SHIU, PUBLIC WORKS DIRECTOR DATE: June 22, 2004 SUBJECT: APPROVE and RATIFY the decision of Gray-Bowen and Company, Inc., as General Manager of the Wiedemann Ranch Geologic Hazard Abatement District, to execute an amendment to the Consulting Services Agreement between the Wiedemann Ranch CHAD and NorCal Engineering Consultants, San Ramon area. ()YO#5511) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&e BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): APPROVE and RATIFY the decision of Gray-Bowen and Company,Inc., as General Manager of the Wiedemann Ranch Geologic Hazard Abatement District (CHAD) to execute an amendment to the Consulting Services Agreement effective May 1, 2004 between the Wiedmann Ranch CHAD and NorCal Engineering Consultants for the coordination and inspection of certain improvements relating to the acceptance of facilities to be maintained by the District. This contract amendment will increase the payment limit for this contract from $24,500 to a new payment limit of$34,500.00 FISCAL, IMPACT: There will not be any impact on the County General Fund.The Wiedemann Ranch GHAD is funded through special assessments on properties within the boundaries of the Wiedemann Ranch CHAD. The proposed contract is consistent with the FY 03-04 program budget. (WO#5511) DATE: June 22, 2004 PAGE: 2 BACKGROUND/REASON(S) FOR RECOMMENDATION(S): Keith Halvorson, the President of NorCal Engineering, has experience in responding to and assisting the GRAD with various types of inspections and fieldwork in the Wiedemann Ranch area. Mr. Halvorson also directs contractors retained by the District to repair landslides, supervises contractors retained to perform preventative maintenance activities,responds to emergency calls from property owners and conducts initial site investigations. This contract amendment is necessary as a result of performing final inspections of the improvements before the District assumes responsibility for facilities and improvements. The CHAD will seek reimbursement from the Developer for charges associated with these inspections. CONSEQUENCES OF NEGATIVE ACTION: Without Board approval, reimbursements for costs incurred to coordinate and perform the inspections of these improvements will not occur. FIRST AMENDML,NT TO CONTRACT This Contract amendment is effective May 1, 2004,between the Wiedemann Rancb Geologic Hazard Abatement District (Public Agency), an agency forted under Section 265 00 of the Public Resource Code and NorCal Engineering Consultants, Inc. (Contractor), a company doing business at 20 Dudley Court, Pleasant dill, CA 94523. WHEREAS,Public Agency and Contractor previously entered into a contract dated May 1, 2003, which Contract was authorized by the General Manager; I-MREFORE, Public Agency and Contractor mutually agree to amend said contract to increase the contract payment limit from$24,500.00 to $34,500.00. In all other respects, the contract dated May 1, 2003 shall remain in full force and effect.
