San Pablo Community Foundation Grant Funds for FY 2005-2006
SPECIFIC REQUEST (S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Authorize the Contra Costa County Librarian to apply for and accept $5,000 in grant funds from the
San Pablo Community Foundation for the period of July 1, 2005 to June 30, 2006.
FINANCIAL IMPACT
No matching funds are required.
BACKGROUND
The San Pablo Library has seen an increase in demand for all types of materials; branch circulation of
all items has risen for the first five months of the fiscal year 2004/05 by 20% over that of thep revious
year. $2,000 will be used to purchase adult materials and $3,000 will be used for children's materials
for the San Pablo Branch Library.
CONTRA.COSTA CHILDREN'S IMPACT STATEMENT
Age appropriate fiction for children (K-6h) will beurchased ($1,500). Contra Costa p County Youth
Services Librarians have created lists of suggested books by grade level that will be used as ag uide for
selection.
Young Adult books (7h-12'h) will beurchased and chosen in collaboration with the Teen Advisory
ory
Group ($1,500). Over the last year, the San Pablo Library has encouraged regular teen users of the library
to create its own advocacy group called Teen Team Advisory (TTA) that has helped library staff select
books from lists created by librarians. The result has been a marked increase in use of the library by local
teens and a sense of empowerment among group members. In addition, the library will purchase books
selected by the American Library Association's Young Adult Services as Quick Picks for Reluctant
Readers. Librarians across the country select these books known to be popular among teens with low
reading abilities and/or low reading interest.
These two activities support Children Ready for and Succeeding in Schaal and Children and Youth
Healthy and Preparing for Productive Adulthood community outcomes established in the Children's
Report Card.

SUBJECT: FY 2004 Housing Opportunities for Persons with HIV/AIDS (HOPWA) Funding Agreement

RECOMMENDATIONS
AUTHORIZE the Deputy Director of Redevelopment, or his designee, to enter into a contract with the City of
Oakland that authorizes the County to receive and administer$494,193.45 in federal funds from the Department
of Housing and Urban Development, for housing and supportive services for low-income persons with
HIV/AIDS.
FISCAL IMPACT
No General Funds impact. HOPWA funds are provided to Contra Costa County from the Department of
Housing and Urban Development(HUD) through the City of Oakland, as administering agent.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The National Affordable Housing Act(Public Law 101-625, approved November 28, 1990) authorizes the
Housing Opportunities for Persons with AIDS Program(HOPWA)to provide states and localities with
resources to devise long-term comprehensive strategies for meeting the housing needs of persons with
HIV/AIDS and related diseases.

The City of Oakland is the HOPWA grant recipient for Alameda and Contra Costa counties.The City allocates the
HOPWA funds between the City and counties on a fair share allocation basis.Approval of a contract with the City
of Oakland will provide$494,193.45 to the County as administering agent on behalf of the Urban County' and other
Contra Costa entitlement jurisdictions (the cities of Antioch,Concord,Pittsburg, Richmond, and Walnut Creek).
These funds may be used for acquisition, rehabilitation and new construction of housing; supportive services;
housing information services;and certain other housing related activities for low-income persons with HIV/AIDS.
A Notice of Funding Availability was issued to receive proposals for the funds; these applications are due March
21 st.

RECOMMENDATIONS:
Approve and authorize the District Attorney to submit an application and execute a grant award agreement,
and any extensions or amendments thereof, pursuant to Federal guidelines, and in concert with the City of
Richmond, to the federal Department of Justice for Justice Assistance Grant (JAG) program funding in the
amount of$ 192,176 for the period October 1, 2004 through September 30, 2008 (Federal funds-No match
required
Authorize the District Attorney to enter into a Memorandum of Understanding with the City of Richmond,
required by federal guidelines to implement the program funding.
FINANCIAL IMPACT:
Of the $ 192,176 available under this program, $ 86,479 will be used by the City of Richmond for program
costs and$ .105,697 by the District Attorney,pursuant to agreement. The County portion will provide partial
ftmding of salaries and benefits for a Deputy District Attorney dedicated to domestic violence prosecution.
The District Attorney will serve as lead agency for the program, and has dedicated the permitted allocation
for administrative support to direct service. Currently, $ 192,176 in total funding is available through the

federal fiscal year 2005 appropriation to be spent by September 30, 2008. Funding requirements require the
establishment of a trust fund in which to deposit the JAG funds. Supplantation is prohibited. Expenditures
and revenue for the County portion of the grant will be appropriated in the fiscal year the funding will be
used. No match is required for this Program.

