FIND and DECLARE that an emergency exists and AUTHORIZE the Chief Engineer,Flood Control and Water Conservation District,to proceed in the most expeditious manner with the San Ramon Creek at Casa Vallecita Storm Drainage Repairs project, Alamo area. 2. FIND,based on the evidence set forth below and as contained in the minutes of the Board meeting, pursuant to Public Contract Code Sections 22035 and 22050, that an emergency exists, that the emergency will not permit a delay resulting from our normal procedures for solicitation of bids and contract award,and that the action described in this order is necessary to respond to the emergency. 3. DELEGATE to Chief Engineer the authority to proceed in the most expeditious manner to repair San Ramon Creek at Casa Vallecita in the Alamo area. DIRECT the Chief Engineer to make periodic reports to the Board of Supervisors, as required by Public Contract Code 22050 to enable the Board of Supervisors to determine that there is a need to continue the emergency action. 5. NAIVE the County Outreach Program requirements for construction contracts,purchasing contracts, and professional service contracts. II. FINANCIAL IMPACT: The total estimated contract cost is $270,000, initially funded by Flood Control Zone 3B Funds (100%). Recovery of project costs from those parties responsible for installation of faulty improvements and failure to maintain improvements associated with Minor Subdivision#105-88 is being pursued by the Flood Control and Nater Conservation District. III. REASONS FOR RECOMMENDATION/BACKGROUND: The project is located on San Ramon Creek at Casa Vallecita,a private road crossing San Ramon Creek in the central County community of Alamo. The project will repair failed stream. bank protection that is allowing erosion along both stream banks, threatening the private Casa Vallecita bridge which is the sole access to three residences and compromising the integrity of Drop Structure 3 located just upstream. New slope protection material, including a retaining wall on a portion of the east bank, will be installed in the same location as the material removed. In order to minimize the potential for future failure,the project will also include installing subdrainage systems and redesigned storm drain inlets. The failure is the result of a poorly designed drainage system on the north side of the Casa Vallecita Bridge installed as a part of Minor Subdivision#10588. The system became blocked allowing storm waters to saturate the easterly bank slope behind the bank revetment of San Ramon Creek. In addition,a lack of area subdrainage to intercept water flowing through the underground utility trenches behind the failed slope added to the creek bank saturation, and pressure behind the revetment exacerbating the problem and contributing to the failure. In order for the project to be built during the 2003 summer construction season(i.e. before the winter rains) an emergency declaration is necessary. If we were to follow our normal construction contract advertisement and award process,the repairs could not begin until mid-October,beyond the October I deadline for working in the creek set by the State Department of Fish and Game. Pursuant to provisions of Sections 22035 and 22050 of the Public Contract Code, when the appropriate findings of an emergency are made by the Board of Supervisors,the normal bidding procedures are waived and repairs can begin immediately. We are,therefore,recommending that the Board make such findings and direct the Chief Engineer to proceed with the project and enter into any necessary contracts. IV. CONSEOC.TENCES OF NEGATIVE ACTION: Non-concurrence of the above recommendation will delay repair of the creek bank until 2004 resulting in loss of additional creek bank slope protection sending large amounts of silt downstream. The continued erosion could also result in loss of the private Casa Vallecita bridge severely limiting access to three residences.
