RESOLUTION NO. 2005/ 155
SUBJECT: Accepting completion of warranty period and release of cash deposit for faithful
performance, Road Improvement Agreement for Bollinger Canyon Road, RA 00-
01105 (cross-reference Subdivision 7984), San Ramon (:Dougherty Valley) area.

On October 28, 2003, this Board resolved that the improvements in RA 00-01105 (cross-
reference Subdivision 7984)were completed as provided in the Road Improvement Agreement with
Shapell Industries of Northern California, a Division of Shapell Industries, Inc. and now on the
recommendation of the Public Works Director;
The Board. hereby FINDS that the improvements have satisfactorily met the guaranteed
performance standards for the period following completion and acceptance.NOW THEREFORE BE
IT RESOLVED that the Public Works Director is AUTHORIZED to refund the $9,000.00 cash
deposit (Auditor's Deposit Permit No. 369922, dated June 15, 2001) plus interest to Shapell
Industries of Northern California in accordance with government Code Section 53079 (if
appropriate), Ordinance Code Section 94-4.406, and the road improvement agreement.
BE IT FURTHER RESOLVED that the warranty period has been completed and the Road
Improvement Agreement and surety bond,Bond No. 190-724-006, are exonerated.