REASONS FOR RECOMMENDATION/BACKGROUND:
The federal government has amended Part E of Title I of the Omnibus Crime Control and Safe
Streets Act of 1968 to establish the Edward Byrne Memorial Justice Assistance Grant (JAG)
Program. This program includes an allocation available to the City of Richmond to use in concert
with the County, pursuant to a Memorandum of Understanding. The District Attorney and the
Richmond Police Department have developed a mutually agreeable program and funding split of the
available $ 1921,176 currently available for expenditure over the course of four years. The District
Attorney will serve as lead agency for the project. The City of Richmond will be enhancing its code
enforcement program, through funding a portion of a deputy city attorney dedicated to this program
area and*working.in close cooperation with the Police Department. The District Attorney's program
will be'in the area of domestic violence prosecution.
CONSEQUENCES OF NEGATIVE ACTION:
Failure to approve the recommendation will result in the inability of the District Attorney to apply for
and receive Federal funds designated by the federal Department of Justice for use by Contra Costa
County and the City of Richmond.

SUBJECT: SB 1255 Medi-cal Contract 2004/2005
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommendation:
Authorize the Health Services Director to transfer a maximum of$10,000,000 to the State of
California as authorized under SB 1255 Round 17B.
Fiscal Impact:
Contra Costa Regional Medical Center (CCRMC) will be eligible for a maximum of$10.0 million in
matching Federal funds. See background information for full discussion.
Background:
Federal grants to the State of the Medicaid program (Medi-Cal in California) are authorized under
Title XIX of the Social Security Act to provide medical assistance to certain persons with low
income, These Medicaid programs are jointly financed by the Federal and State governments and
administered by the States. State Medicaid agencies conduct their programs according to the
Medicaid State plan approved by the Administrator of the Health care Financing Administration
(HCFA). To carry out the Medicaid Program, the State agency pays providers for medical care and
services provided to eligible Medicaid recipients,
The Federal government pays its share of Medicaid program expenses to the State on a quarterly
basis according to a formula. The State share of Medicaid program expenses is paid from "State
funds," that is, those funds over which the State legislature has unrestricted power of appropriation.
In California, the program "split" is 50% Federal financing, 50% State financing.
SB 1255 (chapter 996, Statutes of 1989) added Section 14085.6 to the Welfare and Institutions
Code and established a program whereby certain voluntary transfers and donations will be utilized
by the State to provide funds to disproportionate share hospitals to assist them in enhancing or
maintaining access for Medi-Cal beneficiaries. This program is similar in nature to those
established in Tennessee and other states.

These voluntary transfers would be used to match Federal dollars under the Medi-Cal
program, thereby increasing the total revenue base available for distribution (i.e., $1
donation will generate $1 in Federal funding back to the disproportionate hospitals).
CCRMC is a disproportionate hospital eligible for reimbursement under this program.
The California Medical Assistance Commission (CMAC) is responsible for
administration of SB 1255. The Commission solicits the donations and distributes the
funds collected through the Medi-Cal contracting processing.
Issues:
Issue 1: SB 1255 payments are subject to Federal "Upper Payment Limits"
imposed on the State of California's Selective Contracting Program
waiver.
Discussion: Federal approval of the State of California's most recent Selective
Contracting Program waiver included a provision that on a statewide
basis, the aggregate amount paid to hospitals through their contracts
with CMAC, including SB 1255 payments, may not exceed the
aggregate amount that would have been paid for those same services
under the Medicare Program. While the Federal limit is not hospital
specific, at this time the State has not issued regulations specifying
how they intend to perform the required calculation and implement the
Federal limitation, nor have they specified how they would recoup any
such overage should one occur.
Issue 2: Facilities, which make a "voluntary" donation, are not guaranteed to
return of either the matching Federal funds or the donation itself.
Discussion: SB 1255 is intended to provide a workable program. If the most
"needy" facilities in the State make donations and do not receive back,
at a minimum $1.50 for each $1.00 donation, the program will fail.
While, because of Federal restrictions, the State cannot guarantee the
return of the transferred funds, it is the intent of the program that no
"donating" facility will be disadvantaged.

on Indian Gaining issues for the period March 1, 2005 to September 30, 2005.

BACKGROUND/REASON(S)FOR RECOMMENDATION
The law firm of Nielsen, Merksamer, Parrinello, Mueller and Naylor CNielsen Merksamer'') has extensive
experience with Indian Gaming issues and has represented multiple counties in their dealings with Indian gaming
proposals.
Cathy Christian, the primary consultant under this contract, has represented Contra Costa, Yolo, Sonoma, Marin
and Tulare counties on Indian ganung issues. She is a nationally recognized expert on Indian Gaming issues.
Prior to joining the firm of Nielsen Merksamer, Cathy served in the California Attorney General's office, where
she was a senior advisor to the Attorney General on gambling and Indian law and was General Counsel to the
California Horse Racing Board. Cathy is also Contra Costa County's lead legislative advocate in Sacramento,
and so has an excellent understanding of County Issues
