The Planning Commission approved this project on January 13`x', but an appeal has been filed. The Board is holding a hearing on March 23, 2004. The appeal raised a number of criticisms. The Board will hear more complaints from neighborhood opponents. The Planning Commission fully considered all their claims. The record of evidence and testimony is more than adequate to rebut each challenge, and to support adopting a mitigated negative declaration and approving Gan Shalom Cemetery. We ask the Board to deny the appeal and uphold the Commission's decisions. Enclosed for your information are the following;materials. The applicant's representatives will be available at the hearing to discuss these items. + Form of Petition circulated among County residents who support the cemetery. More than 1,300 signatures have been collected to date. + Letter from Gan Shalom confirming that Rolling Hills Cemetery in Richmond actually cannot accommodate Gan Shalom's needs (contrary to opponent claims). + Letter from Can Shalom accepting security measures recommended by the County Sheriff, with minor modifications. + Photographs of the site and neighborhood, illustrating that the cemetery will fit in and showing commercial-scale equestrian operations in the area. + Realtor flyers for two nearby properties claiming plenty of water and easy commutes, and describing major commercial stable improvements. + Fetters of support from rabbis of Jewish congregations in the area, written in 2002 when the cemetery was first proposed. ,archer NorriS,A Professional Law Corporation y G0139001/340431-2 Board of Supervisors March 17, 2004 Page 2 CEQA Does Not Require an EIR in this Situation. The opponents are correct that when there is a valid dispute among experts whether a project might cause an unmitigated significant impact, that situation might trigger the need to prepare an EIR. However, in this case we have no diMute. The County concluded that the cemetery's use of groundwater might affect neighboring wells. Then staff recommended mitigation measures carefully designed to guarantee this impact cannot occur. There is no risk of an actual significant impact. The mitigations provide an early warning failsafe system to avoid harm. In this situation, it is appropriate and safe to adopt a mitigated negative declaration. Project is Consistent with General Plan,Briones Compact and Zoning Ordinance. The Planning; Commission found that the project is consistent with the General Plan, the Briones Compact, and the Zoning Ordinance. None of the neighbor's objections undermines that conclusion This project does not violate the County's regulations for land uses outside the Urban Limit Line. It is compatible with the goals and restrictions of the Briones Compact. Gran Shalom Cemetery will not be an "urban" development. No water or sewer lines will be built—just a well and a septic system. Only minor road improvements are needed. There will be no houses, no stores, no manufacturing, no construction or activity typically considered "development"—simply funeral services and burials. This project is not urbanizing the area or installing growth-inducing infrastructure. These conditions satisfy the Briones Compact. At all times the property will appear as mostly open space. About 213 of the land will be left untouched,preserving two forested hills and a wide corridor along Pinole Creek. The applicant estimates an average of only 3-4 burials per week. Phase One will take 20-25 years just to fill one small corner of the site(7 acres, 8-112% of the total), while the remaining 76 acres can continue to be used for grazing. Phase Two during the second 20-25 years will be hidden from public view in a protected valley far from Bear Creek Road. liven occupied areas will appear open because there will be no gravestones—only markers installed flush with the ground. The opponents argue that it would be better to locate the cemetery somewhere else, inside the Urban Limit Line. Actually, the opposite is true. As the Board knows, developable land inside the ULL is scarce, and is better used for housing and other purposes in order to reduce the pressure for outward sprawl. This was the County's goal in adopting the Urban Limit Line, and is the key principle offhapfng Cour Future. No one can argue that a cemetery would be good use of the County's limited development land. The County's special cemetery regulations allow the cemetery in the A-2 District. The A-2 regulations allow the cemetery's chapel with a land use permit. They both recognize that these uses are not incompatible with agricultural and related activity. They certainly are not incompatible with the busy commercial equestrian centers that are nearby. GO 139001/340431-2 Board. of Supervisors March 17, 2004 Page 3 Gan Shalom Cemetery was carefully designed to avoid affecting its neighbors. The low level of activity will not cause any nuisance, or harm public health, safety or welfare. There is no valid reason for objecting, and the Board can easily adopt the findings for approval of a land use permit covering bath the cemetery and its chapel building. There is irony in the claim that the cemetery will introduce too much activity and development into the Briones area. Existing uses actually are more intensive and have more activity than the cemetery ever will produce. There are large commercial stables in the vicinity, many with indoor riding arenas. These are very active businesses that attract a steady stream of