There is no impact on the County General Fund. The Blackhawk GHAD is funded through revenues

III. Reasons for Recommendation and Background:
On April 22, 1986, the Contra Costa County Board of Supervisors adopted three resolutions which
resulted in the formation and funding of the Blackhawk Geologic Hazard Abatement District.
Resolution No. 86/209 provided for the addition of geologic hazard abatement extended services with
County Service Area M-23 (Blackhawk area). Resolution No. 86/210 approved formation of the
Blackhawk GHAD pursuant to the provisions of Section 26550 of the Public Resources Code and
appointed the Board of Supervisors to act as the Board of Directors of the GRAD.
Resolution No. 86/211 approved a Joint Exercise of Powers Agreement(TEPA)between the County and
the GHAD to, among other things, provide for the funding of the District through the transfer of a
portion of CSA M-23 revenues.
Richard D. Short, Kleinfelder, Inc., General Manager of the District during the Second Quarter of
2002/03 fiscal year, prepared and submitted the attached report — Blackhawk GHAD Second Quarter
Expense Report for the 2002/03 fiscal year.
Total expenditures for the Second Quarter were $274,009. The attached report details expenditures by
the District under four major budget categories—Major Repair projects, a Preventative Maintenance and
Operations program, a Special Projects program and. Administration. The District responded to a
significant weather event in mid-December. This weather event caused 55 debris flows or slides.
Expenses associated with this event were'$115,685.25.
IV. Consequences of Negative Action:
The quarterly expense reports for GHAD operations will not be available to residents and others with an
interest in the District.

SUBJECT:Revised Second Quarter CHAD Expense Report,FY 2002-2003
Ladies and Gentlemen:
We are submitting this revised Second Quarter GHAD Expense Report to account
for an invoice from Gray Bowen in the amount of $45,179.88 that was submitted
directly to the County and therefore was not accounted for in our previous submittal.
The account balances have been revised accordingly.
Attached is the Blackhawk GHAD expense summary ryfor the second quarter
operations during the fiscal year 2002-2003. The primary activities during this
quarter included follow up activity from the Sequoia/Conifer slide repair project
completed in fiscal year 2041-2002, the CHAD response to the December 15th
storm, and administrative ramp up activities. This period was Kleinfelder's first fill
quarter as General Manager and included meetings with various interested parties for
the purpose of establishing cooperative relationships. The summary report is
followed by a detailed breakdown and a backup invoice summary.
As anticipated, the budget for major repairs and administrative operations has been
N exceeded because of the $378,582 overrun from FY 01/02 and the expenses incurred
for the emergency response during the December 15`" storm. We are submitting a
revised FY 2002/2003 budget in the attached report.

This report presents a summary of the GRAD expenditures during the second quarter
of fiscal year 200212003. A summary of the expenses is presented below in Table 1.

DESCRIPTION OF EXPENSE ACTIVITIES
Major Repairs
During the second quarter expenses were incurred relating to the follow up with the
homeowners on Sequoia Terrace regarding construction related damage claims. The
General Manager and the Operations Manager met with homeowners Oppenheim,
Dougherty and Malone to address their claims of construction related damage. The
GHAD received the pre and post construction floor level survey reports performed
ATI Engineers for ten residences along Sequoia Terrace above the Sequoia/Conifer
slide repair. The floor level data was evaluated and formal letter report responses
were sent to the homeowners. Three of the ten residences appeared to have a
justified claim against the contractors insurance carrier for damage caused by the
construction operations. The claim for landscape damage caused by construction
t t activities was settled with Inge Wheatley.
Preventive Maintenance
After the first significant rainfall a minor erosion condition was observed on the
newly seeded slope above Conifer Terrace. Dover Construction installed whittling
p erosion protection rolls on the slope and the eroded soil in the gutter along Conifer
Terrace was cleaned up.

