AUTHORIZE the Chair to sign a revised letter to Senator Perata regarding inclusion of the Richmond ferry project in the pending Bridge Toll Expenditure Plan for SB 916 (Perata, D-Oakland); 2. ADOPT a "Watch" position on SCA 2 (Torlakson, D-Antioch). FISCAL IMPACT NONE to the General Fund. If SB 916 is approved by the legislature and the voters, it will generate additional revenue for transportation projects in Contra Costa County and elsewhere in the Bay Area. If SCA 2 is approved by the legislature and the voters, it will make it easier for local governments to raise new revenues for transportation through the ballot box. BACKGROUND/REASONS FOR RECOMMENDATIONS The Board of Supervisors on March 11 reviewed positions on six bills that were recommended by the Transportation, Water and Infrastructure Committee. The Board adopted the recommended positions on four of the bills, but asked for follow-up information and further review of two of the bills. The two bills are SB 916 regarding allocation of future bridge toll revenues to certain transportation projects, and SCA 2,which would change the voter-approval threshold to a simple majority for transportation ballot measures that have a smart growth component. FOLLOW-UP ON SB 916 AND SCA 2 APRIL 1, 2003 Page 2 BACKGROUND/REASONS FOR RECOMMENDATIONS (Continued) The Board of Supervisors requested revisions to the draft letter to Senator Perata regarding the expenditure plan for SB 916, along with additional data and background from the recently completed ferry expansion plan from the Bay Area Water Transit Authority (WTA)). The Board also requested further discussion on certain elements of SCA 2. This report provides the requested information. SB 916 Senator Perata's bili, SB 916, would ask Bay Area voters to authorize a $1 increase in bridge tolls on the seven state-owned bridges in the Bay Area (all bridges except the Golden Gate Bridge). The bill would allocate the additional toll revenue to a specific list of projects compiled by Senator Perata,with assistance from the Metropolitan Transportation Commission and countywide agencies including the Contra Costa Transportation Authority. Senator Perata has indicated the list isn't yet considered final. His office is still receiving input on the transportation projects to be included. Senator Perata intends to limit the projects to those that directly address congestion on the bridges and can be implemented in the near term. SB 916 is subject to approval by the legislature this year and Bay Area voters in November 2004. At this point SB 916 is considered a"spot bill,"with further detail – including the expenditure plan –yet to be added. The County previously requested the bridge toll expenditure plan include all four of the ferry sites proposed in the WTA's ferry plan—Richmond, Hercules/Rodeo, Martinez, and Antioch/Pittsburg. However, Senator Perata's office has suggested the County select one ferry site as its priority for the bridge toll plan. The Board on March 11 indicated its intention to seek opportunities to fund and develop all four of the ferry projects. Each of the four sites has its advantages. The Richmond site has had ferry service in the recent past, facilities are in place, and it is the nearest-term ferry project in Contra Costa as recommended in the WTA ferry plan, with initial service recommended for 2008. This is several years earlier than the other sites in Contra Costa County. The Martinez site has the advantage of a tie-in with the new Martinez Intermodal Station. The Board believed this project also is worthy of funding, along with the Antioch/Pittsburg site, which will provide East County commuters with another commute alternative. A ferry site in Rodeo will require significant and costly dredging and therefore is considered a long-term project. Since the Richmond site is considered the nearest-term project in the ferry plan, has a recenthistory of ferry service and has facilities in place, the revised draft letter indicates this project is best suited for inclusion in the Bridge Toll Expenditure Pian. The revised letter to Senator Perata (Exhibit A) is intended to reflect the Board's discussion regarding this issue. Exhibit B is the "Toll Bridge Travel Pattern Analysis" provided by the Bay Area Toll Authority. The data indicate Contra Costa County contributes nearly one-third (29%)of all westbound commute trips over the Bay Bridge each morning (see page 3 of the Exhibit). The table on page 5 of the Exhibit provides a breakdown of the