RECOMMENDATIONS
1. ACCEPT report from the Community Development Director on recent'actions by the Contra
Costa Transportation Authority related to the proposed November 2, 2004 ballot measure to
renew Measure C-1988: Contra Costa Transportation Improvement and Growth Management
Program.
2. ACKNOWLEDGE that the proposal for renewal of Measure C-1988 shall include the adoption
of a"countywide mutually agreed upon voter approved Urban Limit Line or"local jurisdiction's
voter approved Urban Limit Line" before a jurisdiction would be eligible to receive the 18%
return to source funds or the 5% TLC funds.

3. ACKNOWLEDGE that the proposal for renewal of Measure C-1988 includes "Principles of
Agreement" to develop and maintain a new "mutually agreed upon" Urban Limit Line, which
requires certain actions of the County, including adjustment of the existing County ULL on or
before September 30,2004 to make it coterminous with city boundaries where it intrudes inside
incorporated boundaries.
4. AUTHORIZE the County's OCTA representatives to initiate discussion on process for
subregional meetings for the development of a mutually agreed upon ULL, as identified in the
Principles of Agreement, and to seek a funding agreement with OCTA to recover County's cost
for preparation of Master EIR on proposed countywide mutually agreed upon ULL.
5. AUTHORIZE staff to undertake General Plan Amendment study and CEQA review to adjust the
existing County ULL to make it coterminous with city boundaries consistent with the"Principles
of Agreement".
FISCAL IMPACT
Should the ''Board authorize the General Plan Amendment study and CEQA review to adjust the
existing County ULL to make coterminous with city boundaries,this would be an unfunded mandate.
Should the'County be the lead agency in preparing a Master EIR on the proposed countywide
mutually agreed upon ULL, there would need to be a funding source to recover the County's costs'.
BACKGROUND I REASONS FOR RECOMMENDATION
On May 26, 2004, the Contra Costa Transportation Authority (OCTA) approved a proposal for the
November 2, 2004 General Election to renew Measure C-1988: Contra Costa Transportation
Improvement and Growth Management Program. After lengthy debate,CCTA unanimously agreed to
include in the new Measure C Growth Management Program a requirement that a jurisdiction must
comply with either the "Countywide ULL" or the "local jurisdiction's voter approved ULL" before that
jurisdiction would become eligible to receive 18%return to source funds or 5%TLC(Transportation for
Livable Communities)funds.
Included in the CCTA's action was the adoption of"Principles of Agreement" which calls for a new
countywide mutually agreed upon voter approved Urban Limit Line(ULL)which would run concurrent
with extension of the Measure C sales tax to March 31, 2034. A copy of the"Principles of Agreement"
is included as Attachment#1 to this Board Report. Staff notes that the"Principles of Agreement"calls
for a number of actions to be undertaken by the County, including:
1. Adjusting the County's existing ULL to make it coterminous with city boundaries where it
intrudes inside the incorporated boundaries on or before September 30,';2004.

2. Beginning on July 1, 2004, a County representative shall participate in''subregional meetings
with city representatives to develop the new ULL, including the criteria for establishing the ULL
and future modifications to the line, and on or before December 31,2004,the County and cities
will cooperate in development of a mutually agreed upon ULL and criteria for future
modifications that would be placed on the ballot for voter ratification in November 2006.
3. The County would be the lead agency in preparing a Master EIR on the(proposed countywide
mutually agreed upon ULL.
Consistent with the "Principles of Agreement"on adoption of new ULL approved by the OCTA, staff
recommends the following course of actions:
1. Authorize the County's representatives at CGTA to initiate discussion on the process identified
in the Principles of Agreement for the development of a mutually agreed upon ULL and seek
funding agreement or commitment from CCTA to recover the County's costs for preparation of
Master EIR on the proposed countywide mutually agreed upon ULL.
2. Authorize the General Plan Amendment study and CEQA review to adjust the existing County
ULL to make it coterminous with city boundaries and direct staff to begin process of
consultation with affected cities about the ULL boundary adjustments.

The Speci tc GMP language for the ULL would read as allows:
5. Adapt an Urban Limit Line
Each jurisdiction must continuously comply with either a new"Countywide mutually
agreed upon voter approved ULL"or the "local jurisdiction's voter approved ULL"
before that jurisdiction would be eligible to receive the 18%return to source funds or the
5%TLC funds. In the absence of a new local voter approved ULL, submittal of an
annexation request to LAFCO outside the countywide voter approved ULL will
constitute non-compliance with the Measure C Growth Management Plan.
The new ULL will be developed and maintained consistent with the"Principles of
Agreement"in Attachment B, incorporated herein by reference.

