DIRECT County Counsel to forward a copy of the attached draft vessels ordinance, which would prohibit persons from operating vessels in a manner that creates unnecessary or excessive wakes, establish mooring regulations, regulate unseaworthy vessels, establish regulations to control vessel sanitation and pollution, and establish regulations for vessels used for occupancy purposes, to the California Department of Boating and Waterways, pursuant to California Harbors and Navigation Code section 660. 2. DIRECT the Sheriff's Office and County Counsel to prepare a final version of the attached ordinance after receiving the response of the California Department of Boating and Waterways, and to bring the ordinance to the Beardof Supervisors for introduction and subsequent adoption. FISCAL IMPACT: Minimal staff costs for forwarding the ordinance to the California Department of Boating and Waterways. If the ordinance is adopted, enforcement costs will depend on the number of ordinance violations. Some enforcement costs may be recovered by placing liens on vessels removed from waterways and stored by the Sheriff. BACKGROUND: The presence of unseaworthy, derelict vessels and vessels that discharge sewage or ether types of pollution into County waterways has long been a concern. These problems are particularly.serious in the Delta. Another concern has been vessels that create harmful wakes while operating near docks and wharves or in areas with boating speed limits. At the request of District 5, the County Counsel's Office and the Marine Patrol Division of the Sheri Officer develope a ordinance to address these concerns. { CONTINUED ON ATTACHMENT:µ_x_. The ordinance amends several sections of the Ordinance Code and adds four new chapters to the Code. Chapter 410-8 of the proposed ordinance establishes mooring requirements. The ordinance requires vessels to be moored so they do not break away from the mooring, prohibits mooring on buoys and other navigation aids, and prohibits moorings that obstruct waterways or endanger property or public safety. Chapter 410-10 prohibits people from sinking vessels or from mooring "unseaworthy" vessels. Unseaworthy vessels are those that are not in good condition, are not structurally sound, are likely to sink, or are not capable of getting underway on their own. Chapter 410-12 establishes regulations to control vessel sanitation and pollution. Under the ordinance, no one may throw any trash, sewage or similar items into a waterway or onto any land where the material is likely to end up in a waterway. It also prohibits anyone from discharging waste from an on-board toilet into a waterway, and it establishes additional regulations regarding oil and petroleum products and flammable liquids. Chapter 410-14 establishes regulations for people who use vessels for living purposes. These regulations apply only to vessels located in within a U unrestricted land use district. These districts are located in the San Joaquin River and the various sloughs of the Delta. Marinas are generally located in water recreational or other restricted land use districts, so vessels located in these districts wouldnot be subject to the ordinance's occupancy requirements. The ordinance's occupancy regulations require a person who uses a vessel as a living facility within a waterway for more than 30 consecutive or non-consecutive days within a 45-day period to obtain a liveaboard permit issued by the sheriff. A person may not obtain a permit unless the vessel is seaworthy and includes a sanitation device. Permits are valid for a year and may be renewed. The sheriff may attach conditions to a permit, and a permit may be revoked if a person does not comply with the conditions. The ordinance also is intended to address problems caused by wakes in speed zones. These problems include damage to docks, shorelines, and other vessels. Existing designated speed zones include Piper, Taylor, Sandmound, and Dutch sloughs near Bethel Island, and Kellogg Creek and the waterways south of Indian Slough near Discovery Bay. Areas near swimmers, near vessels 16 feet in length or smaller, near swimming floats, near docks or wharves, and near vessels engaged in rescue operations are also classified as speed zones. Section 4101-4.002 of the proposed ordinance prohibits persons from operating a vessel in a speed zone in a manner that creates an unnecessary or excessive wake. The proposed ordinance applies to all waterways under the County's jurisdiction. These are waterways located in the unincorporated area