County Counsel March 16, 2004 Board of Supervisors Appeal of Land Use Permit File#LP022068 Page 2 BACKGROUND After conducting a noticed public hearing, on January 13, 2004, the County Planning Commission approved a land use permit for a cemetery on an 83-acre parcel located at the southeast corner of the intersection of Bear Creek Road and Hampton Road in the Martinez/Briones Valley area. Following the hearing, the County received an appeal from an organization identified as the Briones Hills Preserve Alliance. The group has raised concerns about the compatibility of the cemetery with the surrounding area. The appeal was initially scheduled and noticed for this hearing, however it was subsequently discovered that additional time is needed to prepare for and participate in the hearing. Consequently, staff is recommending that the Board reschedule the hearing to March 23, 2004. The applicant has indicated that they do not object to the recommended rescheduling to that date. On March 9, 2004, staff mailed a follow-on notice to all of the parties who were mailed a notice of this hearing to inform them that staff would be recommending that the Board reschedule this appeal hearing. Still, there may be parties who appear at the March 16 hearing who wish to offer testimony at this hearing. Any such individuals should be encouraged to return on March 23 so that all interested parties might hear the offered testimony. However, should a member(s) of the public find it inconvenient to return on March 23, then the Board could consider allowing testimony for those individuals at the March 16, 2004 hearing prior to continuing the hearing on the appeal to March 23. This is to advise that at that hearing staff intends to recommend that the Board reschedule the hearing on the appeal to the Board meeting of MARCH 23, 2004 at 1:00 p.m. in the County Administration Building, 651 Pine Street, (Corner of Pine and Escobar Streets), Martinez, California. Further, staff intends to recommend that the Board not accept public testimony at the March 16, 2004 hearing, but to request those who appear at the hearing on March 16, 2004 to delay any offered testimony on this appeal to the rescheduled hearing date. The applicant for the land use permit has indicated that they do not object to the recommended rescheduling of this item to March 23, 2004. Rescheduling ofPre-Hearing Meeting—The Clerk of the Board of Supervisors hearing notice also indicated that staff would be available to meet with any interested parties on Office Hours Monday - Friday: 8:00 a.m.- 5:00 p.m. Office is closed the 1st, 3rd & 5th Fridays of each month 2 March 16, 2004 prior to the Board of Supervisors hearing. The purpose of this meeting is to (1) answer questions; (2)review the hearing procedures used by the Board; (3) clarify the issues being considered by the Board; and(4)provide an opportunity to identify, resolve, or narrow any differences which remain in dispute. This pre-hearing meeting with staff is being rescheduled to Tuesday, March 23, 2004 at 12:00 p.m. in Room 108, Administration Building, 651 Pine Street, Martinez.