Gilpin Geoscienc s submitted a geologic report re ung the ground movements
reported by the homeowner at 51 Chestnut property. The Gilpin report cautioned that
sheared formation was encountered at great depth under the site indicating possible
unstable slope conditions. Gilpin provided no hard engineering data to substantiate
their observations. In response to the Gilpin preliminary report CHAD performed a
slope stability analysis of the area and concluded that a slide was not a significant
possibility. Subsequently, Gilpin retracted their comments in view of the slope
stability analysis results. Slope indicator readings would be monitored at the site to
confirm the engineering analysis.
On the night of Sunday December 15, 2002, a severe rainstorm impacted the
Blackhawk community depositing 3.5 inches of rain in less than eight hours.
Because of the intensity of the rain the near surface soils on the slopes became
saturated and resulted in over 60 mudflows throughout the community. The
mudflows clogged drainage ditches and flowed onto residential properties. The
CHAD General Manager and the Operations Manager responded to 90 phone calls
fi received by the Blackhawk Homeowners Association to visit properties and
investigate the slope conditions. In many cases a face-to-face meeting was held with
the homeowners to discuss the slope conditions and GHAD's response. The CHAD
identified mudflows on common slopes and private property, and contracted out
cleanup operations for benches, V-ditches, residence driveways, streets and various
other conditions created by the storm. Dover Construction and Siteworks were
mobilized to perform cleanup and slide preventive operations. Slope failures were
covered with sheet plastic to prevent further saturation from subsequent storms and
were secured against high winds as well as possible. In the weeks following the
storm, GHAD's in-house geologist will visit every site to complete the evaluation of
the slope conditions. The GHAD General Manager will prepare formal incident
reports for each site and mail them to the homeowners. A Right-of-Entry form was
g:
attached to the incident report so that the GHAD could re-enter the property in the
dry season to perform any follow-up work necessary.
Special Projects
Farallon Graphics was authorized to proceed with the GIS project with the intent of
establishing a CHAD website for the public information. The website will also
include a geographic information system that will contain all of the incidents that the
U GHAD has responded since its creation for CHAD use only.
The GHAD was contacted by the Blackhawk Corporation to meet and discuss the
distress that is occurring at the Silver Oak Town Homes project. The second unit
from the south end of the fourplex located at 567 Silver Oak Lane has experienced
cracking in the interior walls and the exterior stonework. The subdivision has
experienced similar problems in the past that have required that several units be
underpinned due to excessive settlement. It is my opinion that the distress at 567
Silver Oak is due to settlement similar to what has occurred elsewhere in the Silver

Oak project and is not landslide related. However, in order to more dearly define the
cause of the distress a geotechnical investigation will be required with three borings
and slope indicator monitoring devices. The cost of this study is estimated to be
$25,000 and was not anticipated in the 02/03 budget.
Administrative
During the second quarter Kleinfelder spent a significant amount of time ramping up
to the General Manager Position duties. Meetings were held with the relevant parties
to discuss expectations and establish communications procedures. These included
meetings with Gray Bowen and Company, Contra Costa County personnel, the
Blackhawk Homeowners Association, the Blackhawk Country Club, Kathy
Chiverton, Chief of Staff for Supervisor Donna Gerber, Tim Ryan, Legal Councils
and several Blackhawk homeowners.
Administrative costs were incurred during the December storm associated with
coordinating efforts with other Blackhawk entities and mobilizing subcontractors for
slope stabilization and cleanup. Several days after the December storm occurred
GHAD called a meeting with the Country Club and the HCFA to report on the
GHAD's efforts and to develop a plan to share personnel resources for clean up
4 operations. Both agencies were very cooperative in supplying staff to supplement the
GRAD efforts.
-- Administrative costs also included the time required to follow up with the claim
settlement with the Oppenheim's and the legal expenses from Gordon DeFraga for
settlement of the Wheatley case.

