SHIU, PUBLIC WORKS DIRECTOR DATE: April 8, 2003 SUBJECT: SUB 8456—Authorize the Public Works Director or designee to Reimburse Centex Homes with funds deposited by Pacific Development Group for improvements completed on State Route 4 and Bixler Road, Discovery Bay area, District III SPECIFIC REQUEST(S) OR RECOMMENDATION(5) & BACKGROUND AND JUSTIFICATION RECOMMENDATION(S) Authorize the Public Works Director or designee to reimburse Centex Homes the amount of$128, 474.56 for work completed along State Route 4 and Bixler Road. Pacific Development Group deposited the said amount to the County as required by condition of approval #54 of Subdivision 8456. The reimbursement will provide Compliance with condition #54 of Subdivision 8456 and condition #37W of SUB 7679. BACKGROUND/REASONS FOR RECOMMENDATIONS Bixler Road improvements were constructed by Centex Homes under SUB 7679 as a condition of approval. Centex Homes entered into a Subdivision Improvement Agreement with the County on August 9, 1994. State Route 4 widening improvements were constructed under RA 1031 (x-ref SUB 7907 and 7679) as a condition of approval for SUB 7679. Centex Homes entered into a Road Improvement Agreement with the County for RA 1031 on November 7, 1995. These improvements were accepted by the Board of Supervisors as complete on December 4, 2001. Subsequently in 2002, Pacific Development Group constructed improvements along State Route 4 and Bixler Road as a condition of approval for SUB 8455. The conditions of approval also required that Pacific Development Group reimburse Centex Homes for improvements constructed by Centex Homes, along the SUB 8456 frontages. The County has coordinated with Centex Homes and Pacific Development Group in an effort to gain agreement on the reimbursable amount. The Public Works Department has determined that completion of this reimbursement will comply with the conditions of approval for both Subdivision 7679 and Subdivision 8456. The reimbursement amount was determined based on a quantity estimate from record drawings of permanent, salvageable pavement and utility relocations by Centex Homes on the east side of the ultimate centerline of Bixler Road and north side of the ultimate centerline of State Route 4 along the subject frontage. The reimbursement amount of$128, 474.56 was received from Pacific Development Group and deposited into the Road Improvement Special Revenue Fund (Deposited March 6, 2003, DP ##401582, $128, 474.56). Upon approval by the Board of Supervisors, this amount will be released to Centex Homes and therefore releasing any further responsibility of Pacific Development Group relating to condition of approval #54 for Subdivision 8456. Any interest accrued will be returned to Pacific Development Group. FISCAI. IMPACT There is no impact to the General Fund. The County has not funded any of the improvements related to this action. The improvements were conditioned to the developers and completed by the developers with oversight by the County. CONSEQUENCES OF NEGATIVE ACTION If the action is not approved, the deposit will be returned to Pacific Development Group and the conditions of approval for Subdivision 7679 and Subdivision 8456 will not be met.