of the County. ORDINANCE NO. 2003- DRAFT VESSEL USE, SANITATION AND OCCUPANCY The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code): SECTION 1. SUMMARY. This ordinance designates all waters under the jurisdiction of the County as a special-use area; adds definitions pertaining to vessel use;prohibits persons from operating vessels in a manner that creates unnecessary or excessive wakes; establishes mooring regulations; regulates unseaworthy vessels; establishes regulations to control vessel sanitation and pollution; and establishes regulations for vessels used for occupancy purposes. (Ord. 2003- § 1.) SECTION 11. The title of Division 410 is amended to read: Division 410 VESSEL USE AND WATER SAFETY SECTION 111. Section 410-2.004 is repealed in its entirety and is replaced by new Section 410- 2.004, added by this Section III, to read: 410-2.004 Special-Use Area. For purposes of this division, all of the waters under the jurisdiction of the county are designated as a special-use area. No vessel may be used within this special-use area in violation of the provisions of this division. (Ord. 2003-_§ 3.) SECTION IV. Section 410-2.006 is amended to read: 410-2.006 Responsibility. No person owning,possessing, or in charge of any vessel shall permit the vessel to be operated in violation of this division. (Orris. 2003- § 4; 69-50 § I (part), 1969.) SECTION V. Section 410-2.012 is added to read: 410-2.012 Enforcement. (a) The County may enforce this division by any remedy allowed under this Ordinance Code, including but not limited to infraction prosecution(Chapter 14-8), abatement(Chapter 14-6), or any other remedy allowed by law, including applicable provisions of the Harbors and Navigation Code. (b) The sheriff has full authority to enforce this division. (c) Whenever this chapter grants a power to the sheriff, the power may be exercised by a deputy of the sheriff or by a person authorized by law, unless otherwise provided. (d) All notices and decisions issued by the sheriff pursuant to this division will be transmitted to the registered vessel owner by first class mail and by posting at a conspicuous place on the vessel, or by personal service by the sheriff. (Ord. 2003- § 5.) SECTION VI. Section 410-2.014 is added to read: 410-2.014 Vessel Disposition. A vessel removed and stored by the sheriff may be disposed of in accordance with one of the following methods: (a) The vessel may be sold or otherwise disposed of in accordance with Harbors and Navigation Code Section 526. (b) The vessel may be sold or otherwise disposed of in accordance with the provisions of Article 4 of Chapter 2 of Division 3 of the Harbors and Navigation Code (Boaters Lien Law). The owner of the vessel will be civilly liable to the County for all costs, fees,damages and expenses incurred by the County in removing, storing and selling the vessel. These costs are a lien upon the vessel and the proceeds of the sale. (Ord. 2003- § 6.) SECTION VII. Section 410-2.016 is added to read: 410-2.016 Charges. Charges imposed by the County for services under this division, including the recovery, movement, impounding, and storage of vessels,will be in accordance with the Sheriff's Department fee schedule adopted by the Board of Supervisors. (Ord. 2003-_ § 7.) SECTION VIII. Section 410-2.018 is added to read: 410-2.018 Definitions. Unless the context otherwise requires, the words and phrases used in this division have the meanings given them in Chapter 5 of Division 3 (Sections 650 fl) of the California Harbors and Navigation Code. Notwithstanding the provisions of the Harbors and Navigation Code, the following words have the following meanings for purposes of this division: (a) "Aquaplane'means any device, including skis,used to move one or more persons on the surface of the water and pulled or towed by any vessel, vehicle, or other motive power. (b) "Barge"means a non-self-propelled vessel. (c) "Garbage"includes the following: garbage, swill, refuse, cans, bottles,paper, vegetable matter, carcass of any dead animal, offal from a slaughter pen or butcher shop, trash, rubbish, radioactive waste material, or discarded nonbiodegradable materials including plastics and ORDINANCE 2003 - DRAFT 2 ....................... ............. broken marine equipment. (d) "floor"means to make fast, tie up, or otherwise secure a vessel other than by anchoring. (e) "Seaworthy"means either of the following: (1) Any vessel, except a barge, that meets all of the following criteria: (A) Structurally sound. (B) Not likely to sink. (C) Capable