(WO#514$) SPECIFIC REQUESTS)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE Gray-Bowen and Company, Inc., as General Manager of the Canyon Lakes Geologic Lazard Abatement District (GLAD) to execute an amendment to the Consulting Services Agreement between the Canyon Lakes GRAD and NorCal Engineering Consultants for coordination and supervision of the District's preventative maintenance and major construction programs. This contract amendment effective March 1,2044 will increase the payment limit for this contract from$24,000 to a new payment limit of$40,000.00. II. Fiscal Impact: There will not be any impact on the County General Fund. The Canyon Lakes GHAD is funded through special assessments on properties within the boundaries of the Canyon Lakes GHAD. The proposed contract is consistent with the FY 03/04 program budget. (WO#5148) DATE: March 23, 2004 PAGE: 2 III Reasons for Recommendation and$aciI round: Keith Halvorson, the President of NorCal Engineering, has experience in responding to and assisting the CHAD with the repair of landslide related work in the Canyon Lakes area. Mr. Halvorson directs contractors retained by the District to repair landslides, supervises contractors retained to perform preventative maintenance activities, responds to emergency calls from property owners and conducts initial site investigations. This contract amendment is necessary as the General Manager anticipates that NorCal will exceed their authorized budget as a result of extra work performed for the District on various CHAD and CHAD related contracts. IV. Consequences of N2pat ve Action: Without Board approval, reimbursements for costs incurred to coordinate repair of landslides and preventative maintenance activities will not occur and the GHAD will not be able to effectively respond to emergencies and oversee construction projects during the remainder of this fiscal year. 03/03i2004 16: 44 FAX 925 947 3177 GraY-ioiven & to. c Wrxxs YJ SECOND A.MI ENDMENT TO CONTRACT This Contract amendment is effective March 1, 2004 between the Canyon Wces Geologic Hazard Abatement District(Public Agency), an agency formed under Section 26600 of the Public Resource Code and NorCal Engineering Consultants, Inc, (Contractor), a company doing business at 20 Dudley Court,Pleasant Hill, California 94523 WHEREAS, Public Agency and Contractor previously entered into a contract dated May 1, 2003, which Contract was authorized by the General Manager; WH,ERAS, said contract was previously amended on December 1,2003 to increase the contract payment limit from$18,000 to $24,000; THEREFORE, Public Agency and Contractor mutually agree to amend said contract to increase the payment limits from$24,000 to$40,000. Tri all other respects, the contract dated May 1, 2003 shall remain in full force and effect. In WITNESS WHEREOF,Public Agency and Contractor have executed this Contract as of date written on the first paragraph of this Contract.
