SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
Approve resolution designating the District Attorney as the major provider of comprehensive services to
victims and witnesses of crimes in Contra Costa County, effective July 1, 2004.
FINANCIAL IMPACT:
None. All services are grant funded. A resolution designating the comprehensive provider of victim and
witness services is required to receive grant funding from the State. Costs and revenue for this program will
be added to the District Attorney's 2004/05 budget when notification of the available amount is received
from the State.
REASONS FOR RECOMMENDATION/BACKGROUND:
The District Attorney initiated the first county-wide program to assist victims and witness of crimes in
August 1977 and was originally designated by the Board of Supervisors as the agency responsible for
assistance to victims and witnesses in Contra Costa County. In 1986, this responsibility was transferred to
the Probation Officer, and he has operated the program since that time.
Throughout the State, victim witness assistance programs are operated by District Attorney's Offices in 41
counties, by Probation Offices in 11, community-based organizations in 5, and by the Sheriff s Office in one
county. In recent years, victim witness assistance programs in three counties have migrated from Probation
Departments to District Attorneys. At this time, with the support of the Superior Court in Contra Costa
County and with the concurrence of the County Probation Officer, the District Attorney is in a position to
provide enhanced coordination of services throughout the criminal justice process and desires responsibility
for providing comprehensive services to victims and witnesses in Contra Costa County.

The District .Attorney is working with the County Probation Officer to ensure continuity of services
to victims and witnesses during the transition period.
CONSEQUENCES OF NEGATIVE ACTION:
Failure to approve the recommendation will result in a disruption in services to victims and witness
of crime in Contra Costa, and the likelihood of loss of State funds for these services.

RESOLUTION OF THE GOVERNING BOARD
WHEREAS the District Attorney of the County of Contra Costa initiated the first county-wide program
to assist victims and witness of crimes in August 1977 and was originally designated by the Board of
Supervisors of Contra Costa County as the County agency responsible for assistance to victims and
witness in Contra Costa County; and
WHEREAS the Board of Supervisors transferred responsibility for the County Victim/Witness
Assistance Program to the County Probation Officer in December 1986 (Resolution 86/715), and
WHEREAS the District Attorney,with the support of the Superior Court of Contra Costa County and
the concurrence of the Probation Officer, is in a position to provide enhanced coordination of services
throughout the criminal justice process, and desires responsibility for comprehensive services to victims
and witnesses in Contra Costa County;
NOW, 'THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Contra
Costa recognizes, effective July 1, 2004, the District Attorney as the major provider of comprehensive
services to victims and witnesses in Contra Costa County and as the agency selected by this County
Board of Supervisors as the eligible program to received funds pursuant to California Penal Code section
13835.2, et al.
