OF URBAN LIMIT LINE CHANGES SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOM'M'ENDATIONS: DEFER activity related to the proposed ballot measure on voter approval of Urban Limit Line (ULL) changes pending final actions related to approval of a mutually agreed upon ULL in association with the extension of Measure C-1988. FISCAL IMPACT: None. The costs to prepare the environmental review of the proposed ballot measure will be directed toward the proposed amendment of the ULL to be coterminous with city boundaries pursuant to the Measure C tax extension expenditure plan. Barry, AICP (9251335-1276) ATTESTED J= 15, 2004 cc: Community Development Department JOHN SWEETEN, CLERK OF THE County Counsel BOARD OF SUPERVISORS AND tr COUNTY ADMINISTRATOR d\Proposed Ballot Mar—ULL BO BY"y, `� ``. %° - - DEPUTY b — } Proposed Ballot Measure on Voter Approval of ULL Changes June 15, 2004 Page Two BACKGROUND/REASONS FOR RECOMMENDATIONS: On March 9, 2004, the Board of Supervisors (Board) directed staff to prepare for its consideration a proposed ballot measure which would (1) extend the term of the ULL; (2) move the ULL to be coterminous with city boundaries where so desired by the cities; and (3)require ratification by voter approval of any decision by the Board to expand the ULL by 25 acres or more. On May 27, 2004,the Contra Costa Transportation Authority(OCTA)approved a proposal for the November 2, 2004 General Election to renew Measure C-1988: Contra Costa Transportation Improvement and Growth Management Program. After lengthy debate, OCTA unanimously agreed to include in the new Measure C Growth Management Program a requirement that a jurisdiction must comply with either the"Countywide ULL"or the"local jurisdiction's voter approved ULL" before that jurisdiction would become eligible to receive 18% return to source funds or 5% TLC (Transportation for Livable Communities) funds. Included in the CCTA's action was the adoption of"Principles of Agreement"which calls for a new countywide mutually agreed upon voter approved Urban Limit Line (ULL) which would run concurrent with extension of the Measure C sales tax to March 31,2034. A copy of the "Principles of Agreement" is included as Attachment#1 to this Board Report. Staff notes that the "Principles of Agreement"calls for a number of actions to be undertaken by the County, including: 1. Adjusting the County's existing ULL to make it coterminous with city boundaries where it intrudes inside the incorporated boundaries on or before September 30, 2004. 2. Beginning on July 1, 2004, a County representative shall participate in sub-regional meetings with city representatives to develop the new ULL, including the criteria for establishing the ULL and future modifications to the line, and on or before December 31, 2004, the County and cities will cooperate in development of a mutually agreed upon ULL and criteria for future modifications that would be placed on the ballot for voter ratification in November 2006. 3. The County would be the lead agency in preparing a Master EIR on the proposed countywide mutually agreed upon ULL Given that the County intends to work in good faith with the cities to establish a mutually agreed upon ULL, it would be advisable to suspend any activities related to the previously proposed ballot measure related to the ULL unless and until those efforts prove ultimately not to be fruitful. In the event that the efforts to create a mutually acceptable ULL are not successful, this Measure may be brought back before the Board for further consideration.
