Bautista, or the Chairperson of the Board of Supervisors to submit and/or sign Contra Costa County's application for approval of the County's Comprehensive Multiagency Juvenile Justice Plan Modification and related contracts, amendments, or extensions with the State of California Board of Corrections. This Resolution also assures that Contra Costa County's Comprehensive Multiagency Juvenile Justice Plan Modification has been developed, reviewed and provided to the Board of Corrections, and provides necessary assurances to the State of California Board of Corrections as required in the grant application. FISCAL IMPACT: $2,738,203 is available to Contra Costa County through the Juvenile Justice Crime Prevention Act (Schiff-Cardenas Crime Prevention Act of 2000). There are no match requirements for the award. BACKGROUND: The State of California Board of Corrections, pursuant to the Juvenile Justice Crime Prevention Act (Schiff Cardenas Crime Prevention Act of 2000, Assembly Bill 1913) as signed into law by the Governor of the State of California on September 7, 2000, is providing a total allocation of $99,725,000 to enable local government units to develop and implement a Comprehensive Multiagency Juvenile Justice Plan. Contra Costa County's allocation for this purpose is $2,788,203. The Juvenile Justice Crime Prevention Act requires that the local Juvenile Justice Coordinating Council be chaired by the County Probation Officer and that the Comprehensive Multiagency Juvenile Justice Plan developed by this body be approved by the Board of Supervisors. Funding from the Juvenile Justice Crime Prevention Act (JJCPA) will allow Contra Costa County to maintain funding for significant children's services. Funding through JJCPA for fiscal year 2004/2005 will allow for the continuation of the majority of the programs established during the initial year of the grant. The following summarizes the programs proposed for continued funding under JJCPA. 1. Duty Probation Officers in High Schools Program Initially funded through Challenge Grant I, the Deputy Probation Officers in High Schools Program has been continued the past two years with funding from JJCPA. The program places probation officers in selected high schools and special necessary schools to provide supervision and intervention services for juvenile offenders and other at-risk youth. The program strongly stresses collaboration among schools, Probation and police agencies to provide supervision and treatment services for youth. The proposed comprehensive multiagency Juvenile Justice plan last year added two probation officers to this program, thereby allowing services to be expanded to two additional high schools in the county, and is recommended for continuation. Il. Deoub Probation Officers in Middle Schools Program The Deputy Probation Officers in Middle Schools Program has been based on the high school model to provide intensive supervision for offenders and an array of early intervention services for at-risk youth. This program was initiated during the first year of JJCPA funding and is being recommended for continuation at a reduced level. Ill. Community Probation Program am Continued JJCPA funding will allow the eight probation officers currently out-stationed in various police agencies throughout the County to continue their focus on high risk youth, at-risk youth and chronic offenders. The deputy probation officers implementing this program work non-traditional hours and collaborate closely with police agencies, schools and community-based organizations to help prevent offending behavior and provide appropriate accountability. IV. Orin Allen Youth Rehabilitation Facility Aftercare Continued funding will allow for the aftercare program at the Orin Allen Youth Rehabilitation facility to continue, allowing for a 90 day period of close supervision and support for those minors graduating from the program. A portion of the aftercare program was initially funded by the SafeFutures grant and was continued and enhanced through JJCPA funding. V. Summit Center Program The Summit Center program represents a collaborative effort between the Probation Department, Children's Mental Health Services, and the County Office of Education to provide residential treatment services for youth in the juvenile justice system in need of mental health and counseling services. Initial funding for this program was, in part, through the SafeFutures grant. Continued JJCPA funding will allow the County to continue to fund the Probation staff working at the facility and to allow for the continued leveraging of other funding sources. _ 3 _ Vi. Volunteers in Probation Program Increased costs and a reduction in revenue will not cover the entire expense for this program. This program was initially funded through the SafeFutures grant and had been continued through JJCPA funding. In order to meet budget requirements, it is recommended that the Volunteers in Probation Program be discontinued. VII. Fee for Service Funding To more effectively respond to the needs of clients, $100,000 of the JJCPA funds has been designated for the purchase of services on an as-needed basis. This approach is intended to effectively address the service needs of youth on an individual basis in order to provide necessary interventions and services. The County continues to work with a number of community-based organizations in providing this support to children in the justice system. Funds may be used for the purchase of equipment and materials, expanding recruitment and outreach, staff training, and minor renovations and repairs. Approval of this contract will allow the Community Services Department to enhance services provided to infants and toddlers, age's birth to three years. The goal of the Home Visiting Program plan is to assure that children, ages 0-5, in our communities are healthy and have access to quality preventive well-child primary care. On October 28, 2003, the Board of Supervisors approved Agreement #28.702-1 with Contra Costa Children & Families Commission, now known as First 5 Contra Costa Children & Families Commission, for the period from July 1, 2003 through ,June 30, 2004. BACKGROUND: Solano County operates their boys ranch program under the provisions of Article 24 of Chapter 2 of Part 1 of Division 2 of the Welfare and Institutions Code of the State of California. The ranch has two 60-bed programs for