amount of Bay Bridge commuting that originates in each part of the Bay Area and several sub areas within Contra Costa 'County. The data are based on the Metropolitan Transportation Commission's traffic forecasting model, not on surveys of commuters. Exhibit C contains excerpts from the WTA's Implementation and Operations Plan for ferry service. The excerpt includes the Executive Summary which documents all the planned routes, and portions of additional material. Page 17 of the Exhibit features a bar chart showing the Richmond site would begin its initial service in 2008,the Antioch-Martinez line in 2012, and Hercules/Rodeo in 2013. Exhibit D is the Bridge Toll Expenditure Plan developed to date by Senator Perata. The Senate Select Committee dealing with the plan refers to this list as the"Tier 1 Project List." These are the projects recommended for inclusion in the Expenditure Plan to date. Note the plan includes ferry projects in San Francisco,Vallejo, Oakland,Alameda, Larkspur, and Berkeley/Albany, but no Contra Costa sites. Also please refer to the"Bay Bridge Corridor" section on the first page of the Exhibit. Note the project list for this corridor lacks any project that provides more transit alternatives for Contra Costa County even though the County contributes nearly one third of all westbound Bay Bridge commuters each morning. ..................................I...........I................................................................................................... FOLLOW-UP ON SIB 916 AND SCA 2 APRIL 1, 2003 Page 3 BACKGROUNDREASONS FOR RECOMMENDATIONS (Continued) The full text of SB 916 was provided in the March 11 Board agenda packet. Since it is only a spot bill, and is 52 pages in length, the full text has not been reproduced in this packet. SCA 2 The Board on March 11 discussed SCA 2, Senator Torlakson's bill regarding the voter majority threshold for transportation sales tax measures with smart growth components. The bill would enable local agencies to pass ballot measures for transportation sales taxes with a simple majority vote, provided that 25 percent of the revenues from the measure would be allocated to smart growth planning. As written the bill provides a very broad definition of"smart growth planning (see Exhibit E) "'Smart growth planning'means land use planning programs that conserve open space, reduce air pollution, and provide housing in close proximity to population and employment centers." The Transportation, Water and Infrastructure Committee recommended a position of "support in concept," pending amendments expected to occur in the months ahead. The Board of Supervisors chose not to adopt a position, seeking further discussion of the bill. Of particular concern to Board members was the bill's requirement that 25 percent of the revenues generated by transportation sales tax measures must go to smart growth planning. Likely amendments to SCA 2 Staff suggests the Board adopt a "Watch" position on SCA 2 at this time based on recent information from Smith Wafts Company, the County's state advocacy firm for transportation. Smith Wafts indicates there is a high likelihood that Senator Torlakson will substantially amend the bill. For example, Senator Torlakson has indicated in committee hearings that he is willing to reduce or possibly eliminate the 25 percent requirement for smart growth allocations. This is in response to comments he has received from numerous interests. It also is likely the bill's majority threshold will be raised from 50 percent to 55 percent, which would be consistent with Assembly Constitutional Amendment (ACA) 7 (Dutra, 13- Fremont). The Board of Supervisors on March 11 adopted a position of "support in concept"on ACA 7, recognizing that amendments are likely to that bill as well. In addition, Smith Wafts advises the County of growing legislative support for another means of transportation revenue generation that may have broader public support. Known as the "flip-flop" concept, this would switch the majority thresholds for passage of general taxes and special taxes. The threshold for passage of general taxes—currently a simple majority—would be raised to two-thirds, while the threshold for special taxes — currently two-thirds —would be lowered to a simple majority. ADDENDUM TO ITEM SDA April 1, 2003 The Board of Supervisors considered a follow-up report on Senate Bill 916 and Senate Constitutional Amendment 2 requested at the Board of Supervisors meeting on March 11, 2003. John Greitzer, Community