Reasons for Recommendations and Background: The Upper and Lower Sand Creek Basins are regional detention basin facilities planned to remediate storm waters generated by the future urban development in the Cities of Antioch and Brentwood,within the Sand Creek watershed. Both basins are large facilities capable of holding large quantities of storm waters. As part of the development of these basins,large quantities of soils must be removed from the sites to construct the basins. The soils must be tested for contaminants,and classified by type before they will be accepted by potential disposal sites. Additional testing is also required for design and construction parameters,and to meet the submittal requirements for the State Division of Dam Safety. All of this testing must be done by a certifiedgeotechnical engineer. IV. Consequences of Negative Action: If this Board Order is not approved, the consulting services agreement will not be extended and future construction of the basins will be delayed. Financial impact: The estimated cast of the amended contract increase is $140,000, funded by Developer's Fees(71%) and Flood Control Zone 3B (29%) funds. III. REASONS FOR RECt3MMENDATION/BACKGROUND: The amendment to the Consulting Services Agreement is necessary in order to include work associated with the San Ramon Creek Channel Improvements Mitigation Planting project and to increase in the Consulting Services Agreement to cover additional work for Dougherty Valley Development,including the San Ramon Creek Channel Improvements Mitigation Planting project. IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the amendment may result in reduced services from A.S. General: Review the existing site Conditions, plans and speccations; prepare reports summarizing current site conditions and recommendations; develop supplemental plans and/or specifications, and assist the County in administrating construction contracts as necessary to achieve success criteria established by the California Department of Fish and Game (DFG) Streambed Alteration Agreement. Verify compliance with California Department of Fish and Game and applicable County requirements. 2. Review suitability of materials and equipment specified. 3. Review installation and maintenance requirements to determine if adequate direction was conveyed to ensure proper installation and maintenance of improvements. B. The County shall provide all related engineering, outside testing including geological boring samples and soil composition testing for plant suitability,hiring of contractors, procurement of materials and equipment, printing and distribution of documents and advertising costs. C. The consultant can provide the above services as an additional expense if required by County at the rates set forth by the Schedule of fees. Vlll. Aciditional Services A. Provide at the request of the County at additional cost. IX. Schedule of Fees A. The fee for the above-described services shall not exceed L40,000.00 without written authorization by the County. B. Rates shall be as shown in Appendix B of the original Consulting Services Agreement by and between the County and the consultant for the Dougherty Valley Landscape Architectural Services effective June 18, 2002 and as amended herein. The rate for outside consultants shall be amended to cast plus 10%for the San Ramon Creek Channel Improvements Mitigation Planting Project. This rate shall apply to outside consultants, independent testing and other outside services requested by the County. III. REASONS FOR RECOMMENDATION/BACKGROUND: The project consists of planting trees, shrubs, and bulbs on approximately 30,000 square feet along Stone Valley Road. Twenty-five trees will be planted in accordance with the Stene Valley Road Improvements project. One hundred and three trees will be planted to enhance Stone Valley Road. Trees and vegetation were chosen as to re-introduce native trees and shrubs and for their resistance to frost,drought,smog,and wind; their tolerance of poor soil conditions; their ability to encourage the return of wildlife, and; their capability to offset vehicular emissions and provide shade cover(large crowning trees). The project has been determined to be in compliance with the General Plan and is exempt from CEQA because it can be seen with certainty that there is no possibility that the activity may have a significant adverse effect on the environment.The project consists of minor alterations in the condition of land, water and/or vegetation as identified in Section 15304. No scenic resources will be removed as a result of the activity. The Notice of Exemption was previously filed by the County Clerk on April 27, 2000. IV.
