SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
APPROVE and AUTHORIZE the Fire Chief to execute an Agreement to Use Property (non-monetary)
between Contra Costa County Fire Protection District and Robert Hager, Jr. for the Fire District's use of his
property at 071 Grayson Lane in Pleasant Hill for conducting firefighting training exercises.
FISCAL IMPACT:
None.
BACKGROUND/REASONS FOR RECOMMENDATION:
The owner plans to tear down the subject property in the future, and this provides the Fire District with an
excellent opportunity to conduct firefighting training exercises involving both destructive training activities
(e.g., cutting holes in roof and walls to practice ventilation procedures)and non-destructive training activities
(e.g., practicing interior search and rescue operations).
This agreement sets forth the terms and conditions under which the Fire District can use the property for
training purposes and contains an indemnification provision in favor of the owner. County Risk Management
has reviewed and approved the indemnification provision.

AGREEMENT TO USE PROPERTY
This agreement is made this_kk__ day of April 20p�4 by and between

designated as"District" for the use of the property described as follows:

The parties hereby agree as follows:
1. As part of its training activities, District shall have the right to use the property from
April 6 , 2004 ...... to July 31 , 2004 -, between the hours of
0800 and 2000 , for the purposes of tearing down or destroying Ithe structure(s) on
the above-described property.
2. District's right to tear down or destroy said structure(s) shall/shaH-ntrt fcross out Inapplicable
language)include the right to burn the structure(s).
3. District's right to tear down or destroy said structure(s) shall not include the right to salvage
any building materials from the property, however, it is agreed by the parties that District shall
incur no liability for the damage or destruction of any building materials or other personal
property on or attached to the premises.
4. District shall conduct its training exercises in as safe a manner as possible. Owner shall not
be liable for any injury, death or liability during the period, including District personnel, or the
property of any person during the period of District's use of the property, as specified in
Paragraph 1 hereof. District agrees to save, defend, indemnify and hold harmless Owner from
any and all claims, costs and liability for any damages, injury or death of or to any person or
the property of any person whose injury, death, damage, claim or liability arises or occurs
during or as a result of District's use of the property.
5. District shall have no liability for any injury, death, damage or liability occurring after the
District's period of use, as specified In Paragraph I hereof, has ended. Owner agrees to
save, defend, indemnify and hold harmless District from any and all claims, costs and liability
for any damages, injury or death of or to any person or the property of any person whose
injury, death, damage, claim or liability occurs or arises after the District's period r%f use has
ended, unless from the District's use of the property.

Approve and authorize a payment not to exceed $267,750 to the City of Pinole for fire protection
services provided to the Contra Costa County Fire Protection District in the area of the former Pinofe
Fire Protection District for FY 2003-04 pursuant to an agreement approved November 18, 1980.
REASONS FOR RECOMMENDATION/BACKGROUND:
In November of 1080, the Board of Supervisors and the City of Pinole entered into an agreement for
the provision of fire protection services by the City to the Pinole Fire Protection District. The contract is
renewed automatically from year to year and provides for an adjustment in the.yearly fee at the time of
renewal. The annual fee was based upon an allocation of the direct fire and communications costs
plus an overhead factor for administration. The County was charged a percentage of the aforesaid lire
protection cost based on the amount of the assessed valuation in the unincorporated area in relation to
the amount of the total assessed valuation, both in the incorporated and unincorporated areas, served
by the City of Pinole Fire Department. Commencing with FY 1999-00 and using the FY 1898-99
payment as the base amount, the annual payment has been increased from year to year by four
percent plus a $6,500 constant charge for five years to help defray the cost of a new fire apparatus.
Effective July 1, 1994, the Pinole Fire Protection District was annexed to the Contra Costa County Fire
Protection District. Accordingly, Contra Costa County Fire is now responsible for fire protection
services in the area of the former Pinole Fire District. As indicated in the fire district consolidation plan,
fire services in the Pinole area will continue to be provided by the City of Pinole Fire Department.

Tara Hills,Bayview, Montara Bay communities and the Alhambra Valley corridor. With
a 4% growth factor added to last year's payment, the contract amount of$267,749.51 is
due for FY 03-04. This includes the 4rth annual payment of 5 toward a proportionate
amount of the capital cost of the primary fire engine for the response area (see attached
