ACKNOWLEDGE the effort of Republic Services and Electronic Innovations to provide surveillance from their individual properties and authorize up to $25,000 from the IRRF mitigation funds to assist in support of equipment purchase for pilot monitoring program from these two locations. 10. ACKNOWLEDGE that the Sheriff has authorized the use of 911 dispatch system to receive calls regarding illegal dumping in the North Richmond community on a 90 day pilot program trial. 11. ENDORSE the use of 1-800-NO-DUMPING as an illegal dumping hotline. DIRECT staff from the Contra Costa Clean Water Program to work with staff from Community Development and the County Administrator's Office to direct calls related to illegal dumping to appropriate phone numbers. 12. ACKNOWLEDGE that a North Richmond Community Services Coordinator position will be filled and funded in part by the Redevelopment Agency, Housing Authority and Public Works Department and that this position will work, in part, on the illegal dumping problem in the North Richmond Community. 13. ACKNOWLEDGE that the District Attorney staff has participated in all task force meetings and has indicated commitment to prosecute all cases regarding illegal dumping violations as a priority item. 14. DIRECT staff of Community Development, Public Works and General Services Department to engage municipal advisory council(s)to explore an "adopt a road program.,, 15. DIRECT staff of the County Administrator's (Office and Community Development Department to engage in discussion with county landfill operators and franchised waste haulers to develop additional strategies to address illegal dumping which should include a bulky material removal program and report options within 90 days. FISCAL IMPACT: An advance of $100,000 from the Regional Enhancement Fee reserve designation would be required to initiate the Mandatory Subscription Enforcement program. The printing of the recycling guide is estimated to cost $73,000. Community Development Department staff has requested contributions from partner agencies to fund the printing. BACKGROUND: On September 23, 2003, the Board of Supervisors approved the Environmental Justice Report from the Environmental Justice Ad Hoc Committee. (see Attachment 1) In that report it was recommended that the Board: RECOGNIZE ongoing work on illegal dumping as a pilot program; ESTABLISH a task force consisting of representatives from those departments most involved in the resolution of illegal dumping, including but not limited to Health Services (Hazardous Materials Program, Environmental Health), Public Works, General Services, Sheriff, District Attorney, Community Development, Building Inspection, County Counsel, District 1, District V, the County Administrator's Office and community representatives and; DIRECT the task force to report back to the Ad Hoc Committee in 90 days on the progress of developing and implementing a strategy to address the problem of illegal dumping. On March 18, 2004, the Environmental Justice Ad Hoc Committee requested a report be made to the full Board. Proposed Actions A. Prevention 1. Mandatory Subscription Chapter 418-6 of the County Code (commonly referred to as the "Mandatory Subscription Ordinance")was adopted in 1985. This ordinance requires that owners and other persons in control of all premises from which solid waste is generated subscribe for solid waste collection services unless an exemption is granted by the Health Officer. This ordinance provides the County with the authority to subscribe for collection services on behalf of an owner if the owner fails to subscribe within 15 days of receiving written notice from the County, unless they have requested a hearing. The ordinance also authorizes the County to recover actual expenses (including administrative costs and payments made to the hauler) as long as they are not in excess of the amount specified in the notice sent to owner(or written decision from hearing if applicable). The specified mechanism to recover these costs is placement of a special assessment against the parcel on their tax bill. The County has entered into Franchise Agreements with several private haulers for solid waste and recycling collection in the following unincorporated communities: Alhambra Valley, Bay Point, Bay View/Montalvin Manor, Canyon, Clyde, Crockett, Discovery Bay, Bast Richmond Heights, El Sobrante, Knightsen, 'Morgan Territory, North Richmond, Pacheco, Port Costa, Rollingwood and Tara Hills. These Franchise Agreements require that the haulers assist the County in its enforcement of the Mandatory Subscription Ordinance by providing the County with the addresses of properties not subscribing to collection service within their franchise areas and by providing collection service to such properties upon written request by the County. A source of one-time funding is needed to initiate a pro-active enforcement system for Chapter 418-6. The amount of funding needed will depend on how many owners fail to subscribe to solid waste collection service after receiving notice from the County's Health Officer. For example, if owners of 898 residences failed to subscribe for service, the County would have to pay the haulers between $15,715 and $21,372 per month for collection services at these 898 residences. Upon dedication of funding for this pro-active enforcement system, the following steps could be initiated: a. Community Development Department(CDD) requests in writing from each Franchised Hauler a list of addresses of all properties not subscribing to collection service within each County Franchise Area; b. CDD transmits list of addresses of properties not subscribing to collection service to the Environmental Health Division of the Health Services Department (HSD); c. HSD sends notices to owners of all properties not subscribing to collection service requiring that they either subscribe or request a hearing within 15 days. These notices must state the consequences for not subscribing (including estimated costs that could be levied as special assessment lien against their property); d. HSD subscribes for service, including making payments to haulers, on behalf of all owners that do not subscribe or request hearing within 15 days; e. HSD keeps an account of the charges incurred for each parcel of real property served including administrative costs, f. HSD transmits allowed costs that are not paid within 30 days