Barry, AICP, Director of Community Development ® J# DATE: June 3, 2003 SUBJECT: Excess Portion of Buskirk Avenue, Walnut Creek Area Project No.: 0676-6P4082 SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS ACCEPT Grant Deed dated May 6, 2003 from Contra Costa County for Parcel S-8, Pleasant Hill BART Station Area, and DIRECT the Redevelopment Agency to have said deed recorded in the Office of the County Recorder; and AUTHORIZE the Redevelopment Director to sign Grant Deed to EOP a-Oak Road i, L.L.C. Development Co., on behalf of the Agency and DIRECT the Real Property Division to deliver said deed to the grantee. FISCAL IMPACT The Grantee will pay$15,225 to the Agency. BACKGROUND/REASONS FOR RECOMMENDATIONS Parcel S-8 is a small 1,015 square foot parcel required for the development of Area 71318 at the Pleasant dill BART Station. The Disposition and Development Agreement for this Development Area provides for the Agency to convey S-8. Conveyance of this property to the developer, EOP—Oak Road 1, L.L.C.,was approved by the Agency on December 4, 2001. In consummating the transfer the title company discovered title issues that required the County to convey title to Parcel S-8 to the Agency. The County approved this conveyance on May 6, 2003. The recommended action constitutes acceptance by the Agency of the conveyance, and will allow the transfer to EOP—Oak Road 1, L.L.C.,to be completed. EOP—Oak Road 1, L.L.C. is the limited liability company formed by Equity Office Properties Trust to own Area -- rth.
