SUBJECT: Accepting Deferred Improvement Agreement as Satisfied for Subdivision NIS 39-91,
Parcel B, Byron area. (District III}
On December 15, 1998, the Board authorized the Public Works Director to execute a
Deferred'hnprovement Agreement with Byron Seventy-Eight for improvements along Bixler Road
and Highway 4 as required by the conditions of approval for Subdivision IVES 39-91.
The aforesaid Deferred Improvement Agreement was recorded on December 30, 1998 in
Recorder's Serial No. 98-330167 and became an encumbrance against Assessor's Parcel No. 011-
220-022.

The Public Works Director now informs this Board that the requirements outlined in said
agreement have been satisfied.
The Board hereby FINDS that the conditions of above-mentioned Deferred Improvement
Agreement are satisfied.
NOW THEREFORE BE IT RESOLVED that the aforesaid Deferred Improvement
Agreement is EXONERATED.