Development Department,presented the staff report and recommendations. The Board discussed the matter and the following issues were raised: ➢ Supervisor Uilkema requested an amendment to the letter to Senator Perata asking if the expenditure plan included funds to improve the security at the transit stations, to include ferry,rail and bus stations. ➢ In paragraph 2 of the second page of the letter, Supervisor DeSaulnier requested"but not limited to"be added for the sentence to read"Before adopting a position of support the Board seeks assurance that Contra Costa County's needs will be adequately addressed by the plan including,but not limited to,ferry service." The Chair then invited those who wished to address the Board regarding this matter. There were no speakers. The ferry plan recently completed by the Bay Area Water Transit Authority identified four ferry sites in Contra Costa County, including Richmond, Hercules/Rodeo, Martinez, and Antioch/Pittsburg. The Board of Supervisors believes all four sites have merits, and will look for funding opportunities to develop all four of them. The Richmond site will address the heavy commute load originating in western Contra Costa County along the overcrowded 1-80 corridor. The Martinez site has the advantage of a tie-in with the new Martinez Intermodal Station and its rail and bus connections. Hercules/Rodeo provides a site in the northwestern part of the County and would complement downtown/waterfront redevelopment plan in either location, whichever is chosen. Antioch/Pittsburg would provide another commute alternative for the increasingly congested State Route 4 Corridor. S.Herninger,Metropolitan Transportation Commission R.McCleary,Contra Costa Transportation Authority EXHIBIT B Toll Bridge Travel Pattern Analysis This analysis uses superdistrict-to-superdistrict vehicle trips(peak direction for 2 hours in a.m.)which cross the seven state-owned bridges to attempt to 1)assess who(by county of origin)is commuting across(paying the tells)the bridges.,2)determine which corridors(bridge approaches)are most utilized to access the bridges,and 3)provide an indication of what may be the most effective types investments in new transit and other services to provide to meet travel demands. Origin and destination vehicle trip tables(peak direction)and maps(peak and non-peak direction)for each of the bridges are attached.A summary of the travel patterns for the peak direction for each of the bridges is provided below. Benicia-Martinez Bridge (southbound) • Users of the Benicia-Martinez Bridge(southbound direction)by county of trip origin include. Solan 72.5% Napa 4.7% Marin/Sonoma 3.3% Out of Region/Other 19.5%0 100°/0 • There are approximately 11,590 southbound vehicle trips on the Benicia-Martinez Bridge during the two-hour a.m.peak period,which is about 65%of total bridge trips during this time period. • A large majority(66.3%)of the southbound trips crossing the Benicia-Martinez Bridge originate in Solano County with destinations in the central and eastern Contra Costa County. For trips using the Benicia Bridge,42%originate in the Benicia/Vallejo area and 24.2%originate in the Fairfield/Vacaville area with destinations in the Concord and Walnut Creek areas. ■ The Benicia-Martinez Bridge also has a significant number(19.5%of all southbound trips)of southbound trips,which originate from outside of the region. Most likely these trips are originating in the Davis/Sacramento areas. Most of these trips are also destined for the central and eastern.Contra Costa County areas. • A large number of trips across the Benicia-Martinez Bridge access the bridge through Interstate 80 to Interstate 680,using the 1-80/680 Interchange. Carquinez Bridge (southbound) ■ There are approximately 9,650 southbound vehicle trips on the Carquinez Bridge during the two-hour a.m.peak period,which is about 64%of total bridge trips during this time period. • Users of the Carquinez Bridge(southbound direction)by county of trip origin include: Solano 65.8% Napa 10.0% Marin/Sonoma 1.5% Out of Region/Other 22.4% 100% • Most of the southbound trips crossing the Carquinez Bridge originate in Solano County with major destinations to west Contra Costa County,Berkeley,Oakland and San Francisco.Almost 32%of the trips crossing the Carquinez Bridge originating in Solano County have destinations in the Richmond/West Contra Costa County area. A significant number(66%)of the trips that crass the Carquinez Bridge travel the length of 1-80 to/through the Bay