RECOMMENDATION
EXERCISE the third option for a one-year extension of Lease with Dolan Foster Enterprises, Inc. and
APPROVE the third one year extension of Sublease with the Pre-School Coordinating Council,
effective April 1, 2003 for the premises at 2711 A&B Willow Pass Road, Bay Point for continued use
by the Family Preservation Program.
FINANCIAL IMPACT
The rental rate for the second option term of April 1, 2003 through March 31, 2004 is $1,480.00 per
month, an increase of$80.00 per month over the previous rate. Rental income from the sublease will
increase by this same amount. Rental income is credited to the Employment and Human Services
Department which is also charged the expenses for the premises.
BACKGROUND
Approval of the third and final lease extension will provide for continuation of the Family Preservation
Program which has been located at the above premises since July 1, 1998. The County has a
Master Lease for the premises with Dolan Foster Enterprises, Inc. and subleases the premises to the
Pre-School Coordinating Council to operate the Family Preservation Program. The Master Lease
contains a third and final extension option for the period of April 1, 2003 through March 31, 2004.

1. APPROVE a Lease Amendment, commencing March 1, 2003, with Thomas E. Stewart for the
premises at 816 Main Street, Martinez, for additional office space as requested by the Clerk-
Recorder, under the terms and conditions more particularly set forth in the Lease Amendment.
2. AUTHORIZE the Director of General Services, or designee, to execute the Lease Amendment
on behalf of the County and to EXERCISE any options to extend the Lease.
FINANCIAL IMPACT
The impact to the current fiscal year for the additional space is an additional $3,700.00 per month for
the four.month period from March 1, 2003 through June 30, 2003. The required Lease payments total
$84,075.00 over the 19-month term of the Lease. The cost for this additional space along with rent
for two other interim locations will be offset by savings realized as a result of the County's loss of the
Clerk-Recorder's current lease at 730 Las Juntas. The initial cost savings is estimated at $2,200 per
month.
BACKGROUND
GROUND
Approval of this Lease Amendment will provide for interim office space needed to offset the lass of
office space at 730 Las Juntas, Martinez as a result of the March 31, 2003;termination of that Lease.
This additional space along with two other locations in downtown Martinez will provide the Clerk-
Recorder with a total of approximately 9,600 sq.ft. to replace the 6,500 sq.ft. Las Juntas space'. The
total square footage of the interim space is greater than the Las Juntas space since it is intended that
the interim space will be occupied with a minimum of remodeling. It is anticipated that the interim
space will be needed for about eighteen months pending completion of construction of a new building
for the Clerk-Recorder.

FIRST AMENDMENT TO LEASE
816 MAIN STREET
MARTINEZ, CALIFORNIA
FOR THE
CLERK-RECORDER
CONTRA COSTA COUNTY
L PARTIES. Effective on MAR 0 4 2003 , THOMAS E. STEWART,
hereinafter called "LESSOR", and the COUNTY OF CONTRA COSTA, hereinafter
called"COUNTY", mutually agree and promise as follows:
2. PURPOSE: The parties desire to amend that lease ("Lease") entered into
between LESSOR and COUNTY dated September 17, 2002 for those'certain Premises
consisting of approximately 500 square feet of office space, commonly known and
designated as 816 Main Street, Martinez, California, to add approximately 2,540 square
feet to the existing Premises, amend the lease term and rent paragraphs and add a lease
extension paragraph.
3. AMENDMENT:
A. Paragraph A.2. LEASE OF PREMISES shall be deleted in its entirety and
replaced with the following:
A.2. LEASE OF PREMISES: Commencing September 17, 2002,
LESSOR., for and in consideration of the rents, hereby leases to COUNTY,
and COUNTY leases from LESSOR those certain premises described as
follows: Approximately 500 square feet of office space commonly known
and designated as 816 Main Street, Martinez, California ("Premises") and
more particularly described in Exhibit "A", attached hereto and made a part
hereof, together with the non-exclusive use of the restrooms, break room
and common areas.
Commencing March 1, 2003, the Premises shall be expanded to
include the remainder of the first floor, which consists of approximately
2,640 square feet, which includes the restrooms, break room, and

conference room, and more particularly described in Exhibit "B", attached
hereto and made a part hereof.
The Premises, as amended, shall total approximately 3,140 square
feet, which comprises the entire first floor of the building located at 816
Main Street, Martinez, California.
B. Paragraph A.3. TERM shall be deleted in its entirety and replaced with the
following.
A.3. TERM: The term of this Lease shall be two (2) years and fourteen
(14) days commencing September 17, 2002 and endingSeptember 30,
2004.
C. Paragraph A.4. RENT shall be deleted in its entirety and replaced with the
following:
A.4. RENT: Commencing September 17, 2002, COUNTY shall pay to
LESSOR as rent for the use of the Premises a monthly rental payable in
advance on the tenth day of each month during the term of this Lease as
follows:
a. THREE HUNDRED THIRTY-EIGHT AND 3 8/100
DOLLARS ($338.33) for the period from', September 17,
2002 through September 30, 2002.
b. SEVEN HUNDRED TWENTY-FIVE DOLLARS AND
NO/100 ($725.00) per month for the period from October 1,
2002 through February 28, 2003.
C. FOUR THOUSAND FOUR HUNDRED TWENTY-FIVE
AND NO/100 DOLLARS ($4,425.00) per month for the
period from March 1, 2003 through September 30, 2004.
Payments shall be mailed to: Thomas E. Stewart, 816 Main Street,
Martinez, CA 94553 or other place as LESSOR may from time to time
designate by written notice to COUNTY.

D. Paragraph A.4.5. EXTENSION shall be added as follows:
A.4.5. EXTENSION: This Lease may, at the option of COUNTY, be
extended upon the same terms and conditions, except the; rental shall be
adjusted as follows:
a. First Option: For a six (6) month term commencing October
1, 2004 and ending March 31, 2005 at a rental of FOUR
THOUSAND SIX HUNDRED AND NO/100 DOLLARS
($4,600.00)per month.
b. Second Option: For a six (6) month term commencing April
19 2005 and ending September 30, 2005 at a rental of FOUR
THOUSAND SIX HUNDRED AND N0/100 DOLLARS
($4,600.00)per month.
C. Third Option: For a six (6) month term commencing October
1, 2005 and ending March 31, 2006 at a rental of FOUR
THOUSAND SEVEN HUNDRED EIGHTY-FIVE AND
NO/100 DOLLARS ($4, 785.00) per month.
It is understood and agreed COUNTY shall give LESSOR sixty (60)
days prior written notice of its intention to exercise this option to extend
this Lease. However, in the event COUNTY does not give such written
notice, its right to exercise any option before termination of this Lease shall
not expire until fifteen (15) days after receipt of LESSOR'S written
demand to exercise or forfeit said option.

4. EFFECT: Except for the Amendment agreed to herein, the Lease dated
September 17, 2002, remains in full farce and effect.
IN WITNESS WHEREOF, the parties have executed this Amendment as of the date set
forth above.
