RichterCosta Contra Costa County Fire Protection District n' DATE: April 6, 2004 nty SUBJECT- Approval of Agreement to Use Property with Robert Hager, Jr. SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the Fire Chief to execute an Agreement to Use Property (non-monetary) between Contra Costa County Fire Protection District and Robert Hager, Jr. for the Fire District's use of his property at 071 Grayson Lane in Pleasant Hill for conducting firefighting training exercises. FISCAL IMPACT: None. BACKGROUND/REASONS FOR RECOMMENDATION: The owner plans to tear down the subject property in the future, and this provides the Fire District with an excellent opportunity to conduct firefighting training exercises involving both destructive training activities (e.g., cutting holes in roof and walls to practice ventilation procedures)and non-destructive training activities (e.g., practicing interior search and rescue operations). This agreement sets forth the terms and conditions under which the Fire District can use the property for training purposes and contains an indemnification provision in favor of the owner. County Risk Management has reviewed and approved the indemnification provision. Richter, Fire Chief � Costa DATE: County April' 6, 2004 ,, ' SUBJECT: Annual Fire Protection Payment for Area of Former Pinole Fire Protection District IYY�YIIYIYiFIYIY�iYIYYYIY4YYY1/YMYYYYwil��y� IIYIiYIIY�y�iYl SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION REQOMMENDATKJNS: Approve and authorize a payment not to exceed $267,750 to the City of Pinole for fire protection services provided to the Contra Costa County Fire Protection District in the area of the former Pinofe Fire Protection District for FY 2003-04 pursuant to an agreement approved November 18, 1980. REASONS FOR RECOMMENDATION/BACKGROUND: In November of 1080, the Board of Supervisors and the City of Pinole entered into an agreement for the provision of fire protection services by the City to the Pinole Fire Protection District. The contract is renewed automatically from year to year and provides for an adjustment in the.yearly fee at the time of renewal. The annual fee was based upon an allocation of the direct fire and communications costs plus an overhead factor for administration. The County was charged a percentage of the aforesaid lire protection cost based on the amount of the assessed valuation in the unincorporated area in relation to the amount of the total assessed valuation, both in the incorporated and unincorporated areas, served by the City of Pinole Fire Department. Commencing with FY 1999-00 and using the FY 1898-99 payment as the base amount, the annual payment has been increased from year to year by four percent plus a $6,500 constant charge for five years to help defray the cost of a new fire apparatus. Effective July 1, 1994, the Pinole Fire Protection District was annexed to the Contra Costa County Fire Protection District. Accordingly, Contra Costa County Fire is now responsible for fire protection services in the area of the former Pinole Fire District. As indicated in the fire district consolidation plan, fire services in the Pinole area will continue to be provided by the City of Pinole Fire Department.