of final order to the Auditor- Controller and Tax Collector to be entered as assessments against the designated parcels and included on bills for taxes levied against said parcels. Additional information is provided in Attachment 111 on mandatory subscription from Ken Stuart from Environmental Health. As a related item, please see Attachment IV on Waste Hauler Permits from Ken Stuart from Environmental Health. What is ilisaai'Dumping and What is the County currently doing to prevent it Illegal dumping is disposal of waste in an unpermitted area. Illegally dumped wastes are primarily non- hazardous materials that are dumped to avoid either disposal fees or the time and effort required for proper disposal. These materials can include: construction and demolition waste such as drywall, roofing shingles, lumber, bricks, concrete, and siding; abandoned automobiles, auto parts, scrap tires, appliances or"white goods", furniture, yard waste, household trash and medical waste Sites used for illegal dumping vary but may include abandoned industrial, residential, or commercial buildings; vacant lots on public or private property; and infrequently used alleys or roadways. Because of their accessibility and poor lighting, areas along rural roads and railways are particularly vulnerable. Illegal dumping can occur at any time of day but is more common at night or in the early morning hours during warmer months. If not addressed illegal dumps often attract more waste, potentially hazardous wastes such as asbestos, household chemicals and paints, automotive fluids, and commercial or industrial wastes. Offenders can include: construction, demolition, remolding, roofing, or landscaping contractors, general hauling contractors, operators of junkyards, automobile repair or tire shops, scrap collectors, local residents and "do-it-yourselfers. An individual may claim to be operating a transfer station or recycling business and accept waste at an unpermitted facility, only to abandon the facility when it reaches capacity. A resident may dump wastes that did' not get picked' up by local waste haulers, such as bulky items, carpeting, or household hazardous wastes. In many cases, illegal dumpers are breaking other laws relating to vehicle licensing, insurance, drug'possession or theft. _. _. The health risks associated with illegal dumping are significant. Ares used for illegal dumping may be easily accessible to people, especially children, who are vulnerable to the physical (protruding nails or sharp edges) and chemical (harmful fluids or dust)hazards posed by wastes. Rodents, insects, and other vermin attracted to dump sites may also pose health risks. Dump sites with scrap tires provide an ideal breeding ground for mosquitoes, which can multiply 100 times faster than normal in the warm, stagnant water in scrap tire casings. Severe illnesses, including encephalitis and dengue fever, have been attributed to disease-carrying mosquitoes originating from scrap piles. In addition, countless neighborhoods have been evacuated and property damage has been significant because of dump sites that caught fire, either by spontaneous combustion or, more commonly, by arson. Illegal dumping can impact proper drainage of runoff, making areas more susceptible to flooding when wastes black ravines, creeks, culverts, and drainage basins. In rural areas, open burning at dump sites can cause forest fires and severe erosion as fires burn away trees and undergrowth. Dumping activities in such areas can also have a negative impact on plants and wildlife. Additionally, runoff from dump sites containing chemicals may contaminate wells and surface water used as sources of drinking water. Dump sites serve as magnets for additional dumping and other criminal activities. As a result of illegal dumping, property values decrease and the community becomes unattractive to commercial and residential developers. Without the tax revenues that accompany development, the funding available to establish and maintain effective illegal dumping prevention programs is limited. Ultimately, it is the development of areas susceptible to illegal dumping that eradicates the problem. Finally the costs to local government and industry associated with continuous clearing dumped waste materials are significant. Some urban areas have reported spending several million dollars per year on cleanup, hauling, and disposal activities associated with illegal dump sites. These costs may be passed along to residents in the form of higher service fees or property taxes. Existing Activities Related to Illegal Dumping Prevention and Abatement Public Works Department A. Litter/debris collection on approximately 640 centerline miles of County roadway. In regards to pick up of illegally dumped debris, Public Works is responsible for dealing with items dumped along the public road right of way under County jurisdiction. Public Works maintains about 700 miles of roadway throughout the county. When a call comes in reporting illegal dumping, information is collected as to the location of the material and a work order request is generated and given to the appropriate road supervisor to investigate. Items that are deemed a road or health safety issues are dealt with immediately to mitigate the any potential hazard. Any dumped items that are not an immediate roador health hazard remain until it can be removed efficiently with available crew. Typically, if the items dumped can be handled manually, a referral is sent to General Services to pick up with their Work Fare Program. Public Works usually handles the large, heavy items such as boats, appliances, furniture, etc. Any dumping complaints can be called into our Maintenance general phone number, 925-313-7000. B. " The tracking of debris collection costs specifically to the North Richmond area was initiated in fiscal year 2000-2001. General Services Department A. General Services uses manual labor to do roadside litter pick-up. CSD crews pick up debris, tires, discarded furniture, appliances, and assorted garbage. GSD does not use heavy equipment to pick up items or materials for removal, nor do the crews pick up low-level hazardous material; this is a function performed by Public Works. The crews dispose of the material by using County garbage services and/or direct hauling to the dumps. _. B. At this time, due to budget constraints, Public Works staff is only picking up