All costs incurred by Contra Costa County to evaluate the proposal(s) submitted in response to the Buchanan Field Airport RFP are covered under an initial deposit of $50,000.00 submitted by the proposer, and additional deposits to be made by the proposer upon request by the County. BACKGROUND / REASONS FOR RECOMMENDATION On July 12, 2004, the Board of Supervisors issued a Request For Proposals (RFP) for the development of a replacement airport to which current aviation uses at Buchanan Field would be relocated and for the evaluation of the reuse and development potential of the Buchanan Field Airport property into a new mixed-use community that would include residential, commercial, and public uses. The Buchanan Field RFP set November 9, 2004 as the due date to submit proposals to Contra Costa County in response to the RFP. One (1) proposal was submitted in response to the RFP. It was submitted by Buchanan Field Partners, LLC, a development team comprising Shapell Industries of Northern California, Lennar Communities, and Garaventa Enterprises. The proposal calls for a development concept for reuse of the airport property that would include an urban mixed- use district, provision of a 60-acre central commons to house civic amenities, several residential neighborhoods providing a wide range and mix of housing types, and proposed transit options aimed at easing access for future residents and visitors. In addition, the proposal outlines an approach to providing a replacement airport site in central Contra Costa County, including the identification of two possible sites. The proposal has been posted on Contra Costa County's main web page, as follows: www.co.contra-costa.ca.us under County News / What's New. On November 30, 2004, in accordance with Government Code section 25515.2 subd. (f) the Board of Supervisors adopted Resolution No. 2004/ 597 declaring its intention to consider proposals in response to the Buchanan Field Airport RFP at the regular Board meeting on Tuesday, March 22, 2005, at 1:00 p.m. Subsequent to the Board's 11/30/2004 action, the Interdepartmental Screening Committee on Aviation Alternatives for Buchanan Field ("Screening Committee") has been engaged in the process of evaluating the proposal submitted by Buchanan Field Partners, LLC. Members of the Board have been provided under separate cover a copy of a December 23, 2004 letter to Buchanan Field Partners, LLC, which provided them with the County's initial review of their proposal. This letter requested Buchanan Field Partners, LLC, provide clarifying information On certain questions about their proposal and submit an additional deposit. At a February 17, 2005 meeting between County officials (Supervisor District IV, Community Development Director, and Assistant Chief County Counsel) and the representatives of Buchanan Field Partners, LLC, the Buchanan Field Partners, LLC, representatives requested a six (6) month extension from the March 22, 2005 date. The purpose of the six-month extension is to resolve matters pertaining to the proposed replacement airport sites, as identified in their proposal, and to respond to issues that were raised in the County's 12/23/2004 letter. March 15,2005 Board of Supervisors Resolution of intent To Consider Proposals on Buchanan Field Airport RFP On September 20.2005 Page 3 BACKGROUND / REASONS FOR RECOMMENDATION — continued The attached resolution (Exhibit "A") would accommodate Buchanan Field Partners, LLC, request to provide a six-month extension by vacating the March 22, 2005 date, as originally established in Board Resolution No. 2004/597, and declare the Board's intent to consider proposals in response to the Buchanan Field Airport RFP at the regular Board of Supervisors meeting on September 20, 2005, at 1:00 p.m. Staff notes that there is not a Board meeting scheduled for March 22, 2005, and in accordance with California Government Code section 25515.2, it would be appropriate for the Board to vacate the March 22nd date and declare its intention to consider the proposals in response to the Buchanan Field Airport RFP to a new Board of Supervisors meeting date. The following persons presented testimony: Dianne Cole, Friends of Concord Airport, 2320 Tomar Court,Pinole; Joe Rodriguez, Federal Aviation Administration, 831 Mitten Road#210, Burlingame; John Pfeifer,, Aircraft Owners and Pilots Association, PO Box 492728,,Redding; Richard Roberts,,Mt. Diablo Pilots Association, 603 Paso Nogal, Pleasant Hill; David Evans, The Airport Coalition, 319 Rock Creek Way, Pleasant Hill; Pat Hewlett,, Chair, Contra Costa County Aviation Advisory Commission, 3692 DeRosa Court, Concord; Russell Roe., 2121 Walnut Street, Martinez; Roger Goodwin; Dan Coleman, Buchanan Field Partners, LLC,, 2678 Bishop Drive, San Ramon. Supervisor DeSaulnier commented that it was important, especially after having come this far,,to exhaust any possibilities of an improved airport at an alternate site. He further noted that should it ever come into fruition, it would be a unique in furthering smart growth efforts to accommodate growth demands, without expanding the urban limit line or inducing sprawl. Dennis Barry, Community Development Department informed the Board that the report containing the details of costs incurred and recovered will be available for review when the invoice being prepared is complete. He further noted that no work is currently in progress on this matter. Having discussed the matter and hearing from those who desired to speak,the