visitors. Large trucks deliver hay, feed,horses and other supplies on a regular basis. They produce traffic, noise, dust, and runoff that pollutes Pinole Creek. They need emergency medical and police visits. The cemetery will add very little to this existing activity. Traffic will be Minimal,with No Impact. Gan Shalom submitted a traffic study prepared by Abrams Associates, a well-respected transportation consultant. Mr. Abrams' results have been reviewed and accepted by County staff. There is no risk of congestion, or safety hazards, or any ether traffic-related problem. The cemetery will average only 3-4 funerals per week. Funeral processions will occur less than once per week. Funerals are held during non-peak traffic hours. There will be few visitors on a typical day. Funeral processions move at a safe speed. people driving to and from a cemetery tend not to speed. There is no credible risk of blocking emergency vehicles or causing traffic jams. There will not be a parade of water tracks. The consultants do not think it likely that any water deliveries will be necessary. However, in a worst-case situation one medium-size truck can carry enough water to serve 2.5 acres of cemetery. Some Briones businesses and residents track in water during the summer; adding a few more trucks to this situation cannot be considered an impact. The Board should nate that this land also could be developed with a large commercial stable and riding arena, without the requirement for a County use permit. Such a business would produce more traffic and other effects on the neighbors than a cemetery. The 83 acres also could be divided into 5-acre homesites—as is being done on neighboring properties—which would create more pear hour traffic than a cemetery. Opponents offer no data or other evidence to support complaints about traffic impacts. This is nothing but unfounded fear and speculation. G0139001i340431-2 Board of Supervisors March 17, 2004 Page 4 There is No Risk of Any Impact on Neighbors' Water Supplies. The applicant tested water capacity from its existing well. The results were carefully reviewed by Can Shalom's consultant Engeo, by the County's independent consultant Geoconsultants, and by a County planner who has expertise in groundwater. They all concluded that the well can support the cemetery,without any risk of harm to neighbors' water supply. The opponents' consultant challenged their conclusion. Engeo and Geoconsultants reviewed his claims and determined that his analysis used incorrect assumptions and improperly interpreted the data. Fears that other wells will be affected are unfounded. Nevertheless, as an added protection the Planning Commission adopted conditions to protect neighbors. Observation wells will be carefully monitored during the life of the cemetery. An early warning system will trigger more detailed studies and require the cemetery to cut back on water use temporarily, which will stop any problem before it can reach beyond the property line. Recycling and ether measures will be implemented if needed. In a worst-case situation the cemetery will permanently reduce well pumping as the County deems necessary—even if it means replacing grass with other groundcover or letting the grass go dry part of the year. This package of conditions represents a failsafe system guaranteed to protect the neighbors' wells. There is no credible risk that the cemetery, with these conditions, might cause any significant impact on water supplies or water quality. This ends the discussion for purposes of CEQA; no further study is needed, and an EIR certainly is not justified. Last summer, Can Shalom representatives observed at least three new wells being drilled in the vicinity. This apparently occurred without any research into potential effects on neighbors, or any consideration of possible impacts on other wells. Can Shalom certainly was not consulted as to the wells' effects on its own legitimate water rights. The Gan Shalom property could be used for agriculture, irrigated pastures, horse stables and other types of use that would trigger multiple wells and even more pumping than proposed.— without any use permits or County restrictions on water use. Five-acre ranchettes could be created—each with its own well—as is happening throughout the Briones area. The Board should recognize this property owner's right to use the land and draw water, Monitoring Well Did Not Shove an Impact on Groundwater Levels. The appeal claims that the water level in Well 4P-3 dropped V2 inch during the last 12 hours of the 24-Dour well test, and asks why this was not considered significant in evaluating possible impacts on neighbors. The evidence shows that no actual change in water level occurs; this reading must have been an error. G0139003113413431-2 Board of Supervisors March 17, 2004 Page 5 The water level in well P-3 was first measured at 8:05 AM on May 29, 2003, a relatively warm clay. The level remained constant throughout the day. At 10:00 PM, after 14 hours of pumping, a drop of'lz inch was recorded. If this truly was caused by the test pumping,the water table level should have continued falling during the last 10 hours of the 24-hour test, as it did in the observation well close to the pump. However, no other change was recorded, and the water level in P-3 remained steady until the end of pumping. According to consultant ENGEO, Inc., the reading showing a 1/2 inch drop likely was the result of some minor equipment error or other anomaly. The fact