litter/debris that poses as immediate road or health safety issue and has instructed General Services staff to follow suit. All other debris will accumulate until it is cost efficient to send a work crew out for its removal. C. GSD crews are composed of a permanent Work Program Crew Leader and one to three temporary Work Program Aides. The number of WPAs fluctuates with the number of referrals made to GSD by EHSD, as well as the reliability of the staff hired. D. The GSD Work Program, including the recycling operations, has been very effective for many years in providing work experience for welfare recipients and providing the County with unskilled, manual services at a low cost. Recently, however, the decreased numbers of welfare referrals, increased costs of salary and benefits, increased disposal fees, and the reduction in budget for roadside litter have had a significant impact on this program. E. The funding for roadside litter pick-up throughout the County, allocated to General Services by the Public Works Department, for FY 2003-04 is $320,000. F. The Keller Mitigation funds are granted directly to General Services for removal of litter and landscape maintenance in the Bay Point and Bethel Island areas. The amount granted for FY 2005-04 is $145,000. These two sources of funding, the only two identified for litter pick-up purposes at this time, are budgeted at a total of$465,000 for fiscal year 2003-04. FOR ADDITIONAL INFORMATION ON THIS MATTER, PLEASE SEE ATTACHMENT 11. Building Inspection Department A. One inspector assigned to North Richmond, two assigned to Bay Point, performs daily inspections in their areas. The Property Conservation Division provided Code Enforcement for the Building Inspection and Community Development Departments. We enforce Title 7 and Title 8 of the County ordinance. We also provide enforcement and inspection services in 39 Mobile Homes Parks located in the unincorporated areas of the County. We provide building code enforcement for the Cities of Clayton, Moraga, Lafayette and Orinda. Grading violations are investigated and enforced by the Grading Inspectors in the Building Inspection Department. B. Letters to property owners C. Abatement of dumping on private property D. Notify other departments of dumping E. We have one inspector assign to North Richmond and two to Bay Point. The inspectors are in their areas daily. We send letters to property owners, notify other departments of dumping, and abate dumping on private property. F. The inspectors spend about half of their time on dumping issues. This adds up to approximately $150,000.00 per year. Placing a tax lien on the property covers the cost of the abatement. Some may take years to collect but we do collect on most. The department may not be reimbursed if the property is not sold for enough to cover all the bills. The department estimates its losses at $10,000 per year. G. The new ordinance allows us to fence the property. This has changed the location of the dumping. They are now dumping on the street and not on lots. Community Development Department A. Oversight of the County's solid waste collection franchise agreements in some unincorporated areas and coordination with JPA and Special Districts that directly franchise solid waste collection in the remaining unincorporated areas. B. Oversight of existing and future solid waste facilities in the unincorporated areas subject to County land use permits. C. Provide referrals and information regarding recycling and disposal facilities through the County Recycling Hotline, D. Our department does not clean-up illegally dumped materials; the most related cost we have incurred is our staff time spent on the EJ Illegal Clumping pilot(attend meetings and review/comment on reports). E. Our department's involvement in the illegal dumping issue is as a result of our responsibility to: (1)oversee the County's solid waste collection franchise agreements in various Unincorporated areas -and- (2) oversee existing or establishment of new solid waste facilities subject to County Land Use Permits. The County's solid waste collection franchise agreements are meant to regulate the terms of collection of waste from'residences and commercial businesses (not industrial businesses). These agreements require the franchise haulers to assist the County with enforcement of the County's mandatory subscription ordinance. In addition to regular weekly garbage collection from residences, these agreements require the haulers to provide 1 to 2 on-call large pick-ups per residence per year(about 11 33-gallon trash bags per pick-up). The haulers are also required to provide up to ten 20-cubic yard drop-boxes per year for community clean-up days (locations to be selected by the County). There are requirements in the County's Lend Use Permits for some of the solid waste transfer stations and landfills which require the operators to collect litter in certain areas near their facilities. F. Additionally, our department is responsible for staffing the County's Recycling Hotline where we provide information regarding the facilities or services in their area that accept materials for reuse, recycling or disposal. This Hotline is a toll-free number that can be used by residents and businesses. G. These responsibilities although related to illegal dumping are not actions taken solely to prevent or abate illegal dumping; therefore, representing the money or staff-hours spent on these activities as being "spent on preventionlabatement of illegal dumping"would be misleading. H. CDD incurred $25,660.80 in staff costs related to Environmental Justice (including Illegal Dumping Pilot) for FY 2002-2003. We do not have this amount broken down between overall EJ and the Illegal Dumping Pilot, however we estimate that the Illegal Dumping Pilot represents about 15-20% of the staff costs ($3,849.12—$5,132.16). 