Board took the following action: 1. ADOPTED Resolution No. 2005/114 declaring the Board's intent to consider Proposals submitted in response to the Buchanan Field Airport RFP on September 20, 2005; 2. and DIRECTED the Community Development Department Director to send a letter to Buchanan Field Partners,, LLC, notifying them that no further work on this proposal will be done by County staff, requesting payment for services provided to date, and the earliest possible notification, up to 6 months from now,, on the feasibility of an alternate site for the airport. NOES: None ABSENT: P 6-e;4P ABSTAIN: None RESOLUTION NO. 2005/114 SUBJECT: Intent to Consider Proposals Submitted In Response To The Buchanan Field Airport RFP, Issued on July 12, 2004 The Board of Supervisors of Contra Costa County RESOLVES that: WHEREAS, the Buchanan Field Airport is a 495-acre site owned and operated by the County of Contra Costa, which includes a general aviation airport, a nine-hole golf course and driving range with a pro shop, and non-aviation commercial development, situated in an unincorporated area in north-central Contra Costa County, between the cities of Concord, Martinez, and Pleasant Hill. WHEREAS, on July 12, 2004, the Board of Supervisors approved the issuance of Request For Proposals (RFP) for the development of a replacement airport to which the current aviation uses at Buchanan Field Airport would be relocated and to evaluate the reuse and development potential of the Buchanan Field Airport property into a new mixed-use community that would include residential, commercial, and public uses. WHEREAS, the Buchanan Field Airport property is intended to be used for residential, commercial, public or cultural development or both if airport uses are relocated to a replacement airport in central Contra Costa County that is equal to or better than Buchanan Field Airport. WHEREAS, on November 9, 2004, Buchanan Field Partners, LLC, submitted a proposal in response to the Buchanan Field Airport RFP issued by the Board of Supervisors. WHEREAS, pursuant to Government Code section 25515.2, subd. (f), the Board on November 30, 2004, passed Resolution No. 2004/597, declaring its intention to consider proposals in response to the Buchanan Field Airport RFP at the regular meeting of the Board on Tuesday, March 22, 2005, at 1:00 p.m. WHEREAS, Buchanan Field Partners, LLC, has requested a six (6) month extension from the March 22, 2005, date, in order to resolve matters pertaining to the proposed replacement airport sites, as identified in its proposal, and,to respond to issues that have been raised by the County since the submittal of that proposal. IT IS HEREBY RESOLVED, pursuant to Government Code section 25515.2, subd. (f), that the Board vacates the March 22, 2005, date to consider proposals and declares its intent to consider proposals in response to the Buchanan Field Airport RFP at the regular meeting of the Board on Tuesday, September 20, 2005, at 1:00 p.m. IT IS FURTHER RESOLVED, pursuant to Government Code section 25515.2, subd. We ask that the Board of Supervisors adhere to the promises made by this board to the business and aviation communities when this so called"process"began. The board promised to see if relocating Buchanan Field was feasible,and if not,the supervisors would work to make Buchanan Field"the best it can be",and you promised to make the study swift. The RFP"process"was long and painful,but the board assured the community that it would be fair. Now the board is considering going back on their word,and reward a developer 6 months more time to amend a deficient proposal and allow the developer time to lobby power brokers for passage. Maybe the board needs to be reminded: L There is no mandate by the people to close or relocate Buchanan Airport;nor is there any public support. 2. There is not one publicly elected official on the local,county,state,or national level that supports the actions of this board.All of them state they believe that Buchanan must remain.This includes State Senator Dianne Feinstein,US Representative Don Young, Congressional Representatives Miller and Tauscher, 3. The cities of Concord and Pleasant Hill have gone on record as being opposed to the closure and/or relocation of Buchanan Field. 4. The Chambers of Commerce of Concord,Pleasant Hill and Pittsburg are on record as opposing the relocation of Buchanan Field. 5. Reach,the emergency helicopter service,is on record,before this very board,as saying that if the airport is relocated,Reach will discontinue service and move out of Contra Costa County. That would be a serious blow to emergency medical care to all of Contra Costa. One has to wonder why the board will not listen to the people,not just pilots,but the supervisors own peers,business people,and citizens from various walks of life;not to mention the FAA which has said Buchanan Field must remain open. The county has known the Buchanan Field Partners proposal is deficient as evidenced by the 28 page letter the county sent BFP on 12-23-04. No viable central county site for an alternate airport exists. BFP has had almost 3 months to reply.Granting a 6 month extension insults the intelligence of all citizens of this county and questions the credibility of this board. We believe the board should adhere to its own promise and the terms of the RFP and rule this RFP as non-responsive. Show some courage and do the right thing,the thing you were elected to do: represent, HE THE PEOPLE. Thank vou. Dianne L.
