RECOMMENDATION{S) :
Approve and authorize the Health Services Director, or his designee (Chuck
Deutschman) to execute on behalf of the County, Contract Amendment Agreement
#74-139-3 with Bi-.Beat Corporation, a non-profit corporation, effective May
1, 2003 , to amend Contract #74-139-1 (as amended by Contract Amendment
Agreement #74-139-2) , to increase the total Contract Payment Limit by
$21, 556, from $241, 303 to a new total payment limit of $262 , 969 .

This Contract is funded 100% by State Substance Abuse and Crime Prevention
Act (SACPA) - Prop 36 funds. No County funds are required.
BACKGROUND/REAASON(S) FOR RECOMMENDATION{S)
The Substance Abuse and Crime Prevention Act of 2000 (Prop 36) has mandated
and funded Counties to establish Alcohol and Other Drug (AOD) treatment
programs for non-violent drug offenders in lieu of incarceration. On
February 6, 2001, the Board of Supervisors designated the County' s Health
Services Department, through its Community Substance Abuse Services
Division, as the lead agency in Contra Costa County responsible for the
implementation of Prop 36 treatment efforts.
On December 17, 2002, the Board of Supervisors approved Contract #74-1.39-1
(as amended by Contract Amendment Agreement #74-139-2) with Bi-Bett
Corporation for the period from July 1, 2002 through June 30, 2003 , (with
a six-month automatic extension through December 31, 2003) for the provision
of substance abuse intervention and treatment services .
Approval of Contract Amendment Agreement #74--1393 will allow Contractor to
provide an additional level of services to include Outpatient Intervention
Treatment services to Parolees in Central and East County, through June 30,
2003 .

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S) :
Ratify purchase of services from MedStaff for the period from May
1, 2002 through April 30, 2003, and authorize the County Auditor-
Controller to pay the $144, 560 . 88 outstanding balance for nursing
registry services for Contra Costa Regional Medical Center and
Contra Costa Health Centers .

Funding for this Contract is included in the Health Services
Department budget.
EACKCROUND/REASON(S) FOR R.ECOMMENDATION t;S) :
On May 21, 2002, the Board of Supervisors approved Contract #26-
347-3 (as amended by Subsequent Amendments #26-347-4 through #26-
374-6) with MedStaff, for the period from April 1, 2002 through
April. 30, 2003 , with a payment limit of $1, 000, 000, to provide
nursing registry services for Contra Costa Regional Medical
Center. Services were requested and provided beyond the payment
limit and by the end of April 20, 2003, charges of $1, 144, 560 . 88
had been incurred, of which $1, 000, 000 had been paid and
$144, 560 . 88 remains outstanding.
Due to an administrative oversight by both the County and
Contractor, use of the Contractor' s services exceeded the
authorized limits .
The Department is requesting that the amount due to the Contractor
be paid. This can be accomplished by the Board of Supervisors
ratifying the actions of the County employees in obtaining
provision of nursing registry services of a value in excess of the
contract payment limit . This will create a valid obligation on
the part of the County, retroactively authorizing all payments
made by the Auditor-Controller up to now, and authorizing payment
of the balance .