that the water level did not continue dropping shows that the 1/2 inch change was not correct. It was reasonable and appropriate not to consider this P-3 reading in the CEQA report. The applicant's expert traffic and water consultants will be available at the hearing to discuss these matters and answer any questions. We ask the Board to follow staff s recommendation, deny the appeal, and uphold the Commission's decision to adopt the mitigated negative declaration and approve the cemetery permit. The Jewish community of Alameda and Contra Costa Counties is in dire need of a Jewish cemetery. Currently, the only cemetery in Centra. Costa County; as well as those portions of Alameda County east of the Oakland Hills, able to accommodate burials conforming to Jewish ritual requirements is Oakmont Cemetery, located in Lafayette. Oakmont Cemetery contains certain limited areas for Jewish burials, although the facilities do not meet the strict requirements for Orthodox Jewish burials and, accordingly, are not available to Orthodox Jews. I attended the planning commission meeting,have read the reports, and I still have serious concerns. The approval by the Board of Supervisors of the cemetery will create a drastic change in the landscape. Once a cemetery is approved and ground has broken,the subsequent chain of events will not be reversible. It is therefore necessary to carefully examine all aspects and potential consequences of the project prior to its approval. It is tantamount that a full EIR be conducted to examine all aspects in detail. Additionally, decisions have been made based on reports which contain errors and do not reflect the data accurately. After my attendance at the planning commission meeting I researched the traffic report and my findings are listed below. Trip Generation "The standard ITE guidelines do not provide any information when calculating the trip generation characteristics for a land use such as a religious non-profit cemetery. Such a situation must be established based on its own individual characteristics."-Abrams & Associates Abrams therefore had the sole task of this assessment, open only to his opinion,which he based on a small number of employees who would work in the area. I propose this is a flawed assessment, there will be a large number of funerals which will occur at the site, this is a dramatic traffic impact and the concern on the community,not the employees on site daily. It is stated in his report"services would have approximately 35 to 75 people in attendance, with approximately 15 to 25 cars at each service"(this is in contrast to the seating capacity proposed by the cemetery,which states it will accommodate 90),with "25%arriving in procession." The numbers assume that the number of people in a single car will range from.2.3 to 3.0. Given the 2.3 estimate and a possible attendance of 90 people,the projected number of cars traveling the roads is 39.1. However, it seems logical that the number of people per car may be closer to 2, due to the remote location, and this would raise the number of cars to 45.Furthermore,with 90 people in attendance, a projection of 23 cars in a processional can be made based on estimates provided by Abrams&Associates. This is an enormous traffic impact. Furthermore, these cars will most likely be arriving within a short time frame impacting the area's traffic. Abrams states that the"total amount of new traffic generated by the project, even during the times that the services would be conducted, is not an issues, since these numbers are well below the threshold where traffic capacity can be measured," Traffic is easily measured when it equates to a increase of 9%of total volume for an area. This is with the estimated 90 in attendance, and the current rate of traffic given in the report by Abrams &Associates. It is hard to believe nearly a 10%increase would not be measurable, especially given the clustered time of arrival for cars and the added issues of processionals and drivers who are distraught and unfamiliar with the area. The report given by Abrams &Associates is weak. The methodology is not noted,nor is the length of time the traffic was studied in"March 2002" it is not clear the number of hours nor the number of days which traffic was assessed for when the report alone is read. Data given by Abrams &Associates shows that traffic was measured for one day: March 27, 2002 for a period of only two hours(1 to 3 in the afternoon). I compared this data from a traffic study conducted by Contra Costa County(June 5, 2002). From the study clone Contra Costa County the "peak traffic hours" are derived and these are in contrast to Abrams &Associates"peak"hours from 4:30-5:30 pm. The Contra Costa traffic study was a much larger study and conducted for a 24 hours period and found conflicting "peak" hours. This"peak"hour determined by Abrams&Associates is in direct contrast to the"peak"hours determined by Contra Costa County,which states North Bound Peak is from 5:30-6:30 and. South Bound peak is from 4:00-5:00 pm. This is an example of the limited data and flawed methodology which was used by Abrams & Associates and the need for a full EIR for the project to fully examine what impact a large cemetery will have on the area. I have reason to believe the study is flawed for additional reasons. Abrams&Associates was hired by Gan Shalom and has presented data which is helpful to their cause. Abrams &Associates testified at the Planning Commission on the results of