The applicant has paid application fees to process this project and is obligated to pay supplemental fees for staff time and material costs. BACKGROUND Site and Proiect description The subject property is a flag lot and is the product of minor subdivision MS22-90.The property is zoned Single Family Residential (R-20), and abuts one of the greens of the Diablo Country Club on the north, a parking lot on the east, a street and putting green on the south and e neighboring resident on the west. The gross area of the site is approximately 3/4 acre in size (0.77 acre)including the deed-restricted area of approximately 35 feet by 144 feet at the rear of the site. The site includes a single-family residence,garage and an unfinished pool.The lot has a slight downward slope in the rear yard that contains a drainage swale and sanitary sewer easement. The drainage swale at the rear of the property is considered an unimproved earth channel by the County Public Works Department and is subject to the Creek Structure Setback Requirements of Title 9. The parcel map for the subdivision was recorded in 1995, and included a grant deed of development rights to the County for the required `Restricted Development Area" in the rear portion of each of the two parcels of the minor subdivision adjacent to the golf green. Development rights are defined to mean and refer to the right of the County to approve or disapprove of any proposed construction, development or improvement within the areas marked "restricted development area". Building Permit for Existing Residence and Swimming Pool The building permit for the residence was issued in November of 2001 (building permit #320241)and the building permit forthe pool was issued in December of 2002(building permit #333916). A hold was placed on the final building permits for the residence and the pool when the County Building Inspector realized that work had been done 'within the restricted development area and within the dripline of an oak tree. Staff determined that maintaining the hold of the final building permit for the residence was not relevant to the issue and the hold was released. The final for the residence was issued in July of 2003. The'hold on the pool fined remains active. April 6,2004 Board of Supervisors File#TP030038 Page 3 Tree Permit In order to comply with the provisions of the Tree Protection Ordinance, a revised notice of tentative approval of a tree permit was sent to the adjacent property owners and to the Diablo MAC on December 12,2003. No comments or appeals were received.The tree permit to allow grading and construction of a 3-foot dry stacked retaining wall within the dripline of a 12-inch oak was approved by the Zoning Administrator on December 23, 2003.' Proposal to Allow Grading and Construction of a Dry Stack Retaining Wall Within A Restricted Development Area and Within the Dripline of One Oak Tree During the building inspections for the new residence and swimming pool, a County Building Inspector noticed that dirt from the pool excavation was being used to level out a portion the rear yard, and that a 3-foot high dry stack retaining wall was being constructed within the restricted development area and within the ddpline of an oak tree. At that point, the inspector noted the property owner of the encroachment problem and a hold was placed on the final for the residence and the pool. The applicant was informed that they would have to obtain approval of a tree permit (part of dry stack wall within the drip line of a 12 inch diameter oak tree) and approval from the Board of Supervisors if they wanted to have the dry stack wall to remain in the restricted development area. Applicants have sought and obtained approval of a tree permit, County;File#TP030038,with no objections from the Diablo MAC or neighbors. Following the administrative approval of the tree permit,notice of the staff decision was issued by mail to the owners of adjacent properties. Letters of support for the tree permit and the dry stack wall were obtained from neighbors and the Diablo Country Club. No objections were received from the ;MAC, regarding the development in the restricted area or the tree permit. Comments on Proposal A. Public Works Department. Flood Control: In a memo dated November 12, 2003, the Flood Control Division of the County Public Works Department stated that they had no issue with the wall being placed within the restricted development area. B. Diablo MAC -- The MAC was given notice (attached) of the tree permit and the development in the restricted development area and voiced no objections. The notice for the tree permit was sent to the adjacent property owners and the Diablo Municipal Advisory Committee. No comments were received from any of the parties notified. CONCLUSION Staff has determined that the request to allow grading and placement of a 3-foot high dry stacked retaining wall within a restricted development area and within the dripline of one oak tree will not conflict with the goals and policies of the County General Plan. Approval of the permit occurred with no comments from adjacent property owners or Diablo MAC.The County Public Works Department has reviewed the plans and had no comments on the issue. Therefore, staff recommends that the Board of Supervisors approve the request to allow the grading and placement of a 3-foot high dry stacked retaining wall to remain within a"Restricted Development Area". The tree and wall are located within a restricted development area that has been dedicated to the County. Subsequent to this approval,the Contra Costa County Board of Supervisors will need to approve the placement of the retaining wall within the restricted development area. The subject property is located at 1710 Clubhouse Road in the Diablo area. A certified arborist has inspected the tree and determined that the tree to be altered is in good health. The background information for this request including site plan may be inspected in the Community Development Department office during normal working hours. Pursuant to Section 816-6,8010 of the Tree Protection and Preservation Ordinance,this is to notify you of the County's Tentative Approval of the request to allow approval to work within the dripline of one (1)tree subject to conditions. Right to Appeal Tentative Approval Any person may appeal the decision to approve this request by filing a letter of appeal with the Community Development.Department. To be valid, an appeal letter must: Office Fours Monday - Friday:8:00 a.m. - 5:00 p.m. Office is closed the 1 st, 3rd & 5th Fridays of each month 1. Be received in the Community Development Department office by no tater than 5.00 P.M. on Monday, December 22, 2003; 2. The letter of appeal must identify the above-listed number and state the specific reasons why the decision does not meet the criteria and factors for granting the tree permit as stated in the Tree Protection and Preservation Ordinance (Chapter 816-6); a copy of the ordinance may be obtained from the Application and Permit Center at x#651 Pine Street, Martinez; and 3. Be accompanied by an appeal fee of$125. Any appeal of this decision will be heard by the San Ramon Valley Regional Planning Commission.