of getting underway and safely maneuvering over the surface of a waterway under its own sailing or mechanical propulsion system. (D) In compliance with all applicable state and federal regulations pertaining to the class and size of vessel in question. (2) A barge that meets all of the following criteria: (A) Structurally sound. (B) Not likely to sink. (C) Capable of being propelled and safely maneuvered over the surface of a waterway. (D) In compliance with all applicable state and federal regulations pertaining to the class and size of the barge in question. (f) "Sewage"means all waste substance, liquid or solid, associated with human habitation, or which contains, or may be contaminated with,human excreta or excrement, offal, or any feculent matter. (g) "Share"means that part of the lad in immediate contact with a waterway, including the area between high-tide and low-tide marks or between high-water and low-water marks. (h) "Stray vessel"means any of the following: (1) An abandoned vessel. (2) A vessel moored without permission. (3) A vessel underway without a competent person in command. (4) A vessel the owner of which is unknown. (i) "To anchor"means to secure a vessel within a waterway by dropping an anchor or anchors to the bottom of the waterway. "Unseaworthy"means either of the following: (1) Any vessel except a barge that does not meet all of the criteria specified in subdivision (e)(1) of this section. (2) Any barge that does not meet all of the criteria specified in subdivision (e)(2) of this section. (k) "Vessel"has the meaning set forth in Harbors and Navigation Code section 651. (1) "Waterway"means any water, lake,river, creek, canal, lagoon,bay, inlet, slough, channel,or tributary situated within the county, or any water area situated within the county providing access for vessels from one place to another. (Ord. 2003- § 8.) SECTION IX. Section 410-2.020 is added to read: 410-2.020 Purpose. The purpose of this division is to protect the health, safety and welfare of residents, boaters, and users of County waterways; to protect and enhance the aesthetic value, natural beauty and scenery of waters within the jurisdiction of the county; and to protect and enhance the value of waters within the jurisdiction of the county as a public attraction by establishing speed zones, establishing mooring regulations, regulating unseaworthy vessels, establishing regulations to control vessel sanitation and pollution,and establishing regulations for vessels used for occupancy purposes. (Ord. 2003-_§ 9.) SECTION X. Section 410-4.002 is amended to read: 410-4.002 Speed Designated; No Unnecessary or Excessive Wake. The areas designated in this chapter are speed zones. No person shall operate any vessel, or permit it to be operated, in a speed zone at a speed in excess of five nautical miles per hour. No person shall operate any vessel, or permit it to be operated, in a speed zone in such a manner that the vessel's speed creates an unnecessary or excessive wake. (Orris. 2003-_ § 10, 69-50 §I (part), 1969). SECTION XI. Section 410-6.018 is added to read: ORDINANCE 2003 - DRAFT 4 ......................... 410-6.018 Hazardous Lights. A person shall not place, erect or install within a waterway any light fixture or fixtures that constitute a hazard to operators of vessels navigating at night. (Ord. 2003-�§ 11.) SECTION XII. Section 410-6.024 is added to read: 410-6.020 Collisions. (a) The operator of any vessel that collides with another vessel or any public or private property within a waterway must immediately secure his or her vessel and notify the owner of the struck vessel, or the owner, lessee, agent, or operator of the public or private property, of the name and address of the owner, and of the operator if this person is not the owner. Notice must be made either in person or by leaving in a conspicuous place in the struck vessel a written notice that includes a statement of the circumstances. After making this notification,the operator must immediately report the incident to the sheriff. (b) Giving the notice and report required under this section does not exonerate any person from giving accident reports required by the Harbors and Navigation Code,the Vehicle Code,or any other report required by law. (Ord. 2003-_§ 12.) SECTION XIII. Chapter 410-8 is repealed in its entirety and is replaced by new Chapter 410-8, added by this Section XIII,to read: Chapter 410-8 MOORING REGULATIONS 410-8.002 Mooring and Anchoring. (a) Any vessel moored or anchored within a waterway shall be moored or anchored with proper care and equipment, and in such a manner to prevent breakaway and resulting damage. (b) Any vessel anchored or mored between sunset and sunrise shall display lights as prescribed by federal and state laws,rules and regulations regarding anchor lights in inland waters. (Ord. 2003- § 13.) 