1. CDD spent 185.10 staff hours related to Environmental Justice (including Illegal Dumping Pilot)during FY 2002-2003. We do not have this amount broken down between overall EJ and the Illegal Dumping Pilot, however we estimate that the Illegal Dumping Pilot represents about 15-20% of the staff time (28-37 hours). Environmental Health Division A. The California Integrated Waste Management Board (CIWMB) has designated Contra Costa Environmental Health as the Local Enforcement Agency for Solid Waste Programs. In addition to permitting and inspection of landfills and transfer stations, the Division staff provided services in waste tire abatement and nuisance abatement. B. Waste Tire: A program receiving grant funding form the CIWMB, the program staff are responsible for guiding the proper disposal of waste tries on property throughout the county(excluding Pittsburg). C. Nuisance Abatement/Code Enforcement: Staff initiates, investigates and abates complaints about solid waste(including litter)and animal waste accumulation on vacant and occupied properties. These services are provided in all unincorporated areas of the county and in cities that request the service. D. Funding levels are based on tonnage fees, and remain the same as least fiscal year. Addition of the Waste fire grant included offset fees for costs related to exclusive disposal of waste tires and waste tire site cleanup. E. $133,650 (3,600 hours) staff costs for three E.H. Technicians working on illegal dumping. Hazardous Materials Programs Division A. The Health Services Department's Hazardous Materials Programs Division is responsible for the regulation and oversight of businesses in Contra Costa County that handle, store, and process hazardous materials. One additional program responsibility that we carry is as the Primary Response Agency for inappropriately released, spilled, abandoned or dumped hazardous materials in all areas of the County. B. The Incident Response Team (IRT) is one of the major Programs of the Division. The IRT is comprised of highly trained and experience Hazardous Materials Specialists who have to be certified, at a minimum, with 240 hours of training by the California Specialized Training Institute. In addition, they bring with them science degrees and years of experience in a broad spectrum of regulatory agencies and industry. C. There are presently four(4)four(4) person teams available for duty. One team is on duty 2417. This staffing level can be expanded as the circumstances dictate. D. The IRT receives calls from citizens, police agencies, and other agencies regarding discovered hazardous materials dumped at various locations and in various states of containment. Based on the IRT's evaluation of the response needed, they usually respond when requested by an Incident Commander or if there appears to be a potential or existing imminent threat to the community or the environment. E. When a call is received, either in our office during regular work hours or from Sheriff's Dispatch after hours, the Lead, Incident Response Team member, evaluates the situation; and if the circumstances dictate that there is a potential threat to the Community' Health, the Incident response team goes to the site. Upon arriving at the scene, the IRT works with the Incident Commander, if present; or conducts an assessment, contains the release, if possible, and then mitigates the release by cleaning it up, or by having the materials properly disposed of. F. Our statistics for 2403 so far this year through 7 NOV 03 demonstrating that there were 59 reports of potential Illegal Dumping activities with 18 resulting in IRT action. The costs of responses range from hundreds to thousands of dollars. In most instances, when the materials recovered meet criteria set by the California State Department of Toxic Substance Control the State may pick the materials up with no cost to the County except the labor and supplies used by IRT. G. For hazardous materials not meeting the State's criteria, the County is responsible for costs of proper disposal. The costs for these responses, is calculated. When a Responsible Party(RP) is ascertained, we attempt to obtain reimbursement for that party. There is no cumulative cost assessment for the labor and supplies expended for these activities. Sheriff Department A. The Office of the Sheriff shall be responsible for enforcement and administration of the Abandoned Vehicle Abatement program. Persons authorized by the Sheriff may enter onto the private or public property to examine a vehicle or parts thereof, obtain information as to the identity of a vehicle and to remove or cause the removalof an abandoned vehicle. The program removes dismantled, wrecked or inoperable vehicles from private property under County Ord. 95-2. CA Vehicle Code Section 22660 supports the ordinance. B. No General Funds are used to fund the Program C. The Sheriff's Office is a member agency of the Cities & County of Contra Costa Abandoned Vehicle Abatement Service Authority. The Service Authority receives funding from the state to be distributed to its member's agency. Monies received from the Service Authority fund the Sheriff's Office Abandoned Vehicle Abatement Program. The revenue is then distributed on a formula. 50%n of the population in the entire county and 50% performance (number of vehicles removed)of all agencies. D. Procedures: 1. Receive referrals-- phone, written, self-initiated 2. Visit site, make contact with resident if possible, tag & inventory vehicles 3. Prepare letters of intent to remove abandoned vehicle. Mail by both certified & regular mail. 4. If a hearing is requested, action is put on hold until the hearing process is exhausted. 5. Two levels of hearing: a. Before the Zoning Administrator b. Before the full Board 6. If a hearing is not requested, tow the vehicle(s) in approximately 20 days after receipt of certified letter. Dependent on scheduling with tow company. For reasons noted below, consolidation would increase over-all programm costs while reducing resources for other road maintenance needs. 2. Though it has a lower cost structure, consolidation of all illegal dumping control activities in the General Services Department(GSD)is also not recommended. GSD staff cannot perform all of the required litter control functions because the equipment needed for major debris pick-up requires operator certification. Certified staff and the necessary equipment exist only in Public Works. Therefore, GSD staff is best suited to the activities that it currently performs, though with a different staffing structure and a different operating schedule. 