APPROVE and AUTHORIZE the County Administrator or his designee to extend the contract with Orrick, Herrington, & Sutcliffe LLP (CHS) for bond counsel services to extend the term of the contract from June 30, 2004 to June 30, 2005. FINANCIAL IMPACT: The cost of bond counsel services is covered in the cost of issuance included in each bond issue. Fees are negotiated for each borrowing transection based upon the size and complexity of the transaction. Other special bond related projects are billed on an hourly basis and charged to occupants of the property for which the bond was issued. BACKGROUND While the County does not currently anticipate issuing bonds in this period, the services of Orrick, Herrington, & Sutcliffe LLP are needed on an occasional basis to prepare presentations to rating agencies. Additionally, it is important to retain a firm with these particular skills to ensure that the County stays updated on advantageous market trends and related legal issues. OHS has worked with the County for the past two decades in the issuance and sale of the County's annual tax and revenue anticipation notes, periodic lease revenue bond issues and its three pension obligation bands. The staff assigned is extremely familiar with the County and are able to prepare the required legal and other documents related to these issues with a minimum of time. APPROVE a Consulting Services Agreement dated July 1, 2004 through June 30, 2005 with Andrew Green Energy Consulting in the amount of $120,000 to provide energy program management services for implementation of Contra Costa County's Strategic Energy Plan. 2. AUTHORIZE the Director of General Services, or designee, to execute the agreement and to issue written authorizations for extra work provided that the cumulative total extra cost for all such authorizations shall not exceed $25,000. FINANCIAL IMPACT The contracted services will be funded by the Williams Settlement funds. Implementation of the energy efficiency measures recommended in the Contra Costa County Strategic Energy Plan will reduce the County's annual energy costs by an estimated $1.2 million. BACKGROUND On December 17, 2002, the Contra Costa County Board of Supervisors accepted the terms of a settlement agreement with the Williams Company related to energy trading practices. The agreement includes a series of payments to the County between December 31, 2002 and January 1, 2007 totaling $3.5 million. The funds are restricted by terms of the settlement "to activities that promote alternative energy production or improved energy efficiency.,' County staff proceeded with the development of a Strategic Energy Plan (SEP), which was completed in January 2004. In addition, the Director of General Services, or designee, was directed to implement the recommendations of the SEP. One of the recommendations of the SEP is to consolidate energy management activities under a single position in the General Services Department. To accomplish this, staff recommends approval of the consulting services agreement with Andrew Green Energy Consulting. Andrew Green Energy Consulting will provide services to assist the General Services Department in implementing the SEP. Fiscallmpact: No impact to General Fund. Contract extension will be paid for with stormwater utility assessment revenue from the unincorporated areas (Fund 2517) designated to the County's Watershed Program. IIL Reasons for Recommendations and Background: Routine street sweeping satisfies the goal of the County's Watershed Program to reduce, eliminate, and prevent stormwater pollution and is mandated by the California Regional Water Quality Control Boards through their joint Municipal Stormwater National Pollutant Discharge Elimination System Permit with the County and cities of Contra Costa. This activity removes sediment, debris, and other contaminants that might normally enter the storm drain system and flow untreated to creeks and other natural waterways. The County has three separate contracts for street sweeping throughout the entire county, one for west county, one for central and east county and one for Alamo, Walnut Creek, Lafayette, and Pleasant Hill. The West County and Central/East County contracts both expire on October 31,2004.Extending the Alamo,Walnut Creek,Lafayette,Pleasant Hill contract until October 31,2004,will allow staff to put all three contracts out to bid at the same time,thereby providing for a possible reduction in the total contract costs due to"economy of scale." Amending the contract to include a subdivision in Alamo and streets in unincorporated Danville will meet the California Regional Water Quality Control Board's requirement that all curbed streets be swept at least once each month. IV. Consequences of Xe2atiye Action: No routine street sweeping will be provided to Alamo, unincorporated Walnut Creek, Lafayette, Pleasant Hill and Danville until November 2004. The County will not be in compliance with its Joint Municipal Stormwater Permit with the San Francisco Regional Water Quality Control Board, which could result in fines of up to $10,000 per day. REASONS FOR.RECOMMENDATIONBACKGROUND: The amendment of the Consulting Services Agreement is needed to assist Public Works Department staff in obtaining environmental clearances for various projects. IV. CONSEQUENCES OF NEGATIVE ACTION: If the Consulting Services Agreement is not amended the project will not obtain required permits causing delays in their construction and/or repair.
