FISCAL IMPACT None at this time. However, depending on the Board's direction to staff there could be costs incurred by the Community Development Department and County Counsel in the future. BY EPUTY 1 March q,2004 --Board of Supervisors re: Status Report On Key Elements For ULL Voter Initiative Page 2 BACKGROUND/REASONS FOR RECOMMENDATIONS At the December 9,2003 Board of Supervisors meeting,the Board accepted a report from the Community Development Director on the key steps and milestone dates to accomplish the Board's directive to prepare a ballot measure for possible placement on the November 2, 2004 General Election that would establish a new procedure to require voter approval of an expansion to the Urban Limit Line. The December 9th report identified a step in late January or early February to return to the Board with a report and discussion on the key elements for the ballot proposal. Based on previous Board discussions, staff has identified the four (4) basic elements or concepts for inclusion in the ballot measure: 1. Voter Approval for ULL Expansion: The ballot measure would ask the voters to amend the Measure C-1990 ordinance, which established the Urban Limit Line,to establish a new procedural requirement for voter approval of a proposal to expand the ULL . 2. 25-Acre Threshold: The ballot measure would ask the voters to establish 25 acres as the appropriate threshold for triggering future voter approval for a future proposal to expand the ULL . 3. Extend ULL Term to 2020: The current term of the Urban Limit Line runs to December 31, 2010, as adopted by the voters in 1990. The ballot measure would extend the term of the ULL another ten (10) years. 4. ULL Co-terminus with City Limits: The ballot measure would adjust the ULL to make it co-terminus or coincident with the current City Limits in those locations where it overlaps and extends into the incorporated territory of a city. With this understanding of the four key elements or concepts to be included in the ballot measure, staff from the Community Development Department will work with County Counsel to draft preliminary ballot measure language that incorporates the elements listed above. As identified in the December 9th report, staff will then initiate the CEQA review process and circulate the preliminary draft ballot language to the 19 cities and stakeholder interests for review and comment. It is anticipated that staff will return to the Board in late April with a report on the comments received on the preliminary ballot measure language. Staff is bringing this matter to the Board to ensure that Community Development and County Counsel have clear direction and guidance before proceeding to the next phase.