3. In order to achieve maximum cost-effectiveness, a modification of the existing program is recommended whereby the General Services Department provides service through its grounds maintenance division staff, supplemented by assistance from Public Works when heavy debris pick-up is required. Activities would function on a demand-response basis and be coordinated with Public Works' street sweeping activities. In the North Richmond, service would be provided in consultation with the assistance of the recently hired"Community Services Coordinator." RECOMMENDATIONS: CONSIDER restructuring the illegal dumping control activities in the General Services and Public Works Departments to a demand-response system, coordinated by Public Works and scheduled in conjunction with the street sweeping program. Services will be provided through the General Services Department except when the staff and equipment of Public Works is required, based on the size of material removal. CONSIDER directing staff of Public Works and General Services to pursue implementation of additional cost saving measures, including the utilization of Sheriff and Probation"offender" labor programs,the placement of additional bins at Public Works corporation yards, and the development of an"Adopt-A-Road"program. CONSIDER directing the CAO to provide a progress report in six months to the Environmental Justice Ad Hoc Committee on program costs,public perception of service delivery,and any implementation issues of the proposed cost control measures. CONSIDER supporting recommendations of the Illegal Dumping Taskforce that are targeted toward addressing the root cause of the illegal dumping problem: community education and engagement, enforcing mandatory subscription service, small hauler regulation/licensing, surveillance of problem areas, and greater law enforcement against offenders. BACKGROUND: At the September 16, 2403, Board of Supervisors meeting, Supervisor Gioia requested that the CAO investigate the illegal dumping control services performed by the General Services and Public Works Departments, and the matter was referred to the Transportation,Water, and Infrastructure Committee(TWIG). Supervisor Gioia expressed concern that Public Works was proposing a reduction in its "Debris Pickup" program and suggested that there may be efficiencies gained through an examination of both departments' operations. At the November 3,2003 TWIC meeting, the Committee received a report on the activities of the departments and suggested modifications to staff's recommendations, including establishing priorities for use of"offender" labor from County Sheriff and Probation programs. The Committee also requested a progress report on implementation of the recommendations. At the Environmental Justice Ad Hoc Committee meeting on March 22, 2004, an oral status report was provided, and the Committee requested that a final report be returned in April. Pro&cess Report Since the reduction in gas tax support for illegal dumping control was proposed by Public Works for FY 03-04, both the Public Works and General Services Departments have modified their operations to respond to budgetary constraints. Notwithstanding the fact 2 that personnel and operating costs have continued to rise' while revenues have declined, the program has been impacted indirectly by rising expectations in the community. The factis that illegal dumping control costs(for both departments)have risen from$530,000 in FY 1999-2000 to over$1 million in FY 2002-03. Consequently,the public has been receiving an increasing level of service that has created expectations of a de facto County "garbage service." While this expectation is not supportable, fiscal constraints of both departments have driven new efficiencies and proposed structural changes. Currently, General Services has two crews assigned to illegal dumping control2. Funding for the crews comes from Public Works' gas tax revenues ($445,000 for FY 2003-04) and,(in the Bay Paint area)the Keller Canyon Landfill Mitigation Fund($145,000). For cost reasons, Public Works does not have a crew assigned to illegal dumping on a full- time basis. Instead, PW provides large-equipment pick-ups on an as-needed basis because they have the staff qualified and certified to operate the equipment. In General Services,there are six Crew Leader positions filled, however,only two Crew Leaders are performing illegal dumping control activities in the Grounds Division at this time. In light of the budget reduction by Public Works in FY 03-04, two Crew Leaders have been reassigned out of litter control activities: one to the Recycling program in the Custodial Services Division and the other to grounds maintenance services. The remaining two Crew Leaders are out on workers' compensation claims, with one expected to return imminently. If there is no additional funding provided to illegal dumping control either from Gas Tax or General Fund,there will need to be a reduction and reassignment of staff in General Services, given the current budget and service levels. The Crew Leader positions that do not have a dedicated stream of funding, such as gas tax or Keller Mitigation funds, may be reassigned to the Custodial/Recycle Services Division permanently. The reassignments to the Custodial Services Division would allow for more flexibility in job assignments for Crew Leaders and provide for an alternative source of revenue through charge-outs to service receiving departments. Reassignments may require demotions but would be an alternative to lay-offs. With respect to the Work Program Aides,these positions would be eliminated. In place of these crews, General Services staff would perform litter control as an adjunct to groundskeeping functions, with a gardener and two groundskeepers comprising the new crew. Service Consolidati©n versus Service Restructurinje Both departments propose to restructure operations to a demand-response system, coordinated by Public Works staff since they receive the majority of the service calls and are more frequently canvassing the streets and roads. In addition, Public Works has proposed that litter control activities be coordinated with their Street Sweeping program, so that crews are sent out in advance of street sweeping activity, to ensure that debris is removed and not an obstacle to sweeping. General Services proposes to eliminate the litter pickup crews and assign the function to its grounds maintenance division. This will result in an approximately 15% savings in the hourly cost of the crew. In addition,the grounds maintenance crew will be able to ',xTork the full 10-hour day as opposed to the Workfare crew, which requires the Crew Leader to pick up the Work Program Aides at different locations, losing up to