.
CONSE UENCES OF NEGATIVE ACTION:
The six-month lien period will not start, the surety bond will not be exonerated and the cash bond will not be
refunded.

The Public Works Director has notified this Board that the private improvements (South
Lakefront Loop, Fern Ridge Circle, and Gold Creek Circle) in Subdivision 01-08571 have been
completed as provided in the Subdivision Agreement with Hofmann Land Development Company,
heretofore approved by this Board in conjunction with the filing of the Subdivision Map.

SUBJECT: Accepting completion of private improvements (South Lakefront Loop,Fern Ridge
Circle,and Gold Creek Circle),Subdivision 01-08571,Discovery Bay area.(District

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of March 1,2005 thereby establishing the six-month terminal period for the filing of liens in case
of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment(labor and materials)surety for$1,037,750.00,
Bond No. 070000633 issued by the above surety be RETAINED for the six month lien guarantee
period until September 1,2005, at which time the Clerk of the Board is AUTHORIZED to release
the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the private improvements have been COMPLETED
and are NOT ACCEPTED NOR DECLARED as County Roads, at this time.
BE IT FURTHER RESOLVED that there is no warranty period required, and the Public
Works Director is AUTHORIZED to refund the $20,755.00 cash security for performance
(Auditor's Deposit Permit No. 413390, dated October 16, 2003) plus interest in accordance with
Government Code Section 53079,if appropriate,to Hofmann Land Development Company pursuant
to the requirements of the Ordinance Code; and the Subdivision Agreement and surety bond,Bond
No. 070000633, dated October 10, 2003, are exonerated.