410-8.004 Mooring to Navigation Aids. No vessel shall be moored to any aid to navigation or regulatory marker within a waterway, including buoys,nun-buoys, spar-buoys, or other objects identifiable as aids to navigation. (Ord. 2003-�§ 13.) 410-8.006 Unsafe Moorings. (a) If a vessel is anchored,moored, decked, beached,or made fast to land in such a position as to ORDINANCE 2003 - DRAFT 5 obstruct the normal movement of traffic or in such a condition as to create a hazard to other vessels using the waterway, to public safety, or to the property of another, the sheriff may order and direct necessary measures to eliminate the unsafe or dangerous condition. (b) The sheriff may remove, and, if necessary, store a vessel in accordance with Harbors and Navigation Code Section 523 and dispose of the vessel in accordance with Section 410-2.014 of this code if either of the following occur: (1) The vessel is left unattended and is anchored,moored, docked,beached,or made fast to land in such a position as to obstruct the normal movement of traffic or in such a condition as to create a hazard to other vessels using the waterway,to public safety,or to the property of another. (2) The vessel poses a threat to adjacent wetlands, levies, sensitive habitat, any protected wildlife species, or water quality. (Ord. 2003-T § 13.) SECTION XIV. Chapter 410-10 is added to read: Chapter 410-10 SUNKEN,DANGEROUS,UNSEAWORTHY,AND STRAY VESSELS 410-10.002 Sunken and Beached Vessels. (a) Whenever a vessel is sunk in a waterway, accidentally or otherwise,the vessel must be marked immediately by a buoy or beacon by day and by a lantern or light by night, and the markings must be maintained until the sunken vessel or obstruction is removed. Removal of the vessel must commence immediately and be completed in a timely manner. A vessel that is not properly marked or is not removed in a timely manner is subject to removal and storage by the sheriff. The vessel may be disposed of in accordance with Section 410-2.014 of this code. (b) An abandoned vessel on public property is subject to abatement in accordance with Harbors and Navigation Code Section 522. (Ord. 2003 § 14.) 410-10.004 Dangerous or Disabled Vessels. (a) Any vessel that enters a waterway in a disabled condition, or any vessel in a waterway that is or becomes disabled or dangerously contaminated by any flammable materials,must be reported immediately to the sheriff and is subject to the sheriff's orders and directions. It is unlawful for any person to fail or refuse to comply with the sheriff's orders or directions. (b) A vessel in a waterway is subject to removal and storage in accordance with Harbors and Navigation Cade section 523 if it does either of the following: ORDINANCE 2003 - DRAFT 6 (1) Interferes with, or otherwise poses a danger to, navigation or to the public health, safety, or welfare. (2) Poses a threat to adjacent wetlands, levies, sensitive habitat, any protected wildlife species,or water quality. (Ord. 2003- § 14.) 410-10.006 Unseaworthy Vessels. (a) An unseaworthy vessel may not be moored or anchored in any waterway. (b) This section does not apply to either of the following: (1) A vessel owned and operated by any agency of the federal government or a state, county or city. (2) A new vessel that has.not yet been launched, rigged or equipped. (c) If proof of seaworthiness of any vessel cannot be demonstrated to the sheriff at the time of any inspection, the sheriff may issue a Notice to Comply that clearly identifies the areas in which the vessel is deemed to be unseaworthy and provides a compliance date by which the vessel's owner must return to the sheriff to demonstrate satisfactory corrections of the deficiencies noted on the Notice to Comply. The compliance date must be at least 10 days after the date of the transmittal of the Notice to Comply. (d) If the owner does not comply with the Notice to Comply, the sheriff may remove and store the vessel. The vessel may be disposed of in accordance with Section 410-2.014 of this code. (Ord. 2003-_§ 14.) 