their study. The testimony was flawed at best, false at worst. This was a public hearing, one which the county bases their decision on. Experts are held to ethical standards, I believe these were intentionally broken. At the planning commission Charley Abrams testified "The.. CHP provides data on accidents on all of the roads in the county, and we looked at this through the county. We looked at five years of data at that time. .. There were some on Bear Creek Road, 1 daresay that there were no fatalities during the period that we looked at this data. And there were also..... everyone of these accidents was a single occupant vehicle, single vehicle involved in it, the majori , of them at night and a lot of those are also noted as alcohol as a factor." Our community has been hard hit with fatal accidents, we are very familiar with them, as stated in the testimony at the planning commission neighbors have come upon these accidents and waited for help to arrive. CHP data for five years(see attached data) indicates there was a fatal accident in 1999 and 2003 on Bear Creek Road. Abrams & Associates would have looked at an earlier data set; however 1999 data would have been included. Additionally, there have been more fatalities this year on Bear Creep Road. As for the testimony stating that the majority of accidents occurred at night: this is simply not true. None of the accidents reported in 1998 or 1999 occurred at night, only one third of those in 2000 occurred at night, 16.7% in 2002, and none in.2003. 'None of these numbers constitute a majority. Even.more important,neither of the fatalities occurred at night. If the hours of proposed cemetery operation are examined(103 am to 2 pm) it is found accidents do occur during this period. The majority of accidents occurred during these hours in 1999(a year which Abrams &. Associates would have examined), and 33.3% of all accidents occurred during these hours for 2000 and 2002. Clearly, these hours are important hours in the traffic patterns of Bear Creek Road. It should also be noted that the cemetery hours listed are only four hours of the day, 16% of the total hours in a day, therefore these hours account for a higher percentage of accidents (if it were representational it would be 16% of all accidents during these hours for the length of time given). Data was not examined for Alhambra Valley Road, however this is an important route for the cemetery to examine given the close proximity and mention of the use of the road in both the traffic report and by members of the organization at the Planning Commission meeting. Data for Alhambra Valley Road shows fatalities during the years examined for 2000 and 2003. In 1999 27.3%of all accidents occurred during proposed cemetery hours and in 2000 half of all accidents occurred during proposed cemetery hours. The report and subsequent testimony by Abrams &. Associates is not reliable and a full, non- biased, correct assessment of the traffic impact of the cemetery should be demanded as part of a full EIR to ensure the safety and integrity of the area. Abrams &. Associates incorrectly testified to the Planning Commission on a very important issue which judgments were made based upon.. As a member of the community I do not have faith in the reports that were presented by the Gan Shalom group. It has to be proven that this project has a realistic chance of succeeding while not negatively impacting adjacent homes, the environment and the Ag. Preserve Agreement. The applies claims that we offer no data and are acting on unfounded fear and speculation. You are well aware by now that we have of red significant data to the contrary. What suits more apparent is that the applicant that has presented unreal claims and it is they that fear that the truth be discovered before a timely approval. The truth is that their preliminary water report showed a wall 1200 feet away from the test well crapped its water level in their twenty four hour test but their final report made no mention of it. The truth is while they claim the property had irrigated tomatoes and hay that this never, ever happened. No such well ever existed. The field was dry farmed. As sure as my seventy two year old father is sitting in this room, a Irian that worked in these fields his whole life, it never h . The truth is they conducted a traffic study north of the property when the cemetery traffic will come from the south where the majority of the population and activity exists. The truth is they claimed there was "maybe only one'fatality+ on 2 area roads in 2003 but six people died. The hazards on Alhambra valley Road and Bear Greek road are:second only to Masco Road. My younger brother, also a firefighter and l held three of these people in our hands at their death. The truth is we were not provided proof that biological impact to the environment from 1000 -2000 human corps per acre wilt be corned in concrete vaults. The preliminary biological study showed the:Federally Endangered Steelhead trout in upper Pinole Creek. No mention of protective mitigations for this highest level of Federal protected specie is made. The County set forward a biologicat study of Pinole Greek last April, It is scheduled to conclude at the enol of this month. The true facts of this study should be included in the full EIR. Last but not least, the safety of the no doubt good people using the cemetery has to be made known. Emergency medical response to this location in is ten to fifteen minutes away.
