County DATE: July 13, 2004 °s SUBJECT: Weed Abatement Contracts Extension SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: AUTHORIZE the Fire Chief, Contra Costa County Fire Protection District, or designee to execute three (3) contract extensions with Randy Bodhaine and one (1) contract extension with H & N Enterprises for the continuation of weed abatement services for the extended ane-year term of January 1 to December 31, 2004. Costs associated with these contract extensions are: Discing and Hand Mowing in the East Contra Costa County area with Randy Bodhaine for$24,149.84; Discing in the Central Contra Costa County area with Randy Bodhaine for$33,555.05; Hand Mowing in the Central Contra Costa County area with H & N Enterprises for $40,000.00; and Discing and Hand Mowing in the West Contra Costa County area with Randy Bodhaine for $40,000.00. Each contract represents services for specific areas within the Fire District and is an extension of an existing contract. FISCAL IMPACT: The cost of above extended contracts is included in the District's FY 2004-05 budget. BACKGROUND/REASONS FOR RECOMMENDATION: Weed abatement contracts with Randy Bodhalne and H & N Enterprises terminated on December 31, 2003. These contracts were for the purpose of exterior fire hazard control by discing, mowing, rubbish and tree removal. Currently, there is not sufficient time to put new weed abatement contracts out to bid and select new contractors as the fire season is now upon us. Due to the hot weather conditions at this time of the year, dry grass/weeds and piles of combustible rubbish present an extreme threat of fire to the public. It is essential that the Fire District have the ability to abate these hazards in accordance with Contra Costa County Ordinance 2002-32 when the owner fails to do so in order to reduce the potential for a catastrophic wildland fire from occurring. The Fire Chief is being authorized to sign the contracts which also require bands, certificates of insurance and other documentation. Pursuant to Public Contracts Code Section 4114, the Board DELEGATES its functions under Public Contracts Code Section 4107 and 4110 to the Fire Chief or designee. CONSEQUENCE OF NEGATIVE ACTION: If these contract extensions are not approved, the public safety will be jeopardized as the District will be unable to have properties abated when necessary. This could result in grass fires of varying magnitudes threatening the lives and properties of District residents. AMENDMENT NO. 1 TO AGREEMENT 1. Maive Pik wd P . The parties desire to amend the Agreement they entered into effective July 23, 2001, entitled"2001/20132/2003 Abatement Contract, Central Division,for Exterior Fire Hazard Control by Hand Mowing,Rubbish Removal, and General Labor,"as described herein. 3. Arendrnent. Section 3,"Contract Term,"is amended to read as follows: "a. The tern of this Agreement shall be from the elective date through December 31, 2004,unless otherwise terminated in accordance with the provisions of this Agreement. b. This Agreement may be terminated by either party upon 30 days advance written notice to the other party. In the event of termination,Contractor shall be entitled to payments due through the date of termination,but the Fire District shall assume no other duty or liability to Contractor on account of its termination of the Agreement. C. Unless the Agreement is terminated in the manner set forth in paragraph(b) above,the contractor shall be entitled during the term of this Agreement to annual adjustments in the contract price, upward or downward,to reflect changes in the"Consumer:Price Index for Urban Wage Earners and Clerical Workers, San Francisco-Oakland, Al items—Series A(1982/84-100),',published by the Bureau of Labor Statistics of the United States as follows:The Cost of Living Index published for the year ending December 31,2000,shall be taken as the"Base Index"for the purpose of computation. Can January 1,2002,and again on January 1,2003, and again on January 1, 2004,the rates set forth in this Agreement shall be increased or decreased by not more than a percentage amount equal to the new percentage change between the Ease Index and the Cost of Living Index for the calendar year ending December 31 of the previous year. The adjusted rate shall be deemed thereafter to be the Base Index for purposes of the next rate computation. Such percentage of change shall be calculated to the nearest one-tenth of I%,and said rates shall be rounded off to the nearest one cent of increases or decreases." 4. Effect.