The estimated project cost is $307,000, funded by Flood Control Zone 313 (100%).
111. REASONS FOR RECOMMENDATION/BACKGROUND:
The purpose of the project is to repair failed streambank protection that is eroding both stream banks,
threatening the piers of a private bridge and compromising the integrity of a drop structure just upstream of
the failure.
The project has been determined to be in compliance with the General Plan and is exempt from CEQA. The
project consists of restoring an existing damaged public facility. The project will not result in an expansion
of use beyond that previously existing or the removal of any scenic resource.

GENERAL CONSIDERATION'S:
1. Location The project is located on San Ramon Creek at Casa Vallecita, a private
road, (Figures 1-4) in the central county community of Alamo.
2. Project Description: The project will repair failed streambank protection that is
eroding both stream banks,threatening the piers of a private bridge and compromising
the integrity of a drop structure (#3)just upstream of the failure. Can the east-bank the
project consists of removing the failed sack-concrete revetment wall. In its place a
concrete retaining wall will be installed,starting at the sidewall of the drop structure and
continuing north under the bridge,conforming back tothe east slope, and including a v-
shaped outfall for the storm drain pipe (Figure 4). The retaining wall will be backfilled
with subdrain material and imported borrow to replace the soil around the exposed
bridge piles. Further downstream the bank will be regraded to a more gradual slope,
and the bank will be armored with concreted rock slope protection. The setback of the
slope will require re-grading of the access road on top of hank to a location further east.

Project Description, Common Game (if any)and Location:Sun Ramon Creek at Casa Valleeita
Storm Damage Repair,Alamo area, County File #CP -03-25: Project Description: The project
consists of the repair of failed sack-concrete revetment with concrete and concreted-rock slope
protection. Stream banks will be regarded to less steep slopes and access roads will be realigned at
the top of bank. Five landscape redwood trees(each 4"dbh)and a backyard fence will be removed
from the County's right of way. The trees are part of a larger complex of mature landscape trees and
do not constitute a scenic resource. Drainage inlets will be constructed and reconstructed. The project
area will be dewatered and flows will be diverted around the project area, Any sediment laden waters
will be treated prior to release into downstream areas. Standard construction best management
practices will be implemented. Real property transactions may occur in support of this project.
Project location: The project is located in Alamo in the central County area. (Figures 1-4)

consists of the repair of failed sack-concrete revetment with concrete and concreted-rock slope
protection. Stream banks will be regarded to less steep slopes and access roads will be realigned at
the top of bank. Five landscape redwood trees (each 24"dbh)and a backyard fence will be removed
from the County's right of way. The trees are part of a larger complex of mature landscape trees and
do not constitute a scenic resource. Drainage inlets will be constructed and reconstructed. The project
area will be dewatered and flows will be diverted around the project area. Any sediment laden waters
will be treated prior to release into downstream areas. Standard construction best management
practices will be implemented. Real property transactions may occur in support of this project.

II. FINANCIAL IMPACT:
The estimated project cost for the project is$30,044, funded by Drainage Area 30C {104°fo}.
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project consists of lowering the invert of the Line A channel so that it can adequately drain the discharge
from the detention basin. The project will start 1000 feet downstream of the outfall and regrade the channel
at a flatter slope to drain the new outfall. The gabion drop structure,located just upstream:of the low point,
will be reconstructed to safely connect the upstream end of the channel invert with the new lower channel
invert. Construction will occur during the dry season. However,Line A may need to be dewatered. Normal
flows will be maintained downstream of'the project site at all times. Standard Best Management Practices
(BMPs) will be employed:. All exposed slopes will be hydroseeded with a mix of native grasses upon
completion of the project. Habitat in the project site consists primarily of ruderal grassland and freshwater
marsh habitats and lads riparian vegetation. Since habitat is poor, there is minimal potential for listed
species to occur within the project area. Pre-construction surveys will be conducted for burrowing owl
(Achene runic aria) and California red-legged frog (Rana aurora draytonii) in order to ensure that these
species are not impacted.
The project has been determined to be in compliance with the General Plan and is exempt from CEQA.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the projects may result in a delay of design and construction and may jeopardize funding.

