SUBJECT: AMENDMENTS TO THE BY-LAWS AND MEMBERSHIP OF THE
ADVISORY COUNCIL ON EQUAL. EMPLOYMENT OPPORTUNITY
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION'S:
1. EXPAND the definition of the "Labor Involved in Training" seat to include
apprenticeship and vocational training, alternative education programs, and
workforce development within the trades;
2. RENAME and REDEFINE the Minority-Owned Business seat to"Business", and
expand eligibility to include all businesses.
3. RENAME and REDEFINE one Community seat to "Education", with the following new
eligibility requirements: to be representative of schools, community college districts
(student,teacher, administrator); and to be a resident of Contra Costa County.
4. ELIMINATE the term limit for membership on the Advisory Council on Equal
Employment Opportunity.
BACKGROUND:
On October 7, 2002, the EEOAC nominated Jonothan Dumas for reappointment to the
Council after conducting a recruitment from which only two applications were received and
one of the two was subsequently withdrawn. The IOC approved the nomination. However,
upon verification of the pending vacancies, staff learned that a Board-established term limit
precluded Mr. Dumas's appointment without further consideration. On November 4, the IOC
reconsidered Mr. Dumas's nomination in light of the term limit, and recommended to the
Board of Supervisors that the Labor Involved in Training seat definition be broadened to be
more inclusive and that a new recruitment be conducted based upon the broadened seat
definition to attract a wider array of candidates. In recognition of the need for the EEOAC to
fill its vacant seats, the Board of Supervisors reappointed Mr. Dumas on an interim basis
pending a new seat definition and recruitment. Mr. Dumas consented to this arrangement.
EEOAC staff also requested that the IOC consider redefining the Minority Owned Business
seat and the IOC concurred with this recommendation.
At the request of the l'OC, the EEOAC reviewed its current membership requirements and
made subsequent recommendations regarding seat definitions and term limits to the IOC
which, at its May 5 meeting, the IOC approved.