Bridge approaches, connecting to Berkeley,Oakland, Southern Alameda County, and San Francisco. • As with the Benicia-Martinez Bridge,the Carquinez Bridge also has a significant number(21.8%of all southbound trips)of southbound trips,which originate from outside of the region. Most likely these trips are originating in the Davis/Sacramento areas. Most of these trips are destined for the Oakland and San Francisco areas. Richmond-San Rafael Bridge(eastbound) • During the a.m. 2-hour peak,eastbound and westbound vehicle trips are fairly evenly divided on the Richmond-San Rafael Bridge.There are approximately 4,404(54%)eastbound vehicle trips and 3,770(46%)westbound trips during this time period. • Users of the Richmond-San Rafael Bridge(eastbound)by county of trip origin include. Marin 70.2% Sonoma 21.6% Out of Region/Other 8.2% 104°10 ■ Most(54.2%)of the eastbound trips crossing the Richmond-San Rafael Bridge originate in Marin County with destinations to the Berkeley and Oakland areas. 2 As a result,these vehicle trips are mixing with the other I-80 trips in the Albany/Berkeley area. Antioch Bridge (southbound) ■ There are approximately 844 southbound vehicle trips on the Carquinez Bridge during the two-hour a.m.peak period, which is about 64%of total bridge trips during this time period. • Users of the Antioch Bridge by county of trip origin include: Solana 22.9% Out of Region/Other 77.1% 100% ■ Most Antioch Bridge users access their Bay Area destination by utilizing Route 4 in eastern Contra Costa County. San Francisco-Oakland Bay Bridge (westbound) ■ Users of the San Francisco-Oakland Bay Bridge(a.m.,westbound direction)by county of trip origin include: Alameda 53.6% Contra Costa 29.3% Solana 8.9% Napa 1.1% Out of Region/Other 7.1% 100% • Approximately 30%e of all bridge crossings during the a.m.. 2-hour peak period are on the San Francisco-Oakland Bay Bridge. During the 2-hour peak.period, westbound(16,610—52%)and east bound(15,460—48%)vehicle trips are rather evenly divided.However,as longer periods of time during the morning travel period are examined westbound trips become increasingly more of the total. ■ Twenty-seven percent(27%)of the total trips across the Bay Bridge originate in the Oakland area(Superdistrict 18). ■ In terms of vehicle trips,the Interstate 80 corridor is the most heavily utilized corridor leading to the Bay Bridge, followed by the 1-880,1-580, and Route 24 Corridors respectively. 3 San Mateo-Hayward Bridge (westbound) • There are approximately 7,600 westbound vehicle trips on the San Mateo- Hayward Bridge during the two-hour a.m.peak period,which is about 57%of total bridge trips during this time period. • Users of the San Mateo-Hayward Bridge(westbound)by county of trip origin include: Alameda 84.6% Contra Costa 8.2% Solan,Marin and Sonoma 0.8% Out of Region/Other .4% 100°/0 • The majority(61.300)of vehicle trips on the San Mateo-Hayward Bridge originate in the San Leandro/Hayward/Fremont areas. • Approximately 8.0%of vehicle trips on the bridge originate in central and eastern Contra Costs County and about 6.5%originate in eastern Alameda County. • Of the total trips crossing the San Mateo-Hayward Bridge approximately 60% head in a northern direction on 101,while the remainder head south on 101. Dumbarton Badge{westbound} ■ "There are approximately 6,150 westbound vehicle trips on the Dumbarton Bridge during the two-hour a.m.peak period,which is about 68%of total bridge trips during this time period. • Users of the Dumbarton Bridge by county of trip origin include. The California Constitution conditions the imposition of a special tax by a city,county,or special district upon the approval of 2/g of the voters of the city,county, or special district voting on that tax, and prohibits these entities from imposing an ad valorem tax on real property or a transactions or sales tax on the sale of real property. (a) A ei� , county, a city and county, a local 36 transportation authority, or a regional transportation agency may, 37 with the approval of a majority of those voters of the jurisdiction 38 voting,on the proposition,impose a special tax upon the privilege 39 of selling tangible personal property at retail within that 40 jurisdiction, if both of the following conditions are met: 98 1 SCA 2 —4- 1 4-1 (1) The tax is unposed exclusively for the purpose of funding 2 transportation projects and services and related smart growth 3 planning. 