GENERAL CONSIDERATIONS:
1. Location: The project is located in the city of Brentwood just south of Lone Tree Way and east of
Fairview Avenue. (See Figures 1-2)
2. Project Description: Line A is an existing rock lined earthen trapazoidal channel that receives water
from a recently constructed detention basin. The outfall from the detention basin is approximately 1.5
feet lower than the current invert of the channel at the discharge point; this is too shallow to effectively
drain the detention basin. Line A is a ditch constructed in uplands and is not within U.S. Army Corps of
Engineers jurisdiction. The project consists of lowering the invert of the channel so that it can adequately
drain the discharge from the detention basin. The project will start 1000 feet downstream of the outfall
and regrade the channel at a flatter slope to drain the new outfall. The gabion drop structure, located
just upstream of the low point, will be reconstructed to safely connect the upstream end of the channel
invert with the new lower channel invert. The drop height of the reconstructed drop structure will be two
feet. Twenty feet of rock lining will be re-installed immediately downstream of the drop structure.
Proposed Subdivision 8546, located along the east channel bank, is expected to grant the District
additional right of way along the eastern property line of the channel. This easement will encompass our
access road and will be granted under a separate instrument. Additional right of way transactions may
be necessary.
Construction will occur during the dry season. However, Line A may have flowing water during the time
of construction in which case the repair area will need to be dewatered. Normal flows will be maintained
downstream of the project site at all times. The dewatering system implemented by the contractor will be
reviewed by the County and approved by the Department of Fish and Game. A sediment filter dam will
be installed downstream of the project site to minimize sedimentation within the Line A as a result of the
project. The repair activity will be kept to the minimum necessary to accomplish the repair, and the work
site will be kept clear of construction debris. Environmentally Sensitive Area (ESA) fencing will be
installed to clearly define the project limits and impact area. Operation of equipment within the channel
will be kept to the minimum amount possible; however, in order to access the entire site, heavy
equipment will be required to operate within the bed of the channel. Standard Best Management
Practices (BMPs) such as locating stockpiles outside of the streamzone, fueling and maintaining
equipment at designated staging areas, and maintaining a clean worksite will be employed. All exposed
slopes will be hydroseeded with a mix of native grasses upon completion of the project.
The project area is surrounded on all sides by either recently developed land or agriculture lands.
Habitat in the project site consists primarily of ruderai grassland and freshwater marsh habitats. A
Southern Pace Railroad line abuts the project area on the west side. The drainage within the project
site has no riparian cover or low flow channel and the water within the drainage will likely dry up or be
very warm during the dry season. Since habitat is poor, there is minimal potential for listed species to
occur within the project area. A burrowing owl (Athene cuncuaria) currently occupies an area
approximately 900 feet north of the project along the bank of the Line A. Construction crews will access
the project via property either to the east or west, to maintain the appropriate buffer zone for the
burrowing owl outlined by the Department of Fish and Game (DFG). Potential habitat for burrowing owl
within the project site is marginal due to the large amount of rock lining the channel. Weekly monitoring
indicates no burrowing owls are occupying the project area. The County will continue to coordinate with
DFG to ensure that burrowing owl disturbance is property avoided. The project site is not likely to
support California red-legged frog (Rana aurora draytonli) (RLF) due to the high level of urbanization,
lack of riparian cover, emergent vegetation, deep pools, and the highly modified condition of the
trapezoidal earthen channel. In order to ensure that RLF are not impacted, a qualified biologist will
conduct pre-construction surveys for RLF within two weeks of the start of construction. Based on the
habitat characteristics, in addition to the presence of existing drop structures downstream, a silty/clayey
substrate, and overall absence of suitable spawning and rearing habitat, Coho salmon (Oneorhynchus
kisutch), Chinook salmon (ancorhynchus tshawvytscha) and California steethead (Oncorhynchus mykiss
irdeus) are not expected to occur in the project area.