two hours of productive time each day. Restructuring is preferred to service consolidation for the following reasons: 1. Consolidation of services at Public Works would result in significantly higher costs The overhead rate for the GSD litter control program, called "Workfare", is 59.5%. The annual maximum salary for the Crew Leader is$52,707. The annual maximum salary for the Work Program Aide is$19,685. In comparison,the overhead rate for the Public Works Maintenance Division, which performs illegal dumping control, is 63%. The annual maximum salary for the laborer position,the least costly in the Maintenance Division, is$40,744,which is more than double the salary of the Work Program Aide. The annual maximum salary for a"Specialty Crew Leader" is $56,484. Thus, both the laborer and supervisor positions have higher costs than those positions providing the services in General Services, and the overhead rate is also higher at Public Works' Maintenance Division. 2. Consolidation of services at General Services is infeasible because of equipment operator certification requirements The equipment that is used by Public Works staff for large debris removal (the loaders) requires operator certification,which is a component of the Equipment Operator job classification. Shifting the equipment to General Services would not eliminate this requirement, and the job classification could not be altered by a change in department assignment. Therefore,the same cost structure would exist for equipment operators in General Services; the only savings would be in the small differential in overhead between the departments . More importantly, the higher paid 4 Currently,it is sometimes the case that General Services responds to a service request and discovers that the debris requires lifting equipment.This change will reduce the duplication of effort. 5 The charge-out rates for Crew Leaders is$70.12/hr and for Work Program Aides is$19.12. The charge- out rate(with overhead)for the Public Works Laborer is$60.35/hr. 6 The additional costs for training,re-certification and alcohol and drug testing of the heavy equipment operator will have to be absorbed in the overhead structure of General Services Department. 4 equipment operator would be grossly under-utilized on days when the heavy equipment is not needed. Prioritization of Labor from Sheriff's Work Alternatives Pfg ram (WAP} The original litter control program for the County, which was started in the mid-1980's, was a component of a program called "Workfare." Workfare was staffed primarily with welfare recipients who were required to work for grant eligibility. Because of welfare reform, the requirements have changed, causing impacts to the Workfare program. The number of welfare recipients required to work has dwindled significantly; the utilization of low-paid workers (Work Program Aides) referred from the Employment and Human Services Department is insufficient to staff at historical levels; and program costs have increased to the point where crews that once numbered 10 or more are now comprised of a Crew Leader and one to two Work Program Aides. In October 2003, representatives from Public Works, General Services, County Administrator's Office, Sheriff's Office and Probation met to discuss the potential use of "offender' labor for illegal dumping control activities. Representatives from both Probation and the Sheriffs Office agreed to provide assistance; General Services agreed to coordinate these efforts with both departments. While labor from the offender programs was intended to be a viable alternative, a shortcoming is that it cannot be provided on a consistent basis. With respect to the Sheriff's Work Alternatives Program, limitations arise because the supply of labor depends on the willingness, availability and reliability of offenders---who must choose to participate in the program--as well as the physical abilities of participants and their proximity to job sites. In addition,because many of the program participants have jobs, they are only available for weekend participation in the program. Sheriff's Office staff has pointed out that the policy basis for their work alternatives program is to ensure successful completion of service requirements,and maximum flexibility in assignment of participants is an important tool in meeting this objective. A policy of prioritizing assignments to meet the needs of the County's illegal dumping program would inhibit the flexibility that is essential for an effective program. Additionally,the Sheriffs Office has contracts with approximately 35 agencies throughout the county for the provision of labor and feels a responsibility to respect those service agreements. The Sheriff's staff is aware that the Transportation, Water and Infrastructure Committee of the Board has requested that priority be given to County needs, and they are attempting to comply. Since November 2003, nine Work Alternative Participants have been referred to General Services for the dumping program. Those nine participants have worked a total of 19 days, with two days per participant as the average. The "sentences alternatives" are generally a couple of days of work, so it would be difficult to manage the use of these 5 participants even if they are referred in greater numbers. The illegal dumping control program could use a minimum of four to six participants, four days per week (Monday- Thursday). If that number were consistent and reliable, General Services could stop using other paid crew members. At this time, however, it is not possible to have a litter program without the use of paid labor. It should be noted that "WAPers" have been and continue to be used in the General Services Recycling Program in larger numbers. These participants referred to recycling activities typically have physical limitations that prevent them from being used to do roadside illegal dumping control work. Other Cost Reduction Measures The impact of volunteer labor from the Probation Department's `Byron Boys' Ranch" program would be minimal because the availability of labor is limited to weekends. Should the availability be expanded to include weekdays, it would provide some additional cost reduction for GSD. However,the geographic area that could be served by labor from the Ranch is limited and the availability of labor on a consistent basis is likely to be problematic. Bins and Compactors The placement