SUBJECT: CONTRACT WITH CONTRA COSTA COUNTY BAR ASSOCIATION
FOR PROVISION OF CRIMINAL CONFLICTDEFENSE SERVICES
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
APPROVE and AUTHORIZE the County Administrator, or designee, to execute a contract
with the Contra Costa County Bar Association, in an amount not to exceed $1,250,000 to
continue to provide mandated'criminal conflict defense services for the period July 1, 2003
through June 30, 2004, subject to cancellation if not approved as part of the Final Fiscal
Year 200312004 Budget.
FISCAL IMPACT
The costs incurred under this contract in FY 2003-2004 will be included in the County
Administrator's Proposed 2003-2004 Budget and are anticipated to be appropriated in the
Final Budget for FY 2003-2004. Provision of conflict defense services by the Bar
Association is contingent upon appropriation of funds in the Finan Budget.
BACKGROUND/REASON(S)FOR RECOMMENDATION(S):
Since 1983, the County has contracted with the Contra Costa County Bar Association for
the provision of conflict defense services. The original contract'was in response to the
escalating cast of conflict defense services under the old system of court-appointed
counsel. Subsequently, in FY 1991-92,the Public Defender created an Alternate
Defender's Office to handle conflict cases. The cases referred to the Bar Association
generally represent multiple co-defendant cases in which the Alternate Defender's Office
can only handle one co-defendant.

The contract with the Bar Association for conflict defense services includes only the costs
associated with representing criminal and delinquency cases referred to the Bar
Association through a written affidavit conflict by the Public Defender and the Alternate
Defender. It does not include provision for costs of representation of dependency cases.
These cases have been excluded from the County's contract since the Lockyer-Isenberg
Trial Court Funding Act of 1997 placed the responsibility for payment of costs associated
with such cases within the Courts' State Trail Court Funding budget. It is no longer a
County financial obligation.
CONSEQUENCES OF NEGATIVE ACTION:
Payment of criminal conflict attorney services is a mandated County cost. If the
recommended action is not approved, the contract with the Bar Association will terminate
June 30, 2003. The appointment and payment of private attorneys for conflict cases that
cannot be handled by the Alternate Defender's Office will revert to the court-appointed
method used prior to the Bar Association contract. All active and new criminal and
delinquency conflict cases will be referred to the courts for appointment of defense
counsel.

SUBJECT: Contract for Education Services in Adult Inmate Facilities '
SPECIFIC REQUEST{S}OR RECOMMENDATION(S)&BACKGROUND AM JUSTIFICATION
1. RECOMMENDATION:
APPROVE and AUTHORIZE the Sheriff, or his designee, to execute a Contract on behalf of the
County with the Contra Costa County Office of Education in the amount of$225,849 for the
continued provision of educational services to inmates in Contra Costa County adult detention
facilities for the periodof July 9, 2003 through June 30, 2004.
Il. FINANCIAL IMPACT:
NONE. This Contract is fully funded by the Inmate Welfare Fund.
Ill. BACKGROUND:
The County has contracted with the Contra Costa County Office of Education since 9985 to
provide educational services at the adult detention facilities. These services provide inmates
with educational and vocational training to include: basic literacy, GED preparation, substance
abuse prevention, computer skills, flood'control, landscaping and woodworking.
IV. CONSEQUENCE OF NEGATIVE ACTION:
This opportunity to prepare inmates to become contributing members to society upon their
release would be lost.

1. RECOMMENDATION:
APPROVE and AUTHORIZE the Sheriff, or his designee, to execute an Interdepartmental
Services Agreement with the Employment and Human Services Department in an amount not
to exceed $102,500 to provide Weed and Seed community policing services to the residents
of Rodeo and North Richmond for the period of January 1, 2003 through September 30, 2003.
11. FINANCIAL IMPACT:
NONE. This is an on-going program and the costs and reimbursement are included in the
Office of the Sheriffs budget.
111. BACKGROUND:
Weed and Seed community policing services provided by the Office of the Sheriff augment
community involvement and police availability for the residents of Rodeo and North Richmond.
The program also enhances relationships between police and residents through participation
in neighborhood meetings, answering complaints, paying home visits, and working with youth
and their families.

111. BACKGROUND:
The County has contracted with Friends Outside since 1980 to provide counseling and social
services at the County adult detention facilities. These services assist inmates in maintaining
ties to the community while incarcerated and to reintegrate upon release from custody.

APPROVE and AUTHORIZE the Sheriff, or his designee, to execute a Contract on behalf of
the County with the Good News Jail and Prison Ministry in the amount of$100,000 to provide
counseling and chaplaincy services for inmates in Contra Costa County adult detention facilities
for the period of July 1, 2003 through June 30, 2004.

NONE. This Contract is fully funded by the Inmate Welfare Fund.
111. BACKGROUND:
The Good News Jail and Prison Ministry will coordinate all chaplaincy activities Within the
Custody Services Bureau of the Office of the Sheriff. These services include arranging for
the conduction of services and counseling (grief, pre-marriage, family, etc.) by representatives
of various organizations to ensure the diverse spiritual inmate needs are met. Trained
volunteers from local clergy, laity, seminary students and the community provide a variety
of support services to include regular visitation, the delivery of materials, and bible study
classes.
IV. CONSEQUENCE OF NEGATIVE ACTION*
In addition to providing on-going support to the inmates, the Good News Jail and Prison
Ministry will respond to crisis and emergency situations involving inmates and family members
and assist in job placement for inmates upon release. Failure to approve this Contract would
eliminate services critical to the welfare and rehabilitation of inmates held in County facilities.
