RECOMMENDATION:
INTRODUCE Ordinance No. 2004-30 to authorize the Director of Building Inspection to issue
infraction .citations for violations of Chapter 418-14, which regulates the management of
construction and demolition debris; WAIVE reading; and FIX July 20, 2004 as the date for adoption.
FISCAL IMPACT:
Fiscal impact will depend on the number of citations issued for violations of the County's demolition
and debris',management ordinance.
BACKGROUND:
On April 19, 2004, the Board of Supervisors directed County Counsel to prepare and introduce to
the Board) an ordinance that authorizes the Director of Building Inspection to issue infraction
citations for violations of the County's construction and demolition debris management ordinance
(Ordinance Code Chapter 418-14). The construction and demolition debris management ordinance
requires owners of all construction or demolition projects that are 5,000 square feet or greater to
demonstrate that at least 50% of the construction and demolition debris generated on the jobsite
are reused, recycled or otherwise diverted (unless a diversion adjustment is granted).
The attached ordinance amends Ordinance Code section 14-8.008(x)(2) to authorize the Director of
Building Inspection or his designated subordinates to issue citations for violations of Ordinance
Code Chapter 418-14. Violations of Chapter 418-14 are punishable by fines of up to $500.

(Construction and Demolition Debris Recovery Violations)
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes
from the official text of the enacted or amended provisions of the County Ordinance Code):
SECTION L SUMMARY. This ordinance amends Section 14-8.008 of the County Ordinance
Code to authorize the Director of Building Inspection to issue infraction citations for violations of
Chapter 418-14, which regulates the management of construction and demolition debris.
SECTION 11. Section 14-8.008 of the County Ordinance Code is amended to read:
14-8.008 Infraction arrest and citation.
(a) The following officers, or their designated subordinates, shall have and are hereby vested with
the authority to arrest any person who violates the following provisions of this code and other
codes as indicated,punishable as infractions:
(1) Director of Health Services: Division 413, Division 445, Chapters 414-4, 414-6, 416-
14, 418-2, 418-6, 418-12, 420-2, 420-6, 450-6 and Labor Code Section 6404.5.
(2) Director of Building Inspection: Title 7, Chapter 418-14.
(3) Director of Community Development: Title 8.
(4) Director of Public Works: Divisions 1002, 1010, 1014, 1106 and 1110.
(5) Sheriff: Division 1110.
(b) The above-listed officers, or their designated subordinates, may issue citations for infraction
violations of the above-listed code provisions.
(c) The county administrator may by written order issue regulations to provide for administration,
procedures and policy direction for this section. (Orris. 2004-30 § 2; 2003-01 § 5; 2002-48

SECTION III. EFFECTIVE DATE. This ordinance becomes effective thirty(30) days after
passage, and within fifteen(15) days after passage shall be published once with the names of

supervisors voting for and against it in the Contra Costa Times, a newspaper published in this County.