of debris bins and compactors in Public Works' corporation yards in Richmond and Brentwood may result in modest cost savings by reducing travel and waiting time, at times over one hour, needed to bring collected litter and debris to the dumps. Having compactors will help ensure that the bins are efficiently filled before they are hauled off to the dumps. Separate bins for metal and tires are recommended for the corporation yards. Since this idea was first proposed, Public Works has installed bins in the Richmond Corporation Yard. Because of space limitations,bins have not been installed in the Brentwood Yard as yet. Adopt-A-Road Program To provide an additional source of revenue for litter control activities,the County could pursue the development of a program to seek donations from businesses and organizations to provide funding for adopted roads. Staff of the Sheriff s Office has indicated that the production of a sign(to indicate adoption) would cost$150. Staff resources would be required to solicit donations and administer the program. 6 ILLEGAL DUMPING REPORT ATTACHMENT III ENVIRONMENTAL HEALTH DIVISION Inter-Department Memorandum Date: May 14, 2004 To: William B. Recommendations: (1) The Health Services Department establish a$50,000 Mandatory Refuse Collection Fund to be used by the Environmental Health Division to reimburse franchise waste haulers their cost of implementing county ordered mandatory refuse collection services at residential dwellings; (2) the Environmental Health Division fully implement the Contra Costa County Code, Chapter 418-6 — Mandatory Subscriptions to recover the mandatory refuse collection costs via tax assessment liens on the properties, (3) the effectiveness of the program be evaluated annually and a summary report submitted to the Board of Supervisors; and (4) the Fund include annual monies made available by the Board of Supervisors from the solid waste mitigation fees. Background: Chapter 418-6 of the Contra Costa County Code contains the mandates, authority, and procedures required of the Division to implement the Mandatory Subscription requirements for refuse collection services. This program has been implemented for many years, with support from the Solid Waste Section staff of the Community Development Department (CDD). Most of the county franchised solid waste collection and disposal companies have taken property owners who this Division orders to have refuse collection service to Small Claims Court for nonpayment of fees. In the case of the Richmond Sanitary Disposal Company, it has provided CDD with an annual list of those owners who have failed to pay the company for mandatory refuse subscription services. In turn, the CDD has forwarded the list to the Auditor-Controller's Office, a tax lien has been placed on the property, and the collected monies were forwarded to Richmond Sanitary Disposal Company. Approximately eighteen months ago, the County Counsel rendered an opinion that the county could not collect monies for a private firm through tax liens. However, it would be legal for the County to pay the Richmond Sanitary Disposal Company from available county monies and then recover the cost through the tax lien, with the recovered monies going back to the County. CDD staff have discussed with the solid waste franchise haulers the concept of their firms establishing a funding account for the county. This suggestion was not acceptable to the haulers. Currently, there are an estimated 320 residential dwellings in North Richmond that do not subscribe to refuse service. There are also residential dwellings in other parts of the county, including Bay Point, that do not subscribe to refuse service. In accordance with the Code, a small number of owners of residential dwellings have received exemptions from refuse service. The numbers of residential dwellings in the North Richmond area without refuse service likely contribute to the chronic illegal dumping problem in the area. Without the establishment of a recoverable fund to pay the refuse companies to collect household waste from the residents that do not subscribe to refuse collection, the companies will understandably not perform the services, and illegal dumping of refuse will continue to be an unabated residential problem. Fiscal Impact: The average monthly cost of residential dwelling refuse collection services is $25, and Chapter 41$_6 of the County Code authorizes the county mandating of refuse service for up to twelve months. Thus, the cost for mandatory refuse collection service for six months would be $150/household while it would be $300 for twelve months. There is no fee for county agencies to initiate a tax lien through the Auditor-Controllers Office, but there is an $11 charge to release the lien on the property. The administrative costs to the Environmental Health Division would be added to the property tax lien, and would be credited to the Division when the tax liens are recovered. It is our intent to utilize existing staff in funded positions to administer the program and to utilize the Mandatory Refuse Collection Fund to pay for only the refuse collection costs. Including the cost of releasing the tax lien and utilizing an average six-month cost of$161, the fund would support the mandatory collection at 621 residences. Utilizing $311 as the approximate cost for a twelve-month refuse service, the fund would support collection services at 321 residences. Recognizing that some property owners will choose to repay the Division and initiate monthly payments to the refuse companies before a tax lien is placed on the property, it is felt that the requested fund should be adequate for the program needs. It is anticipated that some tax liens will not be recovered in a timely manner, and additional funding may be needed to maintain an effective program level. This issue has been discussed with Supervisors Gioia and Glover, and they have indicated their willingness to continue committing funds from their Solid Waste Mitigation funds to offset these unreimbursed costs. Supplemental Recommendations. Although the County Code authorizes the mandating of refuse collection for up to one year, it is recommended that an initial service length of six months be utilized. This would enable the Division to determine effectiveness in a shorter period of time while still being able to legally extend the service for an additional six months. It