FINANCIAL IMPACT: None. BACKGROUND: The proposed Montalvin Manor Redevelopment Project Area ("Project Area") is located in the unincorporated area west of Contra Costa County (map attached). Neighboring cities include Richmond and Pinole. The proposed Project Area is predominantly residential with limited revenue generating commercial and industrial uses. The proposed Project Area has experienced an overall physical and economic decline. Without local assistance through the tools of redevelopment, these properties will continue to decline, increasing the existing physical burden on the community and further diminishing the economic viability of the area. More specifically, in the event that the Agency wishes to rehabilitate, redevelop or develop a property in the Project Area, or a property owner, business operator or business tenant wishes to participate in the redevelopment process, the OP Rules outlines the procedures to be followed to ensure that the rights of the participants in the redevelopment process are preserved and goals stated in the Redevelopment Plan are achieved. The approval of the OP Rules is a requirement of the California Community Redevelopment Law ("CRU), which states that within a reasonable time before the approval of a redevelopment plan, the Agency shell make available for public inspection, rules to implement owner participation in connection with the redevelopment plan. The CRL also requires that the Agency adopt rules to extend reasonable preferences to persons engaged in business in the proposed project area; these rules are also to be made available for public inspection prior to their adoption. Adoption of the OP Rules is not an adoption of a Project Area. The Board of Supervisors will consider adoption of tate Project Area at a later date. h THE REDEVELOPMENT AGENCY OF CONTRA COSTA COUNTY, CALIFORNIA Adapted this Order on May 20, 2003,by the following vote: AYES: supwis RS u73.m&, Gw= and DeSAt7LM NOES: Non e ABSENT: stp:wasop, GIOIA ABSTAIN: None **District III Seat VACANT** Resolution No.:2003/340 SUBJECT: Resolution of the Redevelopment Agency of the County of Contra Costa, adopting Rules for Business Tenant Preference and Owner Participation for the Montalvin Manor Redevelopment Project Area and authorizing transmittal of same to the Contra Costa County Board of Supervisors The Contra Costa County Redevelopment Agency RESOLVES THAT: Pursuant to California Community,.Redevelopment Law,rules for owner participation and business tenant preferences must be provided for the redevelopment project area; and Staff of the Redevelopment Agency of the County of Couua osta(the "Agency")has prepared Rules for Business Tenant Preference and Owner Participation(the "Rules")for the Montalvin Manor Redevelopment Project Area, a copy of which are attached hereto as Exhibit A and by this reference incorporated herein; and The Rules are hereby adopted for the aforesaid Project. Copies of such. adopted Rules shall be transmitted by the Executive Director of the Agency to the Contra Costa County Board of Supervisors for its review prior to a joint public hearing to>consider the adoption of the Redevelopment Plan for the Montalvin Manor Redevelopment Project Area..
