RECALL that on September 23, 2403, the Sheriff made a report to the Board of Supervisors outlining proposed strategies and a business plan to eliminate a deficit in the Law Enforcement Training Center(LETC) Enterprise Fund. 2. ACKNOWLEDGE that one of the fiscal solvency strategies proposed in the report was the creation of a non-profit public benefit corporation for the purpose of accepting donations to assist on offsetting LETC costs and for awarding basic academy scholarships. 3. APPROVE the establishment of a LETC Scholarship Program to provide full or partial tuition for each and every non-affiliated Basic Academy student to the extent feasible through corporate and individual donations to the Sheriff's Charities, Inc_, a non-profit corporation that will act as the fiscal agent for the Program. 4. AUTHORIZE the Sheriff-Coroner to grant, for purposes of the Scholarship Program, non- exclusive, non transferable, warranty-free license to reproduce and display the insignia and slogans set forth in Exhibits A and B. 5. APPROVE and AUTHORIZE the Sheriff-Coroner, or designee, to execute a multi-party contract with Bay Alarm Company, Inc., and Sheriffs Charities, Inc., to accept $35,044 for scholarships and, additionally, other donated promotional services in consideration for exclusive LETC sponsorship in the"alarm and security services" category, providing for certain public recognition and co-branding activities for the period July 1, 2004 through June 30, 2005. 6. The sponsorship will provide $35,000 in direct scholarships for non- affiliatedBasic Academy students and, in addition, public promotion of Sheriff recruitment and training activities at no cost to the County. REASONS FOR RECOMMENDATION/BACKGROUND: Bay Alarm Company, Inc,, established in 1946, is the largest independently owned and operated alarm company in the United States and is headquartered in Pacheco. Bay Alarm Company wishes to provide sponsorship and promotional contributions to the Law Enforcement Training Center to include; non-affiliated(not supported by a law enforcement agency) student scholarships, support for in-service training courses, a recruiting billboard, direct mail, event support and media support during the contract term. Sheriff's Charities, Inc., is organized as a nonprofit public benefit corporation under the Corporations Code of the State of California. It is recognized as holding charitable status pursuant to registration under Internal Revenue Code§501(c)(3). Sheriff's Charities Articles and By-laws provide that it is organized for the purpose of promoting and supporting law enforcement and will directly distribute funds to the Sheriff's Office Enterprise Fund for the Law Enforcement Training Center. Providing scholarships for non-affiliated students will reap a dual benefit for the Law Enforcement Training Center and the citizen's of Contra Costa County; First, the cost of attending a basic academy for a non-affiliated student is considerable. Not only does the LETC charge tuition to offset expenses, but the student also must be self-supporting for a six-month period while they attend the academy full time. Scholarships will Delp offset that expense and increase the number of students who are able to receive this high quality training. Secondly, each non-affiliated student that we attract to a basic academy allows the County to receive Full Time Equivalent Student (F.T.E.S.) payments from the State. So, increasing the number of students in each class will increase the revenue that the County receives. In appreciation for the generous donation by Bay Alarm Company, we request that the Board of Supervisors name one LETC classroom "The Bay Alarm Classroom" for the duration of the contract period. Existing County policy provides guidance on the naming of a room within a County-owned building to honor an individual's service to the community, which can be done by resolution of the Board upon a four-fifths affirmative vote. County policy also provides guidance as to the naming of County-owned facilities to honor community service, or donation of land or of funds to construct a facility. Although not specifically addressed in current County policy, we recommend the naming of the LETC classroom for Bay Alarm Company for a limited period in recognition of its donation of operations funding, in the same spirit as current County policy. CONSEQUENCES OF NEGATIVE ACTION. Failure to approve this agreement will negatively impact the law enforcement community. Bay Alarm Company's sponsorship will advertise the need for recruits, promote awareness of the local availability of courses and services, allow for the presentation of courses not currently funded, and provide full or partial scholarships to qualified candidates who might otherwise not be able to attend the LETC.