is also recommended that the Annual Report to the Board of Supervisors include such information as the number of notices issued and their geographic location, the number of hearings granted and their outcome, the number of refuse exemptions requested, the number of refuse exemptions approved, the number of services assumed by the owner or responsible party, the number of accounts and amounts forwarded to the Auditor-Controller for tax liens, the amount of monies returned to the account from tax liens, the amount of Solid Waste Mitigation funds added to the Fund, and the Fund balance. Action Reauested: Approve the recommendations delineated in the second section of this memorandum and direct the Environmental Health Division to work with the Department Finance Office, County Counsel, and the County Administrators Office to establish the Mandatory Refuse Collection Fund. The Code is all encompassing, and a program issuing waste hauler permits has not been developed or implemented. Problems of illegal dumping in the unincorporated areas of the county are growing, and it appears that unpermitted waste haulers contribute to the problem. On February 9, 2004,the Division convened a meeting to discuss the development of a waste haulers permit program. In addition to Environmental Health staff being in attendance at the meeting, representatives of the Community Development Department, Building Inspection Department and County Counsel participated in the meeting. It was agreed that this Division should proceed with developing an implementation plan for the permit program. Issues that needed to be reviewed and addressed prior to program implementation included: 1. The existing County Code is adequate, but needs amendments. a. Reevaluation of the $2,000 bond requirement. b. Clarification of the required permit time period--one time permanent permit or annual permit. c. Posting of the permit on each vehicle. d. Inclusion of penalty fee authority for operating without a permit. e. Inclusion of an appeal and hearing process. f. Inclusion of fee authority and specified fees included in a fee resolution. 2. Confirmation that municipalities/government agencies are exempted from permits by the existing code if they haul waste from their own properties. If the agencies hire contractors to haul the waste, the contractor would need a permit. 3. Confirmation that building contractors hauling construction/demolition waste with their company equipment from facilities they are constructing would be exempted. If these firms hire subcontractors to haul the waste,the subcontractor would need a permit. 4. Commercial gardeners would need permits for their vehicles or trailers. 5. Review of all franchise hauling companies in the county to determine if each vehicle should be permitted. Program Status: I. Franchise Haulers—The solid waste franchise agreements give exclusive rights to waste collection in the incorporated areas to franchisees. Therefore, a private individual or company with a waste hauler permit issued by the Division would appear to not have the authority to haul refuse from facilities in unincorporated areas of the county. Issuing a resident of North Richmond a waste haulers permit and then telling the individual that they can only haul refuse from incorporated cities (if allowed by City Codes)makes little sense. Status: Community Development Department staff are reviewing the franchise agreements to determine if a"service added"concept for private permitted waste haulers would be in conflict with the agreements. The "service added"concept means that the permitted hauler not only provides a container for refuse and hauls it away for disposal, but the hauler enters the property and performs services including collecting and removing the waste from inside or outside of the premises, 2. Construction and Demolition Wastes---The California Integrated Waste Management Board (CIWMB)has adopted mandatory regulations that will apply to the facilities that collect, recycle, and dispose of construction and demolition wastes. Many local agencies, including Contra Costa County, have adopted or are in the process of adopting building permit regulations that regulate the disposal of construction and demolition(C &D)wastes and require the recycling of a set percentage of the waste at the construction sites. Status: Division staffs are reviewing the CIWMB regulations and building permit requirements to determine if the waste haulers permit program would be duplicative. Division staffs have met with representatives of the Associated General Contractors Association, discussed the C &D waste regulations with them, and will continue meeting with the association. 3. Gardener/Landscape Wastes—The CIWMB has adopted state regulations on the permitting of composting facilities and chipping and grinding facilities. The interest and need to compost organic wastes from gardens are increasing. Division staffs have been instructed to determine if a voluntary certification program for gardeners/landscapers hauling these wastes could be developed, potentially eliminating the need for each vehicle and trailer to be included within a waste-hauling permit. Status: Environmental Health Division and Hazardous Materials Division staffs are active in a Contra Costa-Alameda County Pollution Prevention Program that is currently addressing organic wastes from gardening and landscaping. Ongoing meetings with landscaping business organizations are occurring, and staff will be evaluating the need to include the industry in the waste haulers permit program. 4. Waste Tires—The CIWMB has adopted mandatory waste tire regulations and documenting(via the manifest and trip log system)the proper disposal of waste tires. The Division has just been awarded its 2004-2405 grant by the CIWMB for the second year, the grant intended to allow the Division to continue implementing the waste tire enforcement program. Status: Division staff have developed a data base of approximately 500 waste tire generators, haulers and facilities in the County. This number may actually be larger,but with the coordinated efforts of other local agencies, surrounding counties and cities, and the Cl W1vIB, the Division will continue implementing an active waste tire enforcement program. Board of SuPervisor Action: Environmental Health Division staff intends to have a proposal ready for Board review and action by September 2004.
