RECOMMENDATION
SPONSOR AB 719 (Canciamilla) which would authorize the Board of Supervisors to appoint a Supervisor to
serve as an alternate for the Supervisor appointed as a member of the Retirement Board and to appoint a
member of the public to serve as an alternate for the other Retirement Board members appointed by the Board
of Supervisors, as recommended by the County Administrator.
BACKGROUND/REASOMS)FOR RECOMM[ENDATION
The Contra Costa County 2005 State Legislative Platform includes the following policy position:
SPONSOR legislation to authorize the Board of Supervisors in Contra Costa County to appoint a
supervisor alternate for the Board of Supervisors' member on the Retirement Board as well as an
alternate for the other Board of Supervisors'appointed members.
AB 719 has been introduced by Assemblyman Canciamilla, on behalf of Contra Costa County. AB 719 provides
for appointment of alternates consistent with the Board's policy position.
The Retirement Board consists of nine members. Current law provides for an alternate safety member who may
also serve as an alternate for the elected general members and the retired member. In addition, current law
permits the Retirement Board to appoint a refiree to serve as alternate for the retired member. However, Board
of Supervisors appointed members, including a Supervisor, currently may not have alternates.

Actions of the Retirement Board can have significant impacts on County finances. Consequently, it is imperative
that the County be represented at all times on the Retirement Board. Board of Supervisors members, however,
often have multiple demands on their time and so may find it difficult to attend all meetings. In order to meet the
Retirement Board member participation needs, a Supervisor alternate is necessary. An alternate for other Board
of Supervisors' Retirement Board appointees would also help ensure that the County's point of view is
considered during Retirement Board deliberations and be consistent with the representation authorized for safety
member, general member and retiree positions.

An act to add Section 31520.12 to the Government Code,relating to
county employees' retirement.

AB 719, as introduced, Canciamilla. County retirement boards:
alternate members.
The County Employees' Retirement law sets forth the membership
composition requirements for the board of retirement of counties
subject to certain provisions regarding safety members. The 4th, 5th,
6th, and 9th members are required to be qualified electors of the
county who are not connected with the government, except that one
may be a supervisor. Existing law authorizes a retirement board, in
specified instances, to appoint an alternate retired member to the
office of the 8th member of the board.
This bill would permit the board of supervisors, by resolution
adopted by majority vote,to appoint an alternate member for the 4th,
5th, 6th, or 9th member. The bill would provide that when the county
appoints a supervisor to one of those membership positions, the
alternate member may not act for the supervisor member, and would
permit the board of supervisors to appoint a supervisor to serve as an
alternate supervisor member. The bill would require that the alternate
member, and the alternate supervisor member, have the same
compensation,term of office,except as specified and voting privileges
as his or her counterpart,as specified.

The people of the State of California do enact asollows:
I SECTION 1. Section 31520.12 is added to the Government
2 Code,to read:
3 31520.12. (a) Notwithstanding Section 31520.1, and except
4 as provided in subdivision (b), in any county subject to Articles
5 6.8 (commencing with Section 31639) and 7.5 (commencing
6 with Section 31662),the board of supervisors may,by resolution
7 adopted by majority vote, appoint an alternate member for the
8 fourth, fifth, sixth, and ninth members. The term of office of the
9 alternate member shall run concurrently with the term of office
10 of the ninth member. The alternate member shall vote as a
11 member of the board only in the event the fourth, fifth, sixth, or
12 ninth member is absent from a board meeting for any cause. If
13 there is a vacancy with respect to the fourth, fifth, sixth, or ninth
14 member, the alternate member shall fill that vacancy until a
15 successor qualifies.
16 (b) When the board of supervisors appoints a supervisor as the
17 fourth, fifth, sixth, or ninth member, the alternate member
18 appointed pursuant to subdivision(a) shall not sit and act for the
19 supervisor member, and he or she shall sit and act only for the
20 other members appointed by the board of supervisors pursuant to
21 this section. The board of supervisors may separately appoint a
22 supervisor to serve as an alternate member for the supervisor
23 appointed as a member of the board. The alternate supervisor
24 member may not serve beyond his or her term of office as
25 supervisor. The alternate supervisor member shall vote as a
26 member of the retirement board only in the event that the
27 supervisor member is absent from the board meeting for any
28 cause. If there is a vacancy with respect to the supervisor
29 member, the alternate supervisor member shall fill that vacancy
30 until a successor qualifies or the term of the supervisor member
31 expires,whichever occurs first.
32 (c) The alternate member for the fourth, fifth, sixth, or ninth
33 member,and the alternate supervisor member,shall be entitled to
34 the same compensation as the fourth, fifth, sixth, or ninth
35 member for attending a meeting, pursuant to Section 31521,
36 whether or not the alternate member for the fourth, fifth,sixth,or
37 ninth member, or the alternate supervisor member, attend the
38 meeting.