delinquent boys, which exceed their needs. They make beds available to other counties under the provisions of Section 888 WIC. Section 755 WIC allows the Juvenile Court to permit a ward's placement out of county under the supervision of the Probation Officer of that county. Although Contra Costa County sloes have a boys ranch program, these programs at Fouts Springs are different and would enhance our placement and treatment options for delinquent boys. Their programs would be used for delinquent boys who have failed or run from our ranch program, have treatment needs matching their program, are a threat to the community but their crimes do not warrant a commitment to the California Youth Authority. FOUTS SPRINGS YOUTH FACILITY THIS AGREEMENT, is made and entered into as of the I st day of fix+ 2004 .by and between COUNTY OF SOLANO, a political subdivision of the State of California for the benefit of FOUT SPRINGS YOUTH FACILITY (hereinafter, "Facility") and COUNTY OF CONTRA COSTA, a political subdivision of the State of California(hereinafter"User County"), and ending June 30. 2005 . WITNESSETH WHEREAS,the contracting parties are mutually desirous of providing appropriate facilities for the housing of wards of the juvenile court committed thereto,by the establishment of a youth facility pursuant to the Article 24 of Chapter 2 of Part 1 of Division 881 of the Welfare and Institutions Code; and WHEREAS, the Facility was created and established by the Counties of Solano, Colusa and Placer hereinafter referred to as Establishing Counties, for the purpose of housing wards of the juvenile court committed thereto from said Counties; and WHEREAS,from time to time there exists accommodations in said Facility beyond the needs of the Establishing Counties thus enabling the Establishing Counties to receive in the Facility juvenile court wards from other counties to the extent of such excess accommodations; and WHEREAS,the Facility is willing to receive juvenile court wards from other counties to the extent that the placement needs of the Establishing Counties are to be met before juvenile court wards from other counties will be received and kept in such Facility; and WHEREAS,the User County desires to place wards of its juvenile court in said Facility to the extent that such excess accommodations may exist, subject to said condition; and WHEREAS,the contracting parties agree to provide space for User County Wards for the sum of THREE THOUSAND THREE HUNDRED FORTY SIX DOLLARS ($3,345.00)per month per ward. contract THE PARTIES HERETO DO CONTRACT AS FOLLOWS: 1. User Counties, in consideration of the Establishing Counties providing accommodations for its juvenile court wards, agrees to pay the Facility$3,346 per month per ward and the Facility agrees to accept$3,346 per month per ward. This payment shall cover all costs with respect of the care and maintenance of the wards of the User County, except for the following: a. Costs of any hospital,medical or surgical care and treatment of any of said wards; b. Costs of dental care; C. Costs of transportation and maintenance between User County and said Facility. d. Cost of care if detained in the juvenile hall of the Establishing Counties, said cost to be the cost of maintenance and operation per child per day as determined for the preceding year. e. User County is responsible for transportation of committed wards to and from Facility. It is understood and agreed that the amount of consideration does not necessarily represent the actual cost monthly per ward of maintaining and operating the Facility. Facility will review rates annually, at least sixty (60)days before the end of each fiscal year and notify User County of any rate increase which will become effective July 1"of the ensuing fiscal year. 2. It is expressly agreed and understood that Facility will provide periodic medical examinations during our monthly clinic from our visiting doctor or emergency treatment provided by our staff correctional care nurse at the Facility at no additional cost to User County. 3. Wards committed to Facility will be committed by Juvenile Court Order and Facility will assume custody of said ward or wards when delivered to an authorized employee of Facility. 4. INDEMNIFICATION. A. Facility agrees to indemnify, defend and hold harmless User County and User County's officers, employees or agents from all liability for any loss, damage or injury to persons or property arising from or related to the performance of this agreement, including costs and attorneys fees and without limitation all consequential damages, arising out of negligent or intentional acts or omissions Facility, its employees or agents. contract 2 B. User County agrees to indemnify defend and hold harmless Facility and Facility's officers, employees or agents from all liability for any loss, damage or injury to persons or property arising from or related to the performance of this agreement including costs and attorneys fees and without limitation all consequential damages arising out of negligent or intentional acts or omissions of User County, its employees or agents. 5. Facility is under no obligation to accept the wards of User County, and the Superintendent of Facility may, in his discretion, decline to accept or retain said wards if by reason of limited facilities or other conditions affecting the welfare of the wards at the Facility, it appears to be undesirable. 6. This contract may be terminated at anytime by either party hereto,upon a thirty (3 0) days'written notice to the other party. 7. This agreement shall take effect on(date): M-y 1 2004 8. NON-DISCRIMINATION . In rendering services under this Agreement, Facility and User County shall comply with all applicable federal, state and local laws and regulations and shall not discriminate on the basis of age, ancestry,color, gender, marital status, medical condition,national origin,physical or mental disability,race,religion or sexual orientation. 9. ASSIGNMENT. User County may neither assign nor delegate any of its rights or duties under the terms of this agreement contract without prior written approval of the Facility. 10. ALTERATION. No modification or variation of the terms of this contract shall be valid unless made in writing and signed by the parties hereto, and no oral understanding or agreement not incorporated herein shall be binding on any of the parties hereto. 11. NOTICE.
