SUBJECT: CONTRACT AWARD RECOMMENDATION
Bids for REMODEL AT 3811 BISSELL AVENUE, RICHMOND' FOR THE PUBLIC
DEFENDER were received' and opened'at the County Capital Projects Management Division
Office on May 1, 2003.
Option#1—Award contract to P.J.Atkinson Construction without PLA
It is recommended that the Board of Supervisors award the construction contract to the lowest
responsive and responsible bidder, P. J. Atkinson Construction of Walnut Creek, in the amount
of$1,221,300,which includes $1,219,000 base bid and$2,300 Additive Alternate No. 3.
The Contract Compliance Officer has reported that P J. Atkinson has documented an adequate
good faith effort to comply with the requirements of the County's Outreach Program. 'Therefore,
it is recommended that the`Board award the contract to the lowest responsible bidder, P.J.
Atkinson,who has complied with the Outreach Program.
On January 15, 2002, the Board adopted a policy requiring the use of Project Labor Agreements
on County construction projects, :setting a threshold' of $1 million at which projects will be
subject to the PLA policy. It is somewhat unclear"under the policy whether the $1 million
threshold',applies to the estimated project cost,or the contract award amount. The Consulting
Architect for the project estimated the probable construction cost to be $947,500. Accordingly,
the project was not bid as a PLA' project. It'is recommended that the Board of Supervisors
determine that the Board's PLA policy does not apply to this project and award the contract to
P.J.Atkinson without a PLA.
On June 4, 2003, our department received a letter from Aram Hodess of United Association'
Local Union No. 159 (see attached copy). Mr. Hodess has been notified that the Board will
consider this matter on June 17,2003 and may address the Board on the PLA issue.

Option#2—Reject All Bids and Rebid Project with.PLA Requirement
If the Board determines that the PLA policy should apply to this project,the Board may decide to
reject all bids and rebid the project as a PLA project. This alternative is not recommended
because it would delay the start of construction by at least three months.

Dear Mr. Lango:
Ed Woodard of your office suggested 1 contact you. 1 am informed that the above-referenced
project is currently under review by County staff and may be soon recommended for award. The
bid results your office has provided me show that P.J Atkinson,the low-bidder on this project
submitted a base bid of$1,219,000.
As you know, on January 15, 2002,the County Board of Supervisors adopted a Project Labor
Agreement. This policy set a threshold of$1 million at which County construction projects
would be subject to the policy requiring a project labor'agreement.
This project exceeds the $1 million threshold requiring implementation of a PLA. Please inform
me if and when this project will be coming before the Board for consideration and also,please
provide me a copy of any staff recommendation regarding award, including any discussion of
PLA implementation on it. Thank you in advance for your assistance. Please feel free to contact
me if you have any questions.

On this date,the Board of Supervisors CONSIDERED awarding and authorizing the
General Services Director,or designee,to execute a contract in the amount of$1,221,300
with P. J. AtkinsonConstruction,the lowest responsive and responsible bidder for the
Remodel at 3811 Bissell Avenue,Richmond'for the Public Defender.
The Board invited comments from the public, and there were no speakers.
After further discussions,the Board took the following action:'
1. Awarded and authorized the General Services Director,or designee,to execute a
contract in the amount of$1,221,300'with P. J. Atkinson Construction.,the lowest
responsive and responsible bidder for the Remodel at 3811 Bissell Avenue,
Richmond for the Public Defender;
2..' Directed General Services Department to return to the Board of Supervisors with
language for policy.

The above-referenced project and the plans and specifications therefore having been
previously approved, Addendum No. 1 'having been issued and approved, and bids having been duly
invited and received by the Director of General Services on May 1, 2003; and
The bidder listed first above, P.J. Atkinson Construction ("P. J. Atkinson"), having
submitted the lowest responsive and responsible bid,which is$10,500 less than the next lowest bid; and
The Contract Compliance Officer having reported that P. J. Atkinson has documented an
adequate good faith effort to comply with the requirements:of the County's Outreach Program; and
The Director of General Services recommending that the bid submitted by P. J. Atkinson is
the lowest responsive'and responsible bid, and this Board concurring and so finding,'
NOW,THEREFORE,,the Board finds, determines and orders as follows:
The Board DETERMINES that P. J. Atkinson, as the lowest responsive and responsible
bidder, has demonstrated an adequate good faith effort, pursuant to the specifications for this project, to
comply with the requirements of the County's Outreach Program, and the Board WAIVES any;
irregularities in such compliance;:.and
The Board FURTHER DETERMINES that consulting architect for the project estimated
the probable construction cost for the base bid to be $947,500, and the Board, therefore, FURTHER
WAIVES the requirement for a Project Labor Agreement for this project only; and
The Beard, therefore, ORDERS that the contract for the fun-Ashing of labor and materials
for said work is awarded to P. J Atkinson at the listed amount and at the prices submitted in said bid,
and that said contractor shall present sufficient payment and performance surety bonds as indicated
above, and that the Director of General Services, or designee, shall prepare the contract therefore; and

FOR THE PUBLIC DEFENDER
The Beard FURTHER. ORDERS that after the contractor has signed the contract and
returned it, together with the bands as noted above and any required certificates of insurance or other
required docurnents, and the Director of General Services, or designee, has reviewed and found them to
be sufficient, the Director of General Services, or designee, is authorized to sign the contract for this
Board; and
The Board FURTHER ORDERS that in accordance with the project specifications and/or
Ripon signature of the contract by the Director of General Services, or designee,any bid bonds posted by
the bidders are to be exonerated and any checks or cash submitted for security shall be returned; and
The Board FURTHER'ORDERS that the Director of General Services, or designee, is
authorized to sign any escrow agreements prepared for this project to permit the direct payment of
retention into escrow or the substitution of securities> for moneys withheld by the County to ensure
performance under the contract, pursuant to Section 22300 of the Public Contract Code and pursuant to
Public Contract Code Section 4114, the Board DELEGATES its functions under Public Contract Code
Sections 41.07 and 4110 to the Director of General Services, or designee.
The Board'DECLARES that, should the award of the contract to P. J. Atkinson be
invalidated for any reason, the Board would not in any event have awarded the contract to any other
bidder, but instead would have exercised its discretion to reject all of the bids received. Nothing herein
shall prevent the Beard from`'reawarding the contract to another bidder in cases where the successful
bidder establishes a mistake,refuses'to sign the contract or fails to furnish required bonds or insurance in
accordance'with Public Contract Code Sections 5100-5107.