"Principles of Agreement"
1. The Board of Supervisors shall have,with the concurrence of each affected city,
adjusted the existing County ULL on or before September 30,2004,or as
expeditiously as possible given the requirements of CEQA,to make the existing
County ULL coterminous with city boundaries where it previously intruded inside
those incorporated boundaries.
2. The process to develop the ULL shall have begun by July 1,2004 with meetings
in each sub region between one elected representative of each city and the county.
The sub regional meeting(s)will be followed by meetings between all of the cities
and the county,each being represented by one elected representative. The
discussion will include both the suggested ULL as well as criteria for establishing
the line and future modifications to the ULL.
3. On or before December 31,2004,the County and the cities will cooperate in the
development of a new mutually agreed upon ULL and criteria for future
modifications. In order to be considered a final proposal,the plan must be
approved by 4 members of the Board of Supervisors and 3/4 of the cities
representing 3/4 of the incorporated population.
4. The County will be the lead agency in preparing a Master EIR on the proposed
Countywide"mutually agreed upon ULL."
5. After certification of the Master EIR,the proposal shall be submitted to the voters
for ratification by November 2006. The new mutually agreed upon ULL will be
considered as the Countywide Voter Approved ULL once it is ratified by the
voters.

6. If a Town/City disagrees with the mutually agreed upon ULL,it may,as an
alternative,develop and submit to its voters an "alternative ULL", or rely upon
an existing voter approved ULL.
7. If no Countywide mutually agreed upon ULL is established by March 31,2009,
only local jurisdictions with a voter approved ULL will be eligible to receive the
18%return to source finds or the 5%TLC funds.
8. The new Measure C Growth Management Program will include a requirement
that all jurisdictions trust comply with either the"Countywide ULL"or the"local
jurisdiction's voter approved ULL"before that jurisdiction would be eligible to
receive the 18%return to source funds or the 5%TLC funds. In the absence of a
local voter approved ULL, submittal of an annexation request to LAFCO outside
the countywide voter approved ULL will constitute non-compliance with the new
Measure C Growth Management Plan,
9. The new ULL,unless amended,will be in place through the end of the sales tax
extension(March 31,2034).
10.The Countywide voter approved ULL Measure will include provisions for
periodic review(5 years)as well as provisions for minor(less than 30 acres)
nonconsecutive adjustments.

On this date, the Board CONSIDERED accepting report from the Community
Development Director on actions of the Contra Costa Transportation Authority regarding
renewal of Measure C-1988,
The Board requested public comments and no-one appeared to speak.
After further discussions the Board made the following recommendations;'
1) ACCEPTED report from the Community Development Director on recent
actions by the Contra Costa Transportation Authority related to the proposed
November 2, 2004 ballot measure to renew Measure C-1988: Contra Costa
Transportation Improvement and Growth Management Program;
2) ACKNOWLEDGED that the proposal for renewal of Measure C-1988 shall
include the adoption of a "countywide mutually agreed upon voter approved
Urban Limit Line" or "local jurisdictions' voter approved Urban Limit Line"
before a jurisdiction would be eligible to receive the 18% return to source
Rinds or the 5%TLC funds;
3) ACKNOWLEDGED that the proposal for renewal of Measure C-1988
includes "Principles of Agreement" to develop and maintain a new "mutually
agreed upon"Urban Limit Line, which requires certain actions of the County,
including adjustment of the existing County Urban Limit Line on or before
September 30, 2004 to make it coterminous with city boundaries where it
intrudes inside incorporated boundaries;
4) AUTHORIZE the County's CCTA representatives to initiate discussion on
the process for sub-regional meetings for the development of a mutually
agreed upon Urban Limit Line, as identified in the Principles of Agreement,
and to seek a funding agreement with CCTA to recover County casts for
preparation of Master EIR on proposed countywide mutually agreed upon
Urban Limit Line; AMENDED to read "REFER. to the City County Relations
Committee the process for sub-regional meetings for the development of a
mutually agreed upon ULL, as identified in the Principles of Agreement" and
AUTHORIZE the County CCTA representatives to seek a funding agreement
with CCTA to recover County's costs for preparation of Master EIR on
proposed countywide mutually agreed upon Urban Limit Line;
5) AUTHORIZED staff to undertake General Flan Amendment study and
CEQA review to adjust the existing County Urban Limit Line to make it
coterminous with city boundaries consistent with the "Principles of
Agreement".
