APPROVE and AUTHORIZE the County Administrator, or designee, to execute a contract with the Contra Costa County Bar Association, in an amount not to exceed $1,550,000 to continue to provide mandated criminal conflict defense Services for the period July 1, 2004 through June 30, 2005, Subject to cancellation if not approved as part of the Final Fiscal Year 2004-05 Budget. FISCAL, IMPACT The costs incurred under this contract in FY 2004-05 will be included in the County Administrator's Proposed 2004-05 Budget and are anticipated to be appropriated in the Final Budget for FY 2004-05. Provision of conflict defense services by the Bar Association is contingent upon appropriation of funds in the Final Budget. BACKGROUND/REASON{ FOR RECOMMENDATION(S): Since 1083, the County has contracted with the Contra Costa County Bar Association for the prevision of conflict defense services. The original contract was in response to the escalating cost of conflict defense services under the old system of court-appointed counsel. Subsequently, in FY 1001-92, the Public Defender created an Alternate Defender's Office to handle conflict cases. The cases referred to the Bar Association generally represent multiple co-defendant cases in which the Alternate Defender's Office can only handle one co-defendant. BY �''�• f �i rti._._-DEPUTY 4 Contract with Contra Costa County Bar Association For Provision of Conflict Defense Services Page 2 June 8, 2004 The contract with the Bar Association for conflict defense services includes only the costs associated with representing criminal and delinquency cases referred to the Bar Association through a written affidavit conflict by the Public Defender and the Alternate Defender. It does not include provision for costs of representation of dependency cases. These cases have been excluded from the County's contract since the Lockyer-Isenberg Trial Court Funding Act of 1997 placed the responsibility for payment of coasts associated with such cases within the Courts' State Trail Court Funding budget. It is no longer a County financial obligation. CONSEQUENCES OF NEGATIVE ACTION: Payment of criminal conflict attorney services is a mandated County cost. If the recommended action is not approved, the contract with the Bar Association will terminate June 30, 2004. The appointment and payment of private attorneys for conflict cases that cannot be handled by the Alternate Defender's Office will revert to the court-appointed method used prior to the Bar Association contract. Ms. Zhanar Verzi was selected after a competitive bid process (Request for Interest# 172) to work as Information systems Programmer Analyst for the Information Technology(IT) Division of Employment and Human Services (EHSD)beginning January 2003. The IT Division supports the technical needs of the entire department, including application development services. Ms. Verzi has been primarily working on migrating existing web applications to a new Server and Database and supporting the Application Development Group with various other special projects. Ms.Verzi continues to provide valuable services to the IT Division and this Board Order will renew her contract for another six (6) months to allow the completion of several pending IT projects. BACKGROUND, Mr. Paul Branson provides Transportation Coordinator services to the County's Employment and Human. Services Department's (EHSD) Workforce Services Bureau(WFS) and Adult Services Bureau (ASB). Twenty percent(2010) of his time is spent providing project oversight to CalWORKs (California Work Opportunity and Responsibility for Kids) three transportation programs: Rides to Success Demand-Response Bus Service (RTS), Children's Transportation Project (CTP), and Independent Living Skills Program (ILSP) Transportation for participants and their children and for teenage foster children emancipating from the foster care system. Eighty percent(80%) of his time is spent coordinating and collaborating with Aging and Adult Services staff, transportation providers, and other agencies to identify gaps in transportation services to the elderly and disabled adult population and developing transportation program models and other solutions to bridge the gaps in transportation services. Additionally, Mr. Branson integrates plans for transportation with other EHSD programs and perforins grant writing to secure additional funds to support transportation program activities, program expansion, and manages, monitors, and compiles reports required by grants and other revenue streams. The purpose of the transportation programs for children and families and for the elderly and disabled adult population is to provide heeded transportation to participants assisting them to be independent, obtain and retain employment, and remove barriers to self-sufficiency. RACK YROIJND. Mr. Tighe Boyle provides Assistant Senior Transportation Manager services to the County's Employment and Human Services Department's(EHSD) Adult Services Bureau.(ASIS). In December 2002, the County's EHSD received a three-yeas grant from the East Bay Community Foundation to develop the Senior Mobility Project. The project goals are to assess the current transportation services for seniors, assist seniors to utilize available transportation services, and develop new transportation services. Mr. Boyle serves as ombudsman/facilitator for seniors and care managers; assesses the demand and develops senior transportation services; researches and develops funding resources;provides grant writing assistance; provides outreach; manages contract services; and conducts trainings. Tighe Boyle was selected from a competitive procurement, Request for Interest(RFI) #207, October 2003. RACK" NM- PharmChem, Inc., which maintains the U.S. Department of Health and Human Services (DHHS) Substance Abuse and Mental Health Services Administration (SAMHSA) certification,provides substance abuse testing and test results documentation for clients referred by the County's Employment and Human Services Department(EHSD). Services include ensuring the availability of specimen collection sites located in the West, Central, and East regions of the County, screening test specimens using three different Laboratory Test Systems, providing"on-demand" sample testing when requested by the County's EHSD social worker, providing Sweat Patch Testing to clients as an alternative to sample testing, and providing monthly statistics for clients referred to substance abuse testing to the County's EHSD for each district office. Random substance abuse testing and Sweat Patch testing are court-required services and are ordered as part of the client service plans. Laboratory results are submitted for inclusion in the Court Hearing(s) on Child Welfare Family Maintenance Reunification cases. PharmChem, Inc. was selected from a competitive procurement, Request for Proposal (RFP)#1051.
