ACCEPT the filing of the Preliminary Engineer's Report for County Service Area M-28 for Fiscal Year 2004/2005; INTRODUCE Ordinance No. 13 and WAIVE the reading; 2. FIX May 25, 2004 at 9:30 a.m. in the Board of Supervisors' Chambers, 651 Pine Street, Martinez, California,as the time and place for a public hearing to consider oral and written objections and protests,if any, concerning the Fiscal Year 2004/2005 report. 3. DIRECT the Clerk of the Board to publish a Notice of Filing of the Preliminary Engineer's Report and fixing of Public Hearing thereon in accordance with Government Code Section 25210.77a(Government Code Section 6066) and County Ordinance Code Section 1012-2.608. 4. DIRECT that the County shall make immediately available to the public at;the office of the Clerk l of the Board and the Public Works Department a copy of the Preliminary Engineer's Report and Ordinance No. 13. (District V)Project No. 7473-6X9E70 DATE: April 6, 2004 PAGE: 2 II. FiscalIrnnact: The above actions have no impact on County finances. County services to County Service Area M-28 are funded entirely by the annual service charges obtained from the users of the water, in accordance with Government Code Section 25210.77x. III. Reasons for Recommendations and Backeround: The proposed annual levy of water service charges benefits all property owners within County Service Area M-28 by providing for a community water system (miscellaneous extended service) in accordance with Government Code Section 25210.4(d). The County Service Area M-28 (miscellaneous extended service) includes,but is not limited to,the acquisition,construction,operation,replacement,maintenance,and repair of water supply and distribution systems, including land, easements, rights-of-way, and water rights. Government Code Sections 25210.4a(1). IV. Consequences of Negative Action: The District would be unable to have the Fiscal Year 2004/2005 water service fees collected by the County Tax Collector, and would have to use an alternate method to collect the service fees. ORDINANCE NO. 13 BEFORE THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, AS AND CONSITUTUTING THE BOARD OF DIRECTORS OF CONTRA COSTA COUNTY SERVICE AREA M-28 AN ORDINANCE PRESCRIBING THE ANNUAL WATER SERVICE CHARGES FOR FISCAL YEAR 2004/2005 IN CONTRA COSTA COUNTY SERVICE AREA M-28 The Board of Supervisors of Contra Costa County, as and constituting the Board of Directors of Contra Costa County Service Area M-28, ordains as follows: SECTION 1. ANNUAL UNIT CHARGED FOR FISCAL YEAR 2004/2005. For Fiscal Year 2004/2005, the "annual unit charge" referred to in Section 1 of Ordinance No. 4 is prescribed at $75,300.00. SECTION 2. COLLECTION ON TAX ROLL. The Board of Directors hereby elects to collect the annual water service charge on the Fiscal Year 2004/2005 Assessment Roll. SECTION 3. EFFECTIVE DATE. This Ordinance becomes effective 30 days after passage and, within 15 days after passage, shall be published once with the name of Supervisors voting for and against it in the Contra Costa Times, a newspaper published in the county.