410-10.008 Stray Vessels. (a) All stray vessels or any other personal property found in a waterway, not in the lawful possession or control of some person, may be removed and stored by the sheriff. (b) Vessels removed and stored by the sheriff will be released to the owner only after satisfactory proof of ownership'has been presented and full reimbursement made to the county for all costs incident to removal and storage. (c) If proof of ownership cannot be established within 60 days, the vessel may be disposed of in accordance with Section 410-2.014 of this code. (d) Vehicle Code Provisions. A vessel with its hull identification number removed, defaced, ORDINANCE 2003 - DRAFT 7 .............................................................. .................................................................. .......................................................... ...................................... ....... altered, or destroyed may be seized, impounded, and disposed of in accordance with Vehicle Code section 9872.1,. Pursuant to Vehicle Code section 9853.4,a vessel not displaying a current registration sticker is subject to the penalties set forth in Vehicle Code section 9875. (Ord. 2003 § 14.) SECTION XV. Chapter 410-12 is added to read: Chapter 410-12 SANITATION 410-12.002 Prohibited Acts and Activities. A person shall not do any of the following: (a) Throw, discard, discharge,permit to pass, or deposit any refuse,trash, sewage, human or animal excreta, or waste matter of any description into a waterway or onto a shore. (b) Throw, place or deposit and subsequently abandon any dead animals, fish, shellfish, bait or other putrefying matter into a waterway or onto a shore. (c) Discharge or deposit material of any kind on or adjacent to the banks, shores,bulkheads,piers, wharves or beaches of any waterway where the material may be liable to be washed or otherwise deposited into a waterway by tides, floods,storms, waves, or accidental displacement. (d) Float loose timbers,debris, logs or piles in any waterway in such a manner as to impede navigation or cause damage to vessels. (Ord. 2003-_ § 15.) 410-12.004 Toilet Fixtures. (a) A person shall not discharge or deposit or permit to pass into a waterway or onto a shore any human or animal excreta from any head,toilet or similar facility ona vessel. (b) A person shall not operate the toilet fixtures of a vessel within a waterway at anytime so as to cause or permit to pass or to be discharged into the waterway or onto the shore any excrement, sewage, or other waste matter or contaminant of any kind. (c) Toilet fixtures of any vessel used as an abode may be sealed by the sheriff unless the fixtures can be operated in compliance with this section. (Ord. 2003- § 15.) 410-12.006 Discharge of Petroleum,Coal or Paint Products. (a) A person shall not discharge or deposit or permit to pass into a waterway or onto a shore any coal, tar, oil, gasoline, sludge or residuary products of coal,petroleum, asphalt, bitumen or ORDINANCE 2003- 8 other refined oil products,nor any varnish, lacquer or paint products. (b) Any discharge or deposit of these products must be immediately reported to the sheriff and any other agency having concurrent jurisdiction, and it is a violation of this section to fail to do so. (Ord. 2003- § 15.) 410-12.008 Flammable or Combustible Liquids and Materials. (a) A person shall not pump or discharge or permit to pass into a waterway or onto a shore any flammable liquid or combustible material. (b) A person shall not leave or store on any dock, float, or wharf of a waterway any empty tanks or containers previously used for flammable or combustible liquids,unless free from explosive vapors, except that empty safety containers may be kept in storage. (Ord. 2003- § 15.) SECTION XVI. Chapter 410-14 is added to read: Chapter 410-14 VESSEL OCCUPANCY 410-14.002 Applicability. (a) The provisions of this article apply to and within all waterways located within a U unrestricted land use district. (b) Any vessel that is being used as an abode and is located in a waterway in any land use district other than a U unrestricted district, is subject to all applicable use provisions of the designated land use district. (Ord. 2003_§ 16.) 410-14.004 Prohibited Acts and Activities. A person shall not do any of the following: C� (a) Use or occupy any vessel as an abode within a waterway for more than 30 consecutive or nonconsecutive days in any 45-day period,unless the vessel owner obtains a liveaboard permit from the sheriff in accordance with Section 410-14.006 of this code. This subsection does not apply to any vessel owned and operated by any agency of the federal government or a state, county, or city. (b) Cause or allow another person to occupy any moored or anchored vessel as living quarters for which a liveaboard permit is required but has not been secured. (c) Rent or lease berthing space to any vessel for which a liveaboard permit is required but has not been secured. ORDINANCE 2003-_ 9 ''I.,...........11......................................................I.......... ......................................................... ............................................ ..................................1.11.1 (d) Cause or allow a vessel located on or moored to his or her property to be occupied in violation of this chapter for a period of more than 30 days after receipt of a written notice from the sheriff, specifying the vessel involved and its location. (e) Furnish or supply electrical service, natural gas or fresh water, or provide a sewer connection, to any vessel for which a liveaboard permit is required but has not been secured. (Ord. 2003_§ 16.) 410-14.006 Liveaboard Permit. (a) The vessel owner must apply in writing to the sherifffor a liveaboard permit. The application must include the following information: (1) The name of the applicant and the name or names of all individuals to be living aboard the vessel. (2) The name, registration number, make,model, and size of the vessel. (3) The mooring or anchoring location. (4) The addresses and telephone numbers where the applicant and all other adults living aboard can be contacted during regular work hours or when not occupying the vessel. (b) No liveaboard permit will be issued unless all of the following occur. (1) The vessel is seaworthy. (2) The vessel includes either a federally approved marine sanitation device, or a self- contained portable toilet that prevents the overboard discharge of treated or untreated excrement, sewage, or other waste matter or contaminant of any kind. (3) The application is accompanied by a nonrefundable fee in accordance with the Sheriff Department's fee schedule adopted by the Board of Supervisors. (c) If the sheriff determines that the criteria for issuing a liveaboard permit have been satisfactorily met, the sheriff will issue a liveaboard permit. A permit may be made subject to conditions that the sheriff deems appropriate to ensure compliance with this chapter. (d) Liveaboard permits must be prominently placed in two locations on the exterior of the vessel, such as an exterior window, wall, or similar location. Liveaboard permits must be visible from the waterway and shore. ORDINANCE 2003-_ 10 .............- .......... ..................... (e) Liveaboard permits are valid for one year beginning on the first day of the month following the month of issuance. Permits may be renewed by applying for a new permit in accordance with the procedures set forth in this section. (f) No person shall transfer, assign, sell or convey a liveaboard permit. Any attempt to transfer, sell, convey or assign a liveaboard permit is a violation of this chapter and grounds for revocation of the permit. (Ord. 2003_§ 16.) 410-14.008 Permit Revocation. (a) The sheriff may revoke a liveaboard permit if the sheriff determines that the permittee, any occupant, or any person on the vessel is violating any provision of this chapter or the conditions of permit issuance. (b) If the sheriff determines there may be grounds for revocation of a liveaboard permit,the sheriff may issue a Notice of Intent to Revoke the permit. The notice will state the reason or reasons for the proposed revocation and will advise the permittee of the right to request a revocation hearing before the sheriff. (c) The permittee must request a revocation hearing within 10 calendar days from the date the Notice of Intent to Revoke is served. The request must be submitted in writing. If the permittee does not request a hearing within 10 calendar days,the sheriff's decision is final. (d) If the permittee requests a hearing,the permittee will be given the opportunity to testify and to present evidence concerning the grounds set forth in the Notice of Intent to Revoke. After the hearing,the sheriff will issue a written decision to revoke or not revoke the permit and will list in the decision the reason or reasons for the decision. (a) If the sheriff determines a liveaboard permit is required for a vessel but has not been secured, the sheriff may issue a Notice to Comply. (b) The sheriff may issue a written notice for the removal of a vessel from the waterways of the County if any of the following occur: (1) The vessel's liveaboard permit is revoked.
