A. APPROVE Purchase and Sale Agreement and ACCEPT the Grant Deed from Michael
Bepler, an unmarried man and Adeline Bepler, an unmarried women as tenants in common for
the purchase of parcel #357-161-001 and 387-161-002.
B. AUTHORIZE the Redevelopment Director to execute said Purchase and Sale Agreement on
behalf of the Redevelopment Agency.
C. APPROVE payment of $300,000 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to First American Title Company, 1850 Mt.
Diablo Blvd., Suite 300, Walnut Creek, CA 94596, Escrow No. NSC-142054-CC to be
forwarded to the Redevelopment Agency for delivery.

Property Acquisition — Downtown Rodeo
D. DIRECT the Redevelopment Agency to have the above referenced Grant Deed recorded in
the Office of the County Recorder.

Environmental Quality Act {CEQA) pursuant to Section 15061 (b) (3) of the CEQA guidelines;

The activity is included in the Redevelopment Agency's adopted budget, and uses Contra Costa
County Redevelopment Agency capital project funding and Tosco Reformulated Gasoline Project
Return-To-Source Funding. No General Fund money was used on this project.

Ills Reasons for Recommandat a vi Rackaround.,
In 1995, the Board of Supervisors authorized sharing a portion of the property tax increment
resulting from the Tosco, Reformulated Gasoline Project with the Crockett and Rodeo
communities for the purposed of economic development. The Tosco Return to Source Steering
Committee identified projects to be funded in the communities and agreed to distribute 45
percent of the funding to Rodeo, with a portion ($230,910) dedicated to this project.
The Board of Supervisors approved the specific use of the Return-To-Source funds for each of
the communities, including the Rodeo community's proposal to develop a town square. The
Redevelopment Agency is charged with implementing the town square project.
The intent of the Agency is to use the town square project, with the potential for a mixed-use
project that will include retail and residential units along the town square. The acquisition of the
site is the first step towards the community's goal to develop a town square in downtown Rodeo.
On December 21, 2004, the County Planning Commission determined the acquisition of the
subject property is in conformance with the County General Plan.

The property would not be available for Agency sponsored development.

This memorandum verifies that the County Planning Commission met on Tuesday, December
21, 2004 at which time they reviewed and approved the staff recommendation on a finding of
conformance with the County General Plan for the proposed acquisition by the Contra Costa
County Redevelopment Agency of two parcels (APN 357-161-001 and 002)totaling 17,000 sq.
ft. The subject parcels are located at the intersection of Parker Avenue, Investment Street, and
Railroad in the unincorporated area of Rodeo.

APPROVAL TO THE File: ZT#04-0003. This is a County initiated proposal to convert the existing zoning maps from a system

BY THE CONTRA COSTA COUNTY REDEVELOPMENT AGENCY

STAFF REPORT
This is a public hearing to consider the General Plan conformance of a proposed
acquisition by the Contra Costa County Redevelopment Agency of two parcels (APN
357-161-001 and 002) totaling 17,000 sq. ft. located at the intersection of Parker
Avenue, Investment Street, and Railroad Avenue, Rodeo. (CT 3580)
Section 65402 of the California Government Code requires a finding regarding the
General Plan conformance of any public project that involves the acquisition or disposal
of real property, or the authorization or construction of a building or structure.
The Contra Costa County Redevelopment Agency is pursuing acquisition of the
approximately 17,000 sq. ft. site. The Agency is exploring the feasibility of a future
catalyst project that may include a town plaza and mixed-use development in the Rodeo
community. The Agency will work with the community to determine the feasibility,
intensity, design, and density of a future catalyst project.
CEQA STATUS
The activity entails the acquisition of property by the Redevelopment Agency for
consideration of development of a town plaza with the potential for a mixed-use project
on the site and adjacent properties. The subject parcel was included in the area
evaluated under the 1990 Rodeo Redevelopment Plan Environmental Impact Report,
the 1997 Rodeo Waterfront/Downtown Specific Plan Environmental Impact Report, and
the 1991 Contra Costa County General Plan Environmental Impact Report. Any future
development of the site is subject to further CEQA review once a project scope is
defined.
GENERAL PLAN
The subject parcel has a General Plan designation of Mixed Use — Rodeo Specific Plan,
which allows a maximum density of up to 30 units per acre, depending on the size of the
parcel. The Redevelopment Agency intends to work with the Rodeo community to
define a mixed-use project anchored by a town plaza. Once a project is defined, the
Redevelopment Agency may issue a Request for Proposals to develop the site
consistent with the community's vision. Development of the site will further the goals of
the Redevelopment Plan by encouraging the development of new housing on infill sites,
as well as goals of the Housing Element related to the provision of housing sites. The
development will also further the Rodeo Waterfront/Downtown Specific Plan strategy to
create opportunities for neighborhood commercial uses in the downtown by increasing
residential opportunities nearby.
RECOMMENDATION
Staff recommends the Commission find that the acquisition by the County
Redevelopment Agency of the parcels in downtown Rodeo (comprising of APN:357-
161-001 and 002) for the purpose of evaluating a mixed-use project with a town plaza to
be in conformance with the County General Plan, because it is consistent with the
"Mixed Use (MU)" land use designation, the Rodeo Waterfront/Downtown Specific Plan,
and supports the implementation of a program action relating to infill housing in the
Housing Element. It is worth noting that the acquisition of the subject site for the
eventual development of a mixed-use project would help fulfill a key action described in
the implementation plan for the Redevelopment Project Area relating to the downtown
revitalization.

Based on the evidence in the record, the authorization for Contra Costa County
Redevelopment Agency to acquire a 17,000 sq. ft. site (APN 357-161-001 and 357-161-
002) can be seen with certainty as having no potential for causing a significant impact on
the environment. The subject property is within the Rodeo Redevelopment Area and the
Rodeo Waterfront/Downtown Specific Plan Area. This action only contemplates future
development on the site. Any future development is subject to further CEQA review and
approval when a project scope is defined.
DESCRIPTION OF THE ACTIVITY:
The activity involves the authorization for Contra Costa County Redevelopment Agency to
acquire two parcels that comprise a 17,000 sq.ft. site. it is anticipated that the site maybe
part of a larger town square and mixed-use project in the future.
LOCATION:
The 17,000 sq. ft. parcel (APN 357-161-001 and 002) is located at the intersection of
Parker Avenue, Investment Street and Railroad Avenue in the Rodeo area of Vvest Contra