4 (2) Thee;county,city and county,or the local transportation 5 authority, or regional transportation agency is otherwise 6 authorized by lav to impose a new tax in the form of a special tax 7 upon the privilege of selling one or more classes of tangible personal property at retail within its jurisdiction. 9 (b) At least 25 percent of the revenues derived from any tax 10 imposed pursuant to subdivision(a)shall be used for the purpose I 1 of funding smart growth planning. 12 (c) For purposes of this section: 13 (1)' "Local transportation authority" means an authority 14 designated pursuant to Division 19 (commencing with Section 15 18(000) of the Public Utilities Code. 16 (2) "Regional transportation agency„ means all of the 17 following: 18 (A)', The Metropolitan Transportation Commission created by 19 Section 665012 of the Government Code, as that statute read on 20 January 1, 2002. 21 (B) The Los Angeles County Metropolitan Transportation 22 Authority,or any successor to that authority. 23 (C), The Change County Transportation Authority. 24 (D) Any local or regional transportation entity that is 25 designated by statute as a regional transportation agency. 26 f2)- 27 (3) "Funding of transportation projects and services" includes 28 the servicing of indebtedness issued for the purpose of funding 29 those transportation projects and services. 30 31 (4) "Smart growth planning" means land use planning 32 programs that conserve open space, reduce air pollution, and 33 provide housing in close proximity to population and employment 34 centers. 35 Second—That Section 4 of Article XIII A thereof is amended 36 to read. 37 Seefieft4. 38 Sec. 4. A general tax is not deemed to 14 have been increased if it is imposed at a rate not higher than the 15 maximum rate so approved. I hope you can include this important ferry transportation project in the expenditure plan that will be part of SB 916. We note the"Tier 1" expenditure plan developed to date includes ferry projects in San Francisco, Vallejo, Larkspur, Alameda, Oakland, and Berkeley/Albany, but none in Contra Costa County. We also nate the expenditure plan doesn't include any projects that provide Contra Costa commuters with more transit alternatives for the Bay Bridge corridor, even though Contra Costa County generates nearly one third of all westbound Bay Bridge commute trips each day. The Contra Costa County Board of Supervisors encourages development of all feasible modes of travel as alternatives to the single-occupant automobile. We believe ferry service can be a valuable component of the transportation network given adequate resources, and we welcome your efforts to help develop these resources. The ferry plan recently completed by the Bay Area Water Transit Authority identified four ferry sites in Contra Costa County, including Richmond, Hercules/Rodeo, Martinez, and Antioch/Pittsburg. The Board of Supervisors believes all four sites have merits, and will look for funding opportunities to develop all four of them. The Richmond site will address the heavy commute load originating in western Contra Costa County along the overcrowded I-80 corridor. The Martinez site has the advantage of a tie-in with the new Martinez Intermodal Station and its rail and bus connections. Hercules/Rodeo provides a site in the northwestern part of the County and would complement downtown/waterfront redevelopment plan in either location, whichever is chosen. Antioch/Pittsburg would provide another commute alternative for the increasingly congested State Route 4 Corridor. Honorable Don Perata Letter April 1,2003 Page 2 of 2 The Board of Supervisors believes the Richmond site is best suited for inclusion in the Bridge Toll Expenditure Plan for several reasons. First, it is forecasted by the Water Transit Authority to be the "nearest term" project of the four sites in Contra Costa County. The WTA plan calls for service from Richmond to begin in 2048, several years earlier than the other Contra Costa County sites. In addition, Richmond has a history of previous ferry service, which was provided as recently as 2401. Facilities are already in place, although improvements may be needed. Since the Bridge Toll Expenditure Plan is expected to have the capacity for only one ferry site in Contra Costa County,the Board of Supervisors requests the Richmond ferry project be included. We hope to be able to support SB 915 when the bill and its Expenditure Plan are ready. Before adopting a position of support the Board seeks assurance that Contra Costa County's needs will be adequately addressed by the plan, including ferry service.
