RECOMMENDATIONS
1. AUTHORIZE an amended General Plan Amendment study for property located at
Evora Road and Willow Pass Road, including APNs:099-152-010,099-160-019,099-
160-020,
99-152-010,099-160-019,099-
160-020,and portions of 099-160-025/028/029,as requested by Thomas/DeNova LLC
to re-designate these parcels from Light Industry (LI) and to Mixed Use (MU) to
integrate proposed light industrial and retail uses for approximately 30 acres contingent
upon a rezoning of the entire site to a planned unit development (P-1 District).
2. ACKNOWLEDGE that granting authorization for this request does not imply any
support for the application to amend the General Plan, but only that this matter is
appropriate for study.

None. If authorization is granted the applicant shall pay fees to cover the cost for a General
Plan Amendment and associated application fees.
BACKGROUND/REASONS FOR RECOMMENDATION
The Community Development Department has received correspondence from
Thomas/DeNova LLC requesting a General Plan Amendment study for several parcels
located in an unincorporated area of Concord along Evora Road north of State Route 4 near
the Town of Clyde. See Exhibit "A" for the letter from Thomas/DeNova LLC This area is
currently designated as Light Industrial (LI) under the Land Use Element Map.
The subject parcels,which are the subject of this request,are part of a larger 52.7-acre land
area that is designated as Light Industry(LI)under the General Plan,Thomas/DeNova LLC
acquired the 62.7-acre parcel from the Lesher Family Trust. Thomas/DeNova LLC has an
approved Land Use Permit from the County allowing the development of 98,404 sq. ft.
distribution center for the Frito Lay Company on approximately 15 acres of the 62.7-acre
parcel. Thomas/DeNova LLC also has an approved grading permit for the entire 62.7-acre
parcel,which identifies future building pads for the Frito Lay Company Distribution Center,
three other building pads on the former Lesher Property. See Exhibit"B"for a map of the
subject site.
The Lesher Property was the subject of General Plan Amendment study in 1988 when the
site was designated to the Light Industrial (LI) land use designation. In adopting this
General Plan Amendment in 1988,the Board designated the Li use to generally allow light
manufacturing,assembly,wholesaling,and warehousing activities.Among the uses allowed
by this designation are printing plants, which at the time Lesher Communications was
considering for its printing operations associated with the Contra Costa Times.This action in
1988 specifically stated that retail, professional office, administrative office,and contractor
yards are prohibited Most recently the Board of Supervisors on December 16, 2004
authorized a General Plan Amendment Study for 2.36-acre parcel directly fronting Evora
Road, which is a part of the site, from Agricultural Lands (AL)to Light Industrial (LI).
ThomaslDeNova LLC now desires to retain the ability to develop a portion of the site for light
industrial uses but also provide some flexibility for the development of large-scale retail
outlets. They believe that the 62.7-acre site is ideally suited to mixing light industrial uses
with large-scale retail uses because it has very good freeway access to Highway 4, and
because it is not adjacent to residences, schools, or other uses where there would be
potential land use compatibility conflicts. It would appear that based on the 1988 Board
action that specified the uses under the Ll designation a General Plan Amendment is
necessary to consider the proposal to allow a mix of light industrial and retail uses.

Staff believes the request for a study is reasonable and recommends that it be authorized
provided that Thomas/DeNova LLC;however,this authorization should be contingent upon
Thomas/DeNova LLC submitting a simultaneous application to rezone the entire site to a P-
1: Planned Unit District. The P-1 District is necessary to establish specific zoning
regulations and standards for the site which would implement the policies that would be
established should the Board eventually adopt a new Mixed Use land use designation.
Should the Board approve this action it would amend the General Plan Amendment study
previously authorized on December 16,2003.Authorization of this amended study does not
imply any support for the application to amend the General Plan,but only that this matter is
appropriate for study.

Dear Patrick,
Pursuant to your recent conversation with Steve Thomas concerning the Thomas/DeNova
property off Evora Road in Concord we now wish to confirm our request that you amend
the present CPA(County File GP#03-0001),the application for which we made to you
in 2002,to include "Mixed Use"development for the following parcels:
a) APN 099-152-010 (this is the service station/mini market/fast food parcel).
b) Portion of APN 099-160-025-28 and 29 (These two parcels represent Parcel
B, as shown on the recorded LLA, in which Parcel A is the Frito Lay parcel.
We want the GPA designation of"Mixed Use"to apply to the 10 acre pad
which is contained within Parcel B. As yet it doesn't have an APN
designation).
c) APN 099-160-019(This parcel is the old STAC gun club parcel).
d) APN 099-160-020-6 (This parcel is the old 10 acre Streuli parcel, which
fronts on Evora Road and lies between the eastern and western access roads
for Parcels A and B and the gun club mentioned above).
We feel that as our location has the following attributes:
a) Excellent visibility from Highway 4
b) Easy freeway access from Highway 4 via the Willow Pass off-ramps and
Exhibit "A"
c) Not adjacent to residential developments, schools and other non-retail and
non-commercial uses
our project is very conducive to retail uses, such as "big box" users, and light industrial
uses. Accordingly, we want this"Mixed Use"designation assigned to the above parcels
identified in(a), (b), (c) and(d) above so as to allow us to develop both retail and light
industrial uses within our project.
