DATE: March 23, 2004 PAGE: 2 IIL REASONS FOR RECOMMENDATION/BACKGROUND: The amendment of the Consulting Services Agreement is needed to assist Public Works Department staff in obtaining environmental clearances for various projects. IV. CONSEQUENCES OF NEGATIVE ACTION: If the Consulting Services Agreement is not amended the project will not obtain required permits causing delays in their construction and/or repair. APPROVE a Third Amendment to Lease with Arnold A. Bernstein for the premises at 3431 Macdonald Avenue, Richmond, for continued occupancy by the Employment and Human Services Department (EHS), under the terms and conditions more particularly set forth in the Third Amendment to Lease. 2. AUTHORIZE the Director of General Services, or designee, to execute the Third Amendment to Lease on behalf of the County. FINANCIAL IMPACT The rental rate to extend the term from the current termination date of September 30, 2004 to December 30, 2004 remains unchanged from the current rate of $12,900.00 per month. Payments are budgeted in the Employment and Human Services Department operating budget. BACKGROUND The County has leased the premises since October 1, 1989 for occupancy by the Employment and Human Services Department — General Assistance Program. On July 23, 2002 the Board of Supervisors approved the First Amendment to extend the lease term, provide an option to extend the Lease to March 31, 2004, modify the cancellation provision and to modify the property tax provision. On January 20, 2004 the Board approved the Second Amendment to the Lease to extend the lease term to September 30, 2004. The Third Amendment will provide for an extension of the Lease term to December 30, 2004. A portion of the County owned building at 1300 Macdonald Avenue is being remodeled for the General Assistance Program. It is anticipated that the remodeling will now be completed by December 2004. Approval of the Third Amendment will allow the General Assistance Program to remain at 3431 Macdonald Avenue until the remodeling is complete.
