SUBJECT: SALE OF TAX-DEFAULTED PROPERTY TO THE CITY OF PINOLE
IT IS BY THE BOARD ORDERED that the Chair is authorized to execute an Agreement
of Sale entered into between the County of Contra Costa, State of California, and the
City of Pinole, for the sale of Marcel 401-094-014 to the City of Pinole, pursuant to
Revenue and Taxation Code Sections 3791 et sect., as recommended by the County
Treasurer-Tax Collector.

AGREEMENT TO PURCHASE TAX-DEFAULTED PROPERTY
This agreement is made this 11th day of May , 2004 by and
between the Board of Supervisors of Contra Costa County, State of California, and
the City Of Pinole ("Purchaser"), pursuant to the provisions of Division 1, Part 6,
Chapter 8, of the Revenue and Taxation Code.
The real property situated within said county, hereinafter set forth and described
in this agreement is tax-defaulted and is subject to the power of sale by the tax
collector of said county for the nonpayment of taxes, pursuant to provisions of
law.
TERMS AND CONDITIONS
It is mutually agreed as follows.
1. that as provided by Section 3800 of the Revenue and Taxation Code,
the cost of giving notice of this agreement shall be paid by the
PURCHASER, and
2. that the PURCHASER agrees to pay the sum of$ 13,000,00 and the
additional costs of the sale, for the real property described in
EXHIBIT "A"within 14 days after the date this agreement becomes
effective. Upon payment of said sum to the tax collector, the tax
collector shall execute and deliver a deed conveying title to said
property to PURCHASER.
If all or any portion of any individual parol listed In EXHIBIT "A" is redeemed prior to the effective
date of this agreement, this agreement shall be null and void as to that Individual parcel. This
agreement shall also become null and void and the right of redemption restored upon the
PURCHASER'S failure to comply with the terms and conditions of this agreement.

Pursuant to the provisions of Section 3775 of the Revenue and Taxation Code the
governing body of the City of Pinole hereby agrees to the selling price as provided in this
agreement.

WHEREAS, a number of private streets within the City do not meet a minimum level of
inalntenance standards, and
WHEREAS, Donegal Road is such a private street that the City and the Donegal Road
property owners wish to improve, and
WHEREAS,.the City has secured Offers of Dedication from all affected property owners
except 2 Donegal Road, and
WHEREAS,the City has the opportunity to purchase 2 Donegal Road from the Contra Costa
Tax Collector for$13,500, the amount of unpaid property taxes plus administration fees, and
NOW THEREFORE BE IT RESOLVED;by the Pinole City Council,that the Mayor and City
Manager are authorized to execute an agreement to purchase tax-defaulted property, 2 Donegal
Road,APN 401-094-014.
NOW THEREFORE BE IT FURTHER RESOLVED, by the Pinole City Council,that Public
Facility Renovation funds in the amount of$13,500 shall be used for this purchase.
