RECOMMENDATIONS
ADOPT resolution number 2003/220 supporting the process to place the reauthorization of
Measure C – 1988 on future ballots (See Exhibit A).

BACKGROUND/REASONS FOR RECOMMENDATIONS
Contra Costa Transportation Authority(Authority)staff has prepared a resolution supporting the
process to place the reauthorization of the Measure C transportation sales tax(Measure C-88)
on future ballots. This resolution is scheduled for consideration by the Authority at their meeting
on April 16, 2003. Authority staff has requested the Board and the cities consider adopting
similar resolutions. The text for this resolution is reflected in Exhibit A. County staff believes this
resolution is consistent with the Board's actions to date on the reauthorization of Measure C-88,
and recommends its adoption by the Board. The remainder of this report provides background
for this recommendation.
On January 28, 2003, the Board of Supervisors considered a report on reauthorizing Measure
C-88. The Board took a number of actions, including:
• authorizing the Chair to send a letter to the Authority reiterating the Board's support for the
renewal of the measure and it's request for a joint meeting to discuss issues related this
effort;
• directing the Community Development Director to work with County Counsel to obtain a
determination from the state offices of Legislative Counsel or the Attorney General on the
County's interpretation of the statutes applicable to the reauthorization of Measure C-88;

• directing the departments of Community Development and Public Works to initiate planning
for workshops in each supervisorial district to allow residents to participate in defining an
expenditure plan and growth management program, and coordinate with the Authority and
interested cities on these workshops; and
• requesting the Board's Ad Hoc Committee on Smart Growth to report to the Board on
related initiatives that could be coordinated with the reauthorization of Measure C-88, such
as the Shaping Our Future project.
On February 19, 2003, the Board and the Authority held a joint meeting on the renewal of
Measure C-88. At that meeting next steps in the renewal process were discussed, including 1)
scheduling public workshops on the renewal of Measure C-88 in each supervisorial district,
jointly sponsored by the Board of Supervisors and the Authority; and 2) deciding the time for
future meetings between the Authority, the Board and the cities on the renewal effort.
Public workshops on the renewal of Measure C-88 have been scheduled in each supervisorial
district (see Exhibit B). The first workshop is on April 24th, the last is on May 8th. County staff
has been working with Authority staff and other agencies on the preparation for these
workshops. Extensive outreach activities are underway to encourage residents to participate in
defining a renewed Measure C-88. The first three workshops will be taped by CCTV and
broadcast to help inform those residents who cannot attend and to encourage participation at
the subsequent workshops.
Planning is also underway for a future meeting of the Board, the Authority and the cities to
discuss the process for renewing Measure C-88 and the issues a new measure should address.
This meeting will be coordinated with efforts to implement the recommendations from the
Shaping Our Future project. The Policy Advisory Committee for Shaping Our Future has
schedule a workshop for the public on April 5th to review its recommendations. This will be
followed by a meeting of the Board and the cities on May 171h.
On March 17, 2003, County Counsel and the Authority's attorney jointly submitted a request to
the Attorney General for an opinion on whether renewal of Measure C-88 requires the Authority
to adopt a new transportation expenditure plan pursuant to Public Utilities Code Section (PUC)
180206, or can the Authority amend the existing plan pursuant to PUC Section 180207. The
Board will recall the opinion from County Counsel that to renew Measure C-88, the Authority
must prepare a new Expenditure Plan and have it approved by a majority of the city councils, as
required by PUC Section 180206. The annual amendment procedure in PUC Section 180207,
which only required approved by the Authority board, does not appear to be adequate for
reauthorization of Measure C-88 for another 20 years. If requested by the Authority, the Board
of Supervisors generally is required to call a special election and cannot refuse to do so.
However, if the Authority does not comply with the requirements of PUC Section 180206 or the
California Environmental Quality Act, this could provide a justification for the Board to refuse to
call an election until the Authority complies with the law. The conditions citied in the last
paragraph of the resolution in Exhibit A are consistent with the requirements in PUC Section
180206. There is nothing in this resolution that would prevent the Board from rejecting
placement of a new Measure C-88 on a future ballot if the Authority does not comply with the
law.
Approval of the resolution by the Authority, the Board and each city will help ensure that every
jurisdiction is engaged in the renewal process. Without every jurisdiction's participation, it is
unlikely that the joint efforts by the Board and the Authority to renew the measure will be
successful.

RESOLUTION NO. 2003/220
WHEREAS, Measure C — Transportation Sales Tax Program was passed by the voters of Contra
Costa County in 1988, includes a twenty year (20) sunset, and is set to expire April 1, 2009; and
WHEREAS, Measure C includes a Transportation Improvement and Growth Management Plan
outlining specific projects and programs; and
WHEREAS, the Contra Costa Transportation Authority (CCTA) has done an excellent job of
delivering the projects and implementing the programs that were included in the original Measure C
program, resulting in many new transportation improvements in the County; and
WHEREAS, many of the projects included in the original program were not fully funded by Measure C
and still require additional local funds to complete, in accordance with the Countywide Transportation
Plan (CTP); and
WHEREAS, continued population growth in Contra Costa County and the Bay Area has continued to
stress our existing road, highway and transit system in Contra Costa County; and
WHEREAS, the CCTA, working in coordination with a broad cross-section of stakeholders, interest
groups, and engagement of the general public, has begun the process of examining the elements of a
renewed Measure C with the possibility of placing the measure on the November 2004 ballot; and
WHEREAS, the ability to renew Measure C will depend on the consensus built among elected
officials and stakeholder groups throughout Contra Costa County, including, but not limited to, the
elected officials comprising the CCTA, the Contra Costa County Board of Supervisors (Board of
Supervisors), and all Contra Costa County cities, as well as the support of community stakeholder
groups and the general public;
NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors supports the efforts led by
CCTA to reauthorize and extend Measure C as a primary funding source for transportation
improvements in Contra Costa County; and
BE IT FURTHER RESOLVED, that the Board of Supervisors agrees to fully participate in the process
to renew Measure C and recognizes the importance and legitimacy of all the County's cities, the
County, CCTA, stakeholder groups and the general public as a critical part of the process; and
BE IT FURTHER RESOLVED, that the Board of Supervisors supports the policy that before the new
Measure C is placed on the November 2004 ballot that the measure will have obtained the support of
2/3rds of the members of the CCTA, a majority of cities representing a majority of the population in the
incorporated area of Contra Costa, and a majority of the Board of